The ECHR awarded three defendants in the Hizb ut-Tahrir cases compensation for violation of the right to family life

The European Court of Human Rights awarded compensation to three defendants in the Hizb ut-Tahrir cases from Tatarstan: Azat Zagiev and Zafar Yakubov - 3.5 thousand euros each, Irek Mukhametov - 4.5 thousand euros. This is reported by Idel.Realii with reference to the website of the ECtHR.

The European Court found that the Russian authorities violated their right to respect for family life (Article 8 of the Convention on Human Rights) by banning them from visiting relatives in the SIZO.

In relation to Mukhametov, the authorities also violated the right to have the case heard within a reasonable time (Article 5 of the Convention). In custody before the entry into force of the sentence, he spent almost two years.

• Azat Zagiev and Irek Mukhametov lived in Almetyevsk before their arrest. They were sentenced to 13 and 18 years in a strict regime on charges of involvement in Hizb ut-Tahrir. Zafar Yakubov is a defendant in one of the Kazan cases of Hizb ut-Tahrir, he received 17 years in a strict regime. All three were found guilty of recruiting into terrorist activities (part 1 of article 205.1 of the Criminal Code), Mukhametov and Yakubov of organizing the activities of a terrorist organization (part 1 of article 205.5 of the Criminal Code), Zagiyev of participating in activities (part 2 of art. 205.5 of the Criminal Code).
• Hizb ut-Tahrir was recognized as a terrorist organization in Russia. In this regard, criminal cases are initiated in different regions of the country, while the defendants are sentenced to various terms in a strict regime colony only on the basis that they met in apartments, read religious literature and spread their ideas. According to a number of experts, Hizb ut-Tahrir was unlawfully recognized as a terrorist organization, since its members in Russia did not prepare or carry out terrorist acts.
