
The convicted person in the case of the “Network”* Viktor Filinkov disputes the penalties received in the colony, which ensured him torture conditions of the detention.
The defense of Filinkov filed 13 claims against correctional colony No. 1 in Orenburg, where he arrived in August 2021 to serve the 7 -year -old regime appointed by the court. But in the detachment, Victor spent the incomplete three days. The rest of the time is strict quarantine, 59 days a schizo, a month of PCT (chamber type in a colony). For a blade thrown on his birthday, he was assigned a month of the most strict form of isolation - EPT (a single chamber -type premises for the convicted region), sending to serve in Novotroitsk and issuing another 10 days of a schizo for “inter --hemous communication” on the track. Victor spent a total of five months out of six.
Filinkov’s claims are considered in the Central District Court of Orenburg by judge Marina Grechishnikova and Raisa Chuvashev.
So far, only one is completely satisfied: the reprimand announced by Victor immediately upon arrival in the colony (for not saying hello to the employee), even before familiarizing himself with the internal regulations. But in this case, the court could not do otherwise - the prosecutor's office had already canceled this reprimand.
But then, as a muffled - refusal for refusal.
In the meeting last week, the defense asked to appoint an examination of one of the evidence of the defendant (it is represented by the head of the legal service of the Federal Penitentiary Service for the Orenburg Region Andrei Denisov). Namely: applications for employment for sewing production, allegedly submitted by the Filin chief of IR No. 1. It is only written by his hand - which is obvious to any of those dozens who have been corresponding with Victor, including the Novice correspondent for the fourth year.
Moreover, Filinkov, according to this paper, also twice wrote with a mistake his own surname: “Filenkov”.

The application appeared after Victor undertook to challenge the two penalties imposed on him for incomplete three days spent in the detachment.
Victor did not move from work, on the contrary: from the very beginning he wanted to do at least some kind of business.
In those three and a half years that he spent in St. Petersburg, he read a lot, taught cellmates to mathematics, improved his English and was engaged in the development of a training course on programming "for mothers, dads and their children." I managed to make 180 classes.
In the colony of Filinkov, a talented programmer who won from various scientific competitions (including international astronomical in Baikonur) - could benefit other convicted (and employees) engage in their training. But the administration set him his Jesuit “Correction Way”: from a month a month to look at the wall a day . Victor talked about how this torture is arranged during the break of one of the court hearings:
“Of the 16 hours allotted for wakefulness: in the walking courtyard I look at the wall for an hour; A meal, when you also look at the wall ... You can’t even sleep, you just sit on the bench and look at this wall. One hour just a day they give me a letter or read a letter. <...> I brought me so many letters - I do not have time to answer in one hour, I don’t have time to read them. I do not have time to write one letter to my mother for this hour! <...> I would like to read literature in English, I brought six textbooks in mathematics with me. <...> They don’t give them to the camera, just to study, you can’t study - well, where is it suitable? <...>] These are degradant conditions. It is not that they do not socialize, they do not socialize the most stupid way. Just really people become vegetables. ”
Work on Schweik was the only option to get out of the schizo and a single chamber, Victor explains. And when the operatives asked if he would sew, he agreed on the move. I thought that at first there would be training in vocational schools, as is usually the case. But Filinkov was immediately sent to production, without even conducting safety precautions. And already on the first day he happened to see the injuries received by other convicts:
“One had a finger pierced by a sewing machine. It's scary, she sews very quickly. I saw ordinary cars in my life, of course. But industrial - never. Nothing is clear. There are buttons, to be honest - I still do not understand what they all mean. "

“For such communication, Victor received two schizo for five days,” says his defender Yevgeny Kulakov. - The first - for the “dishonest attitude to work” (discussing with a neighbor sewing the width, he laughed at the joke that this was a very important job and it is necessary to do it carefully). The second is because he "left the workplace during work." This is when other convicts invited Victor to come to see how to sew a belt.

