"They are like slaves there." Torture and bullying in a psychiatric hospital

On December 16, the State Duma adopted a package of amendments to the Code of Criminal Procedure on forced hospitalization in psychiatric hospital "" persons detained "-for a period of not more than six months. The Kaliningrad Andrei Tsipukhovsky in a psychiatric hospital is already a year and a half, despite the minority of the charges - drug storage. His mother Olga Tsipukhovskaya demanded that the Investigative Committee initiate a criminal case against the head physician of the hospital, which allows mockery of the patient.

In a specialized type in Chernyakhovsk, 38-year-old Andrei Tsipukhovsky, in July 2020, was in a psychiatric hospital in Chernyakhovsk. He was placed there by a court decision, which a year ago found him guilty of the “popular” article of the Criminal Code of the Russian Federation (drug storage).

Tsipukhovsky did not admit his guilt and appealed. But for a year and a half, he has been forced to live side by side with the most unpleasant criminal contingent - maniacs, pedophiles, cannibals. There is even its divineer in this hospital.

“I was there just before the start of Covid, I was asked to go to the boy’s mother, who killed my grandmother with an ax, dismembered and buried me in different parts of the garden,” says Maria Bonzler ’s lawyer. - And then the doctor said that this boy was talking all the time with a maniac who killed 25 women, he is asking him thoroughly.

According to Art. 101 of the Criminal Code of the Russian Federation, forced psychiatric treatment can be prescribed to a person who is a particular danger to himself or for others and requires constant and intensive observation. The very fact that a person is placed in such a hospital in a drug article, a shock causes, the lawyer says. There are only seven similar medical workers in the country. From ordinary psychiatric hospitals, they are distinguished by rigid conditions of content.

- Such hospitals were created for maniacs who mowed under the crazy people. And there were such psychiatric hospitals that were worse than prison. To some extent, the regime there is more severe than in the colonies of a special regime: the slightest disobedience follows the punishment in the form of Aminazin injections, fastening to the bed and dressing a humble shirt. During his location in this institution, Tsipukhovsky was sentenced to penalty in the form of Aminazin injections and was beaten several times with patients. There, a person is completely deprived of a personality, it is like "flying over a cuckoo's nest." We do not say that Andrei is completely healthy, perhaps he has a disorder. But not so much as to place in such places, ”Bonzler notes.

According to her, now, during the pandemic, patients are deprived of walks, fresh air and dates with loved ones.

Torture, beating, hospital

In the hospital, Tsipukhovsky was by a court decision, which a year ago found him guilty of storing drugs on an especially large scale. According to investigators, in November 2019, Tsipukhovsky received 48 "LSD" LSDs, or 0.99 grams of a narcotic drug by mail. However, Andrei himself denies guilty and says that he came to the post office for a postcard: he has a hobby - to exchange cards with foreign friends. At the post office he was detained by the FSB officers, and at that moment they, according to Tsipukhovsky, threw him drugs. In court, an employee of the post confirmed that the letter for Tsipukhovsky was brought to the post office by the FSB officer. She later abandoned the testimony.

After the detention, Tsipukhovsky spent six months in SIZO-2 in Chernyakhovsk, where, according to the lawyer, he was tortured by the UFSIN employees: for example, the usual case here was to force the prisoner to stand "on the Smirno Street" within 18 hours.

- And then in a pre -trial detention center he was terribly beaten by the employees, he was all blue. And so far, the pre-trial detention center cannot interrogate-they do not allow the investigator because of the Covid. A year and a half cannot interrogate! And after this beating Tsipukhovsky immediately in Serbsky was sent, ”says Bonzler.

In May 2020, the court appointed him a forensic psychiatric examination, and psychiatrists of the National Medical Research Center of Psychiatry and Narcology named after V.P. Serbian was diagnosed in Tsiphov schizophrenia and paranoid syndrome.

"Specially planted to maniacs"

In the Chernyakhovsky hospital, Tsipukhovsky was beaten by other patients several times. His mother claims that this was facilitated by the medical staff who transferred him to the wards to particularly dangerous criminals. For example, in September he was placed in a ward for a patient who killed several women. There was a conflict.

