The court dismissed the lawsuit against Nirvana members. It was submitted by an American who, in infancy, became the subject of the cover of the Nevermind album.

A California court has dismissed a lawsuit filed by Spencer Elden, who sued former Nirvana members for distributing child pornography. The Wrap writes about this, citing court documents.

Spencer Alden, 30, is the subject of Nirvana's famous Nevermind album cover, which depicts a naked baby in a swimming pool reaching for a dollar bill on a fishhook. Elden was photographed for the cover at four months of age.

In August 2021, Elden filed a lawsuit alleging distribution of private sexual material and coercion into commercial sexual activities under the age of 18. The defendants in his lawsuit were not only former members of Nirvana, but also the authors of the Nevermind album cover and several record companies. He demanded $150,000 from each defendant.

In December 2021, the defendants' lawyers demanded that Elden's claim be dismissed, calling his claims unfounded. They noted that he repeatedly recreated the pool shot for Nevermind anniversaries, tattooed the album title on his chest, and signed copies of the Nevermind cover to sell on eBay. In addition, the statute of limitations on his claims expired back in 2011, the lawyers added.

Elden had until December 30 to file his objections to this motion. He didn't. Therefore, the court rejected his claim, but left him the opportunity to file it again until January 13, taking into account the position of the defendants.
