
On January 6, 2021, both chambers of the Congress were supposed to approve the results of a meeting of the board of electors , at which Joe Biden was elected President of the United States.
Donald Trump and his supporters insisted that mass falsifications took place in the elections and unsuccessfully tried to challenge the results in court. On the day of the meeting, in order to once again express a protest, the conservative female movement Women for America First organized a rally in Washington called Save America. At the rally, a number of conservative activists, republican politicians (including members of Congress) and Trump himself spoke at the rally. He again refused to recognize the results, demanded that Vice President Mike Pence cancel them, and after that he called on his supporters to go to the building of Congress with him. The crowd really began to move in the direction of the Capitol Hill, but Trump himself instead went to the White House.
Meanwhile, in Congress, Republicans tried to challenge the results of the vote in the presidential election in Arizona. But the meeting had to be stopped when the protesters broke through the police cordon around the Congress building and began to make their way inside with a battle. Politicians hastily evacuated from the building. The protesters captured the Senate meeting room, defeated the office of the speaker of the House of Representatives of Nancy Pelosi and other legislators. The building was able to free from the protesters only three and a half hours after the start of the assault by the police and the National Guard.
After that, the Congress meeting resumed, and the Republicans again tried to challenge the voting results in Arizona and Pennsylvania . But they did not have the right number of votes.
During the riots , five people were killed , and more than 150 police officers were injured (15 of them were hospitalized). Subsequently, about one and a half hundred police officers also quit their posts. Many complained about post-traumatic stress, as well as a contemptuous attitude from those whom they have to protect-especially the Republican congressmen who deny the very fact of any riots in the Capitol, and their participants are called “tourists”.
According to the results of the events of January 6, the FBI opened an investigation and stated that about two thousand people participated in the riots. As of the end of December 2021, the authorities detained and charged more than 700 defendants , and the FBI believes that about 350 people are hiding from the authorities, including 250 who participated in attacks on police officers. About 80 detainees were placed under the arrest before the court, about 170 were already plead guilty and cooperate with the investigation, almost all of them are accused of easy articles not related to violence. In relation to more than 70 of them, sentences have already been issued .
Basically, the charges against participants in the riots in the Capitol were put forward by low articles . Nobody has yet received charges of organizing an uprising and/or tranquil. More than half of the convicts did not receive any prison deadlines (the rest of the deadlines from 14 days to six months), having escaped with a conditional term or house arrest. Five more accused on heavy articles received from eight to 41 months of prison, mainly for attacking police officers.
The sentences were carried out by 19 judges of the Court of the County of Colombia, who were appointed both democrats and republicans (including four judges appointed by Trump). In 22 cases, the judges sentenced a more strict punishment than the charge asked.
In total, the judges have so far appointed fines from $ 500 to 5,000, and the total damage from the riots is estimated at $ 1.4 million. The accused complain of poor conditions of detention in prisons and beating by guards.
Just a few months before, during the protests of the Black Lives Matter related to the murder of African American George Floyd , both parties quite clearly declared their position regarding protests. Democrats harshly criticized the police and ardently supported the Black Lives Matter movement, trying to maximize the scale of violence and justify the motivation of their participants, and the Republicans demanded to put an end to the rebels and pogroms, standing to the side of the police with the slogans Back the Blue Lives Matter .
But after what happened in the Capitol, everything turned upside down. Now the Democrats resolutely condemned the riots and the fact that the liberal Columnists had already called an attempt by a putsch without abysses. The Republicans called people fighting with the police “tourists” and “ peaceful patriots” , who “were very angry” , or were “ paid provocateurs ” and “antifa terrorists” . When a bill on the award of the police officers of the Capitol Golden Medal of Congress was introduced to the House of Representatives, 12 Republican congressmen voted against , disagreing with the text of the resolution in which the participants of the riots were called "rebels." A similar split between parties manifested itself on the investigation of the incident on January 6.
In June 2021, the speaker of the House of Representatives Nancy Pelosi announced the creation of a special committee to investigate the riots on January 6. It was expected that in addition to organizing public hearings to clarify the reasons for the unpreparedness of law enforcement services, the commission will also have the authority to call witnesses to establish the organizers, and also study the possible role of President Trump in the riots. Earlier, President Biden refused to create a similar commission, referring to the fact that such an investigation is the prerogative of the congress.
From the very beginning, the leadership of the Republicans opposed the creation of the commission, calling it politicized and unbalanced. As a result, the initial proposal was significantly changed by analogy with the inter -party committee, which conducted the investigation of the attack on September 11, 2001: the leaders of both parties in the Senate and the House of Representatives were invited to appoint two members of the commission (only eight), the post of chairman would receive a democrat, and his deputy republican, while both had the right to send the summons.