- On September 28, Andrei had to prepare for the trial. And he is not able to prepare - there are radio and people scream, he has to put a pillow on his head so as not to hear it. When he asked to do it, they began to provoke him. Beaten. One of them flew up, hit the left temple, there was a bruise under his left eye, ”says Olga Tsipukhovskaya .

- The doctor specially planted him to maniacs. She told him: "If you are killed, what we can do, they are crazy." Why are they doing this? I don't know. There was an administrative case on this beating, there was still no court, ”says Bonzler.

Olga Tsipukhovskaya filed a complaint with the regional prosecutor’s office and the investigating committee, in which she accused the psychiatrists of pressure on her son and demanded to initiate a criminal case on the facts of excess and abuse of authority, as well as for bullying and torture.

According to her orders, my son was transferred many times with particularly dangerous criminals - dividing and pedophiles in order for them to be mocked at him, they beat him, stating that if he was killed She is not to blame for the patients and the personnel to provocations in relation to my son in order to bring him out of physical and mental equilibrium.

“They want to break the will so that he is limp like a rag.” He was turned into a lump of nerves, they are taken away food, the books that I pass, ”says Olga. - They do not give pens, notebooks, there is no way to even prepare for the court. He had to declare hunger strikes several times for three to five days, after which they betrayed the paper or threatened that they would begin to feed him forcibly. He had to change before the court, he could not go to court in a little and Mike. And for half an hour he begged the doctor to give him jeans. This is a mockery, psychological pressure. People there as a consumable, over which you can arrange torture, they are like slaves there. He was more than once threatened that they would grind him (with medications), turn into a vegetable. And they will not be anything for it.

Andrei Tsipukhovsky also regularly finds himself in the "supervised" chambers - the analogues of the prison frame in which the video recorders are installed.

- Under the supervision, he was planted for the last time for the fact that he did not remove the orange peels. They can plant for any oblique look, ”says the lawyer. “But they have no right to do this, he is not their patient.” It is simply contained in this clinic before the court’s decision, they must hold it separately. And in fact, he was placed in a punishment cell several times.

In the hospital, Tsipukhovsky is almost a year and a half. Meanwhile, in May 2018, the Constitutional Court pointed out the inadmissibility of the unlimited content of the suspects and accused of a psychiatric hospital, noting that the term of their stay in such a medical institution at the preliminary investigation should be counted during the detention, says lawyer Marianne Andryushin .

On December 16, the State Duma adopted amendments to the Code of Criminal Procedure, setting the term for the premises for treatment in such cases up to six months with "the possibility of its repeated extension and the restriction of the contacts of the person placed on treatment with other persons."

-The news is that a person hospitalized in a psychiatric hospital is at least once a month is subject to mandatory psychiatric examination by a commission of psychiatrists. At the same time, doctors will have to inform the preliminary investigation body about the results of a psychiatric examination at least once a month and the court in which his case is being investigated, the lawyer explains.

Meanwhile, the defense of Andrei Tsipukhovsky repeatedly petitioned for the appointment of a repeated forensic psychiatric examination, as she no longer trusts the Center named after Serbian, "known as the center of punitive psychiatry," says Maria Boncler:

-We asked to appoint an examination in St. Petersburg, in a psychiatric hospital No. 6, in a department specially intended for being detained. However, the Zelenograd District Court ultimately sent Tsipukhovsky only to an outpatient examination to Kaliningrad, which is absolutely useless, since it cannot cancel the inpatient verdict, but can only send to the stationary, which we hoped for, the lawyer notes. - The survey was conducted by three doctors, they did not introduce themselves to us. The main questions were asked by a woman aged. And when we received a resolution of the examination, there were signatures of only two doctors, which is a violation. I believe that the third doctor wanted to send him to a stationary examination, but they had an order and they ignored it.

In March, the Kaliningrad Regional Court, having examined the case of Tsipukhovsky, found inconsistencies in it and sent for a new consideration. However, in the fall, the court again made a decision not in favor of Tsipukhovsky, after which his defense filed an appeal. Its consideration was supposed to take place in early December, but the meeting was postponed to January 12 due to the state of health of the defendant.

- He came to the court in stress, could not even speak. He is simply brought to despair. I am even afraid that there may be tragic consequences, ”says Olga Tsipukhovskaya. - Now I think about going to an appointment with the Prosecutor General, to the head of SK Bastrykin, to the presidential administration. I complained earlier, but so far I get the only unsubscribes.