In court, the colony officers insisted that all the necessary knowledge of teaching sewing and safety was brought to Filinkov - and in one evening! Presenting as evidence a false statement from him. Now that the court admitted that there was no training, and obliged to conduct it, the teacher began to come to Victor. And it turned out: the training program is designed for 2.5 months. ”
The court partially satisfied the lawsuit, recognizing illegal admission of Filinkov to work without training. And at the same time, he refused to cancel the two penalties imposed on him precisely because he did not go through training and did not know how to sew.
But the judge was not interested in the egregious fake of the document: the defense was denied the examination of the “Filinkov statement”. There was no assessment of the actions of the colony employees.
But from their presentation, Victor receives new penalties in the colony - for, for example, that during the court session he repeated at the request of the chairing of the jargon word.
This word, allegedly used by Filinkov, provided him with a reprimand immediately upon admission to the colony. At the trial, the judge asks to clarify exactly where he said. “I was taken to the so -called murmark,” Victor explains (he participates in the meetings in the video). He did not know the meanings of this word before. For the first time I heard from employees to accept the stage when they used it, asking Filinkov a question. Answering, he was forced to use him (he thought, the so-called some room).
The judge, not hearing: “Once again! The connection is interrupted. Gourmet? " Filinkov repeats: "Murmanka." And then Lieutenant Colonel Denisov enters: “I want to explain that the word“ Murmanka ”is a prison slang,” he says, opening the stored vocabulary of the thieves' language. - translates as a "penalty area". That is, the convicted person at the hearing is expressed by a jargon word, ”Denisov states with satisfaction. And he promises to draw up a report that will provide Filinkova with a new punishment. Victor’s complaint is dismissed.

He managed to distinguish between Denisov and a creative approach to echoing the favor of judges: he played the role of Santa Claus, who gives gifts to those who behave well. On December 28, he came to the court, loaded with New Year's packages. The first brought to the office of Judge Grechishnikova, where he looked with the phrase: "I brought gifts to you!" Since the lieutenant colonel was without a beard from Vata, he was immediately recognized by Vitaliy Cherkasov, a lawyer of Filinkov, who was in the corridor (on this day, a consideration of one of his claims was scheduled). And he managed to shoot this show on the phone, fixing how the FSINO Santa Claus further enters packages to the offices of Raisa Chuvasheva, Maria Sergienko and other judges. The lawyer shared with captured personnel with the head of the Federal Penitentiary Service in the Orenburg region Sergei Porshin, applying them to his appeal with a request for verification for the corruption component. To confirm the facts, Cherkasov proposed to additionally request and records from video surveillance cameras posted in the court building.
The audit was reduced to obtaining the explanations of Denisov himself.
He confirmed that he came to the court that day, where "in accordance with the job description at that time, he represented the interests of the Federal Penitentiary Service." It was also confirmed that Denisov “entered the cabinets with gift bags” listed by Cherkasov (including the offices of two judges, which are considering cases of Filinkov’s complaints). But, as the peddler assured, only calendars for 2022 were in packages. What Porshin does not see anything reprehensible. And since, in his opinion, the law on the status of judges does not allow us to request video recordings from cameras or other court documents, he redirected the appeal of Cherkasov to the chairman of the Central District Court of Orenburg Margarita Uslova.

Mrs. Uslova in her answer to the lawyer did not even recognize the fact of the visit of the lieutenant colonel with packages. I limited myself to a brief message: “In the journal of registration of visitors to Denisov A. A., on December 28, 2021, it was not registered. It is not possible to get acquainted with the records of video surveillance cameras located in the court building, since the archive of videos in court is not conducted. ” All.
“Very strange,” Vitaly Cherkasov comments on the “new”. - Participants in the process cannot enter the court building without registration and inspection of bags. Of course, I was just shocked. I have never met this for all the years of work - so that it was so openly in one of the parties in the case to be presented to judges who are obliged to keep a distance, not even allowing a hint of their possible bias. But in Orenburg it seems to be in the order of things. So far, for all the failures, we received only one motivation solution. It looks helpless: general phrases, not backed up with anything. One hope for the courts of the second instance. "
“New”, having examined the public procurement website, did not find a single purchase of the Orenburg Federal Penitentiary Service for the manufacture or purchase of calendars for 2022. We sent a request to Sergey Porshin with a request to clarify: where and when the calendars were acquired by which their employee gave the judges, from what funds this “compliment from the institution” was paid and who specifically instructed Lt. Col. Denisov to hold this action of extra -procedural communication. The second request "New" was addressed to Margarita Uslova. I would like to understand who and how can go to the court building without registration, whether explanations were taken from the packages of judges and whether the chairman considers their such informal communication with the parties in the case.