Nevertheless, when the time came to vote, the creation of the commission was supported by 252 congressmen , and all the other 175 Republicans spoke out against. Even the brother of the former vice president Mike Pence Greg did not support the investigation against those who called to hang his brother. With voting in the Senate, everything was even worse : 54 senators voted for the creation of the commission, against - 35 Republicans . Since the rules of Filibaster require that 60 senators vote for the adoption of the law, regardless of the quorum and the number of voters, the bill on the creation of the commission failed , although it was supported by 60% of those present. In March 2021, according to the Monmouth University survey , 53% of the Americans surveyed supported the idea of creating a commission, and in May from SurveyMonkey - already 65% .
After the failure of the bill in the Senate, the Democrats decided to make a commission only within the framework of the House of Representatives, where they had enough votes of their own faction to create it, and at the end of June they voted for its formation (this time only two Republican congressmen supported it). The democrats were taken by seven places, the Republicans-five, but after Pelosy refused to introduce two congressmen-republicans to the commission who voted against the approval of the results of the presidential election, their leader Kevin McCarthy announced that his party would not participate in the work of the commission. Then Pelosi herself appointed two Republicans to the commission who supported the bill on its creation (including the post of vice-chairman was received by Liz Chain , who fell into disgrace in her party).
The commission still continues to work. Members of the commission have already listened to the testimony of more than 250 people , most of whom acted voluntarily, without a summons. In relation to those who refused to cooperate with the commission, the Congress sent 51 summons to the turnout to testify (and about a hundred more requests for telecommunication companies for information about telephone conversations). Among them are members of a number of right -wing extremist organizations like Proud Boys and Oath Keepers, organizers of a rally on January 6 in Washington, former employees of the Ministry of Justice, White House, Trump’s election campaign, as well as a number of people from his immediate environment.
The most scandalous of them was the former adviser to President Stephen Bannon, who refused to appear in the agenda congress (she has legal force), for which he was accused of disrespect for Congress and was arrested on November 15. Similar measures can now wait for the former head of the presidential administration Mark Medous, who first agreed, and then refused to cooperate with the commission. The indications of a honey is especially important, since it is he who probably has the most complete information about Trump’s connection with the events of January 6.
Among observers and commentators there are a lot of different points of view on the events of January 6, 2021 in Washington, but the two most popular are reduced to the following.
According to one of them, the rally of the supporters of Donald Trump grew into riots, ending with the capture of the building of the congress and the subsequent acceleration of the protesters. Although Trump called on the protesters to go to the Congress building, there is no evidence that there was a certain assault plan in advance, approved by the presidential administration. Moreover, according to the sources of Reuters in the US law enforcement agencies, the FBI failed to find direct evidence of large -scale coordination of riots in order to overthrow power. Separate groups of extremists made plans for invasion of the Capitol building, but there were no specific plans for what to do next, in case of success, they also found them.
Trump himself, albeit after three hours of persuasion , but still urged protesters to go home. He did not try to introduce a state of emergency, use troops and special services to suspend the work of other authorities, and eventually peacefully transferred power to Biden. In other words, according to this version, spontaneous riots occurred, which were not supported by the president. Moreover, in his recently released memoirs, Trump adviser Peter Navarro claims that chaos in the Capitol prevented him and Stephen Bannon's plan to deliberately tighten the voting procedure with the help of the most loyal Trump members of Congress.
The alternative theory, which is mainly adhered to by liberal commentators and a small number of anti -tramissive republicans, states that the events on January 6 were an attempt by a coup, which failed for a number of reasons. As one of the arguments in her favor, the amazing unpreparedness of the American law enforcement agencies to unrest served, although the special services had enough information that some Trump supporters were prone to violence . After the start of the assault, Capitol Trump refused to mobilize the units of the National Guard to accelerate the protesters, and as a result, the decision of this, according to the CNN source, was forced to make Vice President Mike Pence.
At about 13:15 Washington time, protesters broke through the police cordon near the Capitol building. Washington mayor Mariel Bauser requested reinforcements at 13:34, but the order to mobilize the units of the National Guard came only an hour and a half after the start of the riots, and they arrived in the place about two and a half hours at 17:40. The buildings of the Capitol were cleaned from the protesters at 19:15.
