Torture with administrative resource
We continue to observe the race of bills
Today, at 5 pm, the State Duma adopted in the first reading the bill “On torture” in the editorial office proposed on December 20 Andrei Klishas and Pavel Krasheninnikov. It was entrusted with the newcomer in the YP faction Irina Pankina, and the deputies from Fair Russia - Oleg Nilov, from the “new people” - Oleg Leonov and Alexei Kurinni - he was criticized from the Communist Party, but, nevertheless, he was unanimously sent for the second reading.
The intrigue is that Lyudmila Narusova in the Federation Council for about a year, along with human rights activists and hinges, prepared another project. Klishas also took part in this group, but introduced his own, overtaking Narusov on the last turn. When she, in her simplicity, asked a colleague why he did this, Klishas, from the words of Narisova, replied that the project was “lowered from the administration, and nothing can be changed there (see “ New ”No. 8 ).
The fundamental difference between the projects of Narosova and Klishas is that only the first involves the introduction of a special article on torture in the Criminal Code,
And the second follows the path of supplement the existing article on compulsion to testimony. A separate article would allow not only to understand how widespread in places of imprisonment, but also to attribute them to especially serious crimes with a period of imprisonment up to 15 years and a similar period of the statute of limitations for prosecution - and this is important, since the victims, as a rule, continue to remain in the institutions of the Federal Penitentiary Service. This project also contains additions to a number of other laws, regulating the translation of prisoners between cameras in the pre-trial detention center in order to complicate the use of “press khat”, and offering the translation of those who testified about torture, in the colony of other regions.
A few days ago, Narusova still managed to register her project in the Duma, but, in accordance with the regulations, he has so far aimed at imprisonment in the government. In parallel, passing Olympic biathlon races, this would mean a penalty circle: now catch up with Klishas with Krasheninnikov - undoubted champions in a bill “sport” - it will not be so easy.
Nevertheless, the second reading, the deadlines are not yet determined - in many ways it will depend on what will be said where the project No. 1 was allegedly “launched”. On the eve of the meeting of the Duma, two (technically even three) projects at a working meeting in the HRC was compared by Eva Merkachev, who raised the issue of torture before the president at his meeting with the Special Revolutionary. She, Igor Kalyapin, who has been dealing with the question of torture for more than 20 years, and the permanent guest of the FSIN institutions Andrei Babushkin stood up for the Narzova option. But those who are closer to the authorities believe that the tit in the hand is better than the crane in the sky: you need to bet on the projects that "supported by the administrative resource."
Now we must expect amendments that will be offered to the second reading in the State Duma. Deputies from Fair Russia and New People are waiting for the government to imprison the Narisova project in order to try to get a separate article from the Criminal Code from it about torture and try to instill it, like an apple tree to Dichka, to the Klimshas-Krasheninnikov project. Technically, this is possible, but it would politically mean the defeat of the "EP" in this matter. We stock up on popcorn, which, alas, cannot be said about those who are shaking from fear in colonies and pre -trial detention centers.
