According to the resolution 3314 (XXIX) of the UN General Assembly of December 14, 1974, aggression is any military attack on another state that is not a response. Simply put, no one has the right to attack first. In 2014, the vast majority of Russian citizens decided that in connection with the special politically circumstances, the actions of the Russian army in Crimea were justified. History showed that we were wrong. Aggression is always aggression.
Today we are aware of this clearly and clearly. The armed forces of our state for no reason, not being attacked and not having any “special” circumstances as an excuse, invaded the territory of our neighbor - Ukraine. The sovereign and not alien to the peoples of Russia of the state.
Our troops fulfill the order they had given. And they have no choice. But Russian citizens have a choice. Now we know for sure that the head of our state, President of the Russian Federation Vladimir Putin went beyond his constitutional powers, since the Constitution does not even give his right to unleash an aggressive war.
If international law still has some kind of power, the right to unleash an aggressive war does not have the right to unleash the Soverene of Russia-the multinational Russian people. If international law no longer exists, we must admit that the sovereign did not express his will clearly and unequivocally regarding the outbreak of aggressive war. Thus, neither the right, nor the Constitution, nor the will of the peoples of Russia stand behind the President of Russia given on February 24, 2022 by order to conduct a “special military operation”. This order has no foundation.
Being a guarantor of the constitution, peace and consent in Russian society, the president, proceeding to the performance of duties, makes an oath. Among other things, her text says that the President of the Russian Federation is obliged to “respect and protect the rights and freedoms of man and citizen”, without a reservation regarding the rights and freedoms of only Russian citizens. Possessing the huge political and military force given to him by the peoples of Russia and the Constitution, the President of the Russian Federation must respect the rights and freedoms of citizens of all states, both in peacetime and on the basis of the right of war. “Special military operation” means that the President of the Russian Federation not only went beyond the boundaries of his powers, both in the sense of the letter and in the sense of the spirit of the Basic Law, but also violated the oath that he gave four years ago.
Citizenship is not only the rights of membership in the political union, which is any political nation, but also the obligations of belonging to this union. We have no right to wish the troops of our state. But we are not obliged to wish them victories in an aggressive war. No one can force us to this.
We can, remaining within the framework of a peaceful civil protest, with words and actions to identify our position. This decision of the President of the Russian Federation Vladimir Putin is legal only in a narrow sense. But it is illegitimate, since it is not based on the Constitution, nor the will of the people, nor on custom, nor on the norms of international law. This decision was made in violation of the oath given to them.
The case of the future is to make a decision regarding the fate of the President of the Russian Federation, both political and on the pages of history textbooks. Our business is to express an active civil disagreement with a violation of our laws and an insult to the peaceful spirit of the peoples of our country.
The reputation of our country and its fate in the 21st century depend on how persistent, calm and consistent we will be in the coming days and weeks.