Such delay could be attributed to bureaucratic inefficiency, but the report of the General Inspector of the Ministry of Defense says that the Pentagon’s employees deliberately refused to give the order to send units of the National Guard in fear of possible consequences. For example, the acting Minister of Defense during the events of January 6 Christopher Miller said that "having sent a soldier to the Capitol, I would have created the greatest constitutional crisis from the time of the Civil War." He was echoed by the former head of the CIA and the State Department, Mike Pompeo and the chairman of the United Committee of the Chiefs of Staff, Mark Milli, who feared that Trump could use the army in case of defeat in the elections.
Millie quite frankly said that in the period between the elections and the inauguration of the new president, any crisis can become an analogue of the “Fogging of the Reichstag” for Trump. When Trump announced the rally of his supporters in Washington on January 6, Millie admitted to his employees that Trump could resort to the use of the rebellion law in order to put the army under its beginning and remain in power.
The next day, the police management of the Capitol resigned. The internal investigation showed that although they had information that the building of the Capitol could become the goal of riots, the police management considered more dangerous potential counter-protesters who could arrange clashes with Trump supporters. It was also ordered not to use special tools to disperse riots, for example, light -school grenades.
In order to avoid the repetition of such events, on December 15, 2021, the Congress adopted a law that allows the head of the Capitol Capitol head to call for the help of the National Guard and other federal law enforcement agencies.
Other arguments in support of this theory are the actions of the most presidential administration before January 6. Trump really tried to use the administrative resource to change the election results in his favor. The help of him in this was provided by an official of the Ministry of Justice of Jeffrey Clark , whom Trump wanted to appoint the acting Prosecutor General. Clark himself refused to cooperate with the Parliamentary Commission for the investigation of the events of January 6, and now he, like Bannon, faces responsibility for disrespecting Congress.
The Trump's associates plan was set out in a memorandum with proposals for Vice President Penca, which was drawn up at the end of December 2020, Professor John Istman from Trump’s legal team. The plan was that the penalty, in accordance with the 12th amendment to the US Constitution and the law on the calculation of votes from 1887, would refuse to count the votes of electors from 7 states where Biden defeated. To do this, during the calculation, he must refer to the presence of supposedly contradicting results from competing colleges of electors (for this, the Republicans had to send his own “alternative” delegation of electors from each of the seven states, but in the end they did not do this) or mass falsifications. Based on this, he will declare Trump the winner - or, if he has less necessary 270 votes of electors, will convey a decision to the House of Representatives in which each staff will have one vote. And since the Republicans control 26 state delegations out of 50, Trump will also be elected president.
The hystman, along with Trump, persuaded the Pence several times to act in accordance with this memorandum, but he flatly refused. Subsequently, at the hearing in Congress, the hystman did not testify the commission, taking advantage of the 5th amendment to the Constitution . The head of the presidential administration, Mark Medous, also knew about the memorandum of Istman, in whose archive they found a presentation with a description of the plan for the cancellation of voting results and emergency announcements under the pretext of the intervention of Venezuela and China in the elections. An equally curious find among the medical documents was correspondence with the former governor of Texas and the then Minister of Energy in the administration of Trump Rick Perry. On November 4, that is, before the presidential election, Perry wrote to Medouses that if Trump loses in Georgia, North Carolina, Pennsylvania and other states where the Republicans control the legislature, it will simply be not to recognize the election results and send their electors.
Thus, according to this theory, the riots on January 6 were rather an unplanned side effect of a “bureaucratic” coup prepared in advance, which failed for a number of reasons: the Republicans did not put forward alternative electors; Trump could not consolidate his one -party members in Congress so that they unanimously speak out against the approval of the presidential election; а вице-президент Майк Пенс не последовал советам Истмана и не стал саботировать подсчет голосов выборщиков и отдавать победу Трампу. Либеральная общественность США ответила на события 6 января смесью злорадства над неудачной попыткой путча трампистов и мстительного преследования их участников. В сети даже появилось крупное сообщество Sedition Hunters («Охотники за изменниками»), занимающееся поиском участников беспорядков, в том числе с использованием технологии распознавания лиц искусственным интеллектом. Но даже за пределами специализированных сообществ было довольно много случаев, когда об участниках штурма Капитолия сообщали их коллеги , друзья или даже родственники . То есть лево-либеральные активисты, традиционно скептически настроенные по отношению к американским спецслужбам, в этом случае стали их деятельными союзниками.
Параллельно с этим развернулась политическая кампания по осуждению или дажеизгнанию из Конгресса так называемой Sedition Caucus («Фракции изменников») — республиканцев, которые голосовали против утверждения результатов выборов, выступали на митинге 6 января или плотно взаимодействовали с организаторами. В сочетании с активной деятельностью комитета по расследованию беспорядков 6 января у консерваторов стали возникать ассоциации с периодом маккартизма .
