The ECHR awarded compensation to a defender of the rights of Pomors convicted on charges of inciting hatred

The European Court of Human Rights awarded compensation of 8,800 euros to Ivan Moseev, the former president of the Association of Pomors of the Arkhangelsk Region, who was convicted in 2013 on charges of inciting hatred (Part 1, Article 282 of the Criminal Code). This is reported by the telegram channel "Network Freedoms", citing a link to the decision on the website of the ECtHR.

Moseev was accused of leaving a comment on the website of the Ekho Severa news agency under the nickname Pomory containing “a humiliating characterization and a pronounced negative emotional assessment of the Russian ethnic group.”

The ECHR considered that although Moseev's comment contained an offensive word, its text was not aimed at inciting hatred and did not call for violence. The actual compensation for moral damage, according to the court decision, is 7,500 euros, in addition, Russia was ordered to reimburse the amount of the fine paid in the amount of 1,300 euros.

The case against Moseev was opened in 2012. The public man was searched twice. The statement attributed to Moseev was subjected to examination twice: the first, which formed the basis of the case, according to experts, was carried out with violations, the second, independent, testified in favor of Moseev.

On March 1, 2013, Moseev was sentenced to a fine of 100 thousand rubles, the court of appeal upheld the verdict. According to the prosecutor's office, Moseev was dismissed from his post at the Northern (Arctic) Federal University and from the post of director of the Pomor Institute of Indigenous Minorities of the North, and was expelled from all Russian public organizations in which he was a member.

On July 8, 2014, the court declared illegal the actions of the Sberbank branch to terminate operations on Moseev’s bank account, ordered the removal of restrictions on the disposal of his own money, and decided to recover a thousand rubles in favor of Moseev as compensation for moral damage. On September 18, Moseev was excluded from the list of extremists and terrorists of Rosfinmonitoring.