У либеральных же публицистов стали появляться опасения касательно того, что беспорядки 6 января были лишь репетицией будущего путча.
Пока американские либералы упивались победой и продолжали охоту на оставшихся на свободе участников беспорядков, консерваторы решили провести работу над ошибками и укрепить свои позиции в органах власти на разных уровнях. Ведь поскольку административно-чиновничий аппарат и особенно его силовой блок в лице спецслужб и Пентагона не выразил достаточной поддержки и лояльности Трампу, рассчитывать на объявление чрезвычайного положения и другие силовые варианты захвата и удержания власти оказалось бессмысленно.
Поэтому в случае повторного поражения на президентских выборах в 2024 году, на которых Трамп вновь может стать кандидатом от Республиканской партии, альтернативным выходом может стать механизм, отраженный в вышеописанном досье Истмана. Но на этом пути есть несколько препятствий.
Многие политики-республиканцы поддержали заявления Трампа о том, что на выборах 2020 года были массовые фальсификации, благодаря которым якобы и победил Байден. Однако целый ряд членов партии, занимавших в администрациях штатов посты, связанные с надзором за выборами, отказались поддержать так называемую «Большую ложь» . Классическим примером такой принципиальности стал секретарь штата Джорджия Брэт Раффенспергер, который продолжал настаивать на честности проведения выборов (и победе Байдена, сохранившейся даже после нескольких пересчетов голосов ), несмотря на давление со стороны коллег по партии. Не изменил он своего решения даже после знаменитого телефонного разговора с Трампом, в котором президент настойчиво просил его «найти» около 12 тысяч голосов в пользу республиканцев, что в итоге стало одним из поводов для объявления второго импичмента.
Раффенспергер и другие чиновники, отвечавшие за проведение выборов,получили более сотни угроз убийства. Согласно одному из опросов , каждый третий работник избирательных комиссий разного уровня не чувствует себя в безопасности из-за своей работы. Это уже привело к массовому исходу сотрудников избиркомов, особенно в Пенсильвании, Висконсине, Мичигане и Аризоне, где перевес Байдена был наименьшим. По данным другого исследования , каждый шестой работник планирует уволиться до выборов 2024 года.
Эта ситуация предоставляет республиканцам отличный шанс провести в избирательные комиссии более лояльные кадры, которые уже не повторят ошибки их предшественников в 2020 году. Имея большинство в законодательных органах ряда штатов, которые в 2020 году были колеблющимися — ни у одной из двух партий там не было непререкаемого преимущества, республиканцы теперь могут начать «подминать» выборы под себя. За 2021 год в 19 штатах республиканцы приняли как минимум 34 закона , ограничивающие процедуру голосования, и еще более двух сотен законопроектов находится на рассмотрении. Также в 14 штатах приняли 24 закона , которые усиливают контроль законодательного собрания штата за избирательными комиссиями, либо ограничивают полномочия секретарей штатов по утверждению результатов выборов. Наиболее здесь показателен пример Джорджии, где в соответствии с новым законом ассамблея штата может отнимать у местных избиркомов право подсчета голосов. А в Висконсине республиканцы планируют и вовсе распустить межпартийную избирательную комиссию штата, отдать ее членов под суд и заменить комиссией из одних республиканцев.
В 2020 одним из главных препятствий для искажения результатов выборов стали суды, которые отвергли многочисленные иски, направленные на отмену их результатов. Поэтому в 2021 республиканцы пошли в атаку и на независимость судебной системы. За год в 35 штатах было внесено 153 законопроекта, так или иначе затрагивающих независимость судов. Из них 19 в 14 штатах были приняты и стали законами. Кроме того, в девяти штатах приняли 12 законов, связанных с ролью судов в выборах. В частности, в Канзасе , Кентукки и Техасе были приняты законы, запрещающие судьям приостанавливать действие избирательного законодательства.
Установив контроль над избирательными комиссиями, судами и законодательством, республиканцы смогут диктовать свою волю на выборах, не считаясь с результатами всенародного голосования. Согласно второй статье американской Конституции , решение о назначении членов коллегии выборщиков, голосующих за президента, принимает законодательное собрание штата (легислатура). С конца 19 века легислатура по традиции лишь подтверждала решение избирателей, но в деле Bush v. Gore в 2000 году Верховный суд постановил , что в спорных ситуациях легислатура может воспользоваться своими конституционными полномочиями. То есть республиканцы, получив контроль над местными законодательными собраниями, смогут назначать собственных выборщиков, ссылаясь на нарушения на выборах. В таком случае исход президентских выборов будет решаться в Конгрессе (где к 2022 году республиканцы могут оказаться в большинстве) и Верховном суде с его консервативным большинством.
В определенном смысле общественное мнение к подобному исходу уже подготовлено: октябрьский опрос NPR/PBS NewsHour/Marist показал, что среди демократов 82% верят, что выборы 2024 году пройдут честно, а среди республиканцев таких лишь 33%. Это во многом соответствует ноябрьскому опросу PRRI , согласно которому 68% республиканцев все еще думают, что выборы 2020 году украли у Трампа (среди демократов таких 6%, среди независимых избирателей — 26%).
Существующая в США политическая система сейчас в значительной степени «перекошена» в сторону Республиканской партии. Для победы на президентских выборах кандидату-демократу нужно набрать примерно на 3,5% голосов избирателей больше, чем республиканцу. Подобная ситуация связана тем, что в США непрямые выборы через коллегию выборщиков. На последних шести президентских выборах кандидаты-демократы получили большинство голосов избирателей в пяти случаях, но стали президентами лишь в трех из-за коллегии выборщиков.
Наиболее очевидным примером дисбаланса американской политической системы является Сенат, верхняя палата Конгресса, в которой каждый штат имеет по два представителя. Раньше это не создавало больших проблем, так как обе партии были примерно одинаково конкурентоспособны в крупных и малых штатах. Но со временем электорат республиканцев стал концентрироваться в малонаселенных штатах, из-за чего сейчас Республиканская партия контролирует в Сенате 50 из 100 мест, но при этом представляет лишь 43% избирателей.

В нижней палате Конгресса, Палате представителей, также есть перекос в сторону республиканцев, который существует последние 50 лет. В первую очередь он связан с джерримендерингом и поляризацией на консервативный сельский и либеральный городской электорат. Дважды, в 1996 и 2012 годах, это приводило к тому, что демократы получали большинство голосов избирателей, но меньшинство мест в Конгрессе. После 2010 года, получив большинство в законодательных собраниях многих штатов, республиканцы в пять раз чаще демократов перерисовывали границы избирательных округов. К выборам 2022 года республиканцы будут определять границы 188 округов, а демократы лишь 47 (судьбы еще 147 будут решать независимые комиссии, либо партиям придется договариваться о границах округов).
Аналогично джерримендеринг помогает республиканцам удерживать контроль над законодательными собраниями ряда штатов. Например, в 2018 году демократы получили большинство голосов на выборах в нижние палаты легислатур Мичигана, Северной Каролины и Пенсильвании, но все равно оказались в меньшинстве по количеству мест. А в 2020 году республиканцы сохранили контроль над целым законодательным собранием Мичигана, сенатом Миннесоты и Пенсильвании (там республиканцы правят с 2012 года, набрав большинство на выборах лишь один раз), хотя и получили меньшинство голосов избирателей.
Подобная практика создает стимул еще больше менять границы избирательных округов или переписывать избирательное законодательство в свою пользу для правления меньшинства и ограничения демократического волеизъявления. В Северной Каролине , Висконсине и Мичигане республиканцы использовали свое положение правящего меньшинства, чтобы лишить избранных губернаторов-демократов части полномочий, а во Флориде , Южной Дакоте и Юте по сути отменили результаты местных референдумов .
Кроме структурного неравенства политической системы, в пользу республиканцев играют и другие факторы — например,Верховный суд , где влияние нередко является продуктом случайности и политического расчета. Республиканцы чаще идут на нарушение политических норм , особенно на уровне штатов . Все это толкает США в сторону правления меньшинства, а значит и установления гибридного режима, сочетающего в себе демократические и авторитарные элементы. Это не значит, что республиканцы вообще не способны выиграть выборы и стремятся установить диктатуру — вполне вероятно, что в 2022 году на промежуточных выборах в Конгресс они одержат победу за счет термостатического характера американской политики . Но подобное «сворачивание» демократии за счет создания все более неконкурентных правил игры является лишь одним из примеров, которые политологи наблюдали в случае России и других демократий, мутировавших в автократии.
Поэтому в последние месяцы целый ряд исследователей, политологов и социологов выступили на страницах американских изданий, с тревогой отмечая авторитарные тенденции и призывая к укреплению демократических институтов. Но этот призыв, даже будучи услышанным, вероятно, останется без ответа: республиканцы рассматривают избирательные реформы демократов как не более чем попытку перетянуть электоральное одеяло на себя. И пока в Сенате существует правило филибастера, которое сейчас по сути парализует законодательный процесс силами только одной партии, борьба за демократию будет разворачиваться в отдельных штатах, а не в Вашингтоне.
