The ECHR found the long-term detention of a Bashkir opposition leader unlawful because of the video
The European Court of Human Rights declared unlawful the period of pre-trial detention of the Bashkir opposition leader Airat Dilmukhametov in the case of calls for separatism (part 2 of article 280.1 of the Criminal Code). It is reported by HRC "Memorial".
The ECHR considered that Russia had violated Dilmukhametov's right to liberty and security of person (Article 5 of the Convention on Human Rights) and awarded him compensation in the amount of 3,100 euros.
The case of calls for separatism against the oppositionist was opened in March 2019. This was already the fourth case against Dilmukhametov. The reason for the new criminal prosecution was a video on YouTube called "Appeal of the presidential candidate of Bashkortostan Airat Dilmukhametov to the V Free Russia Forum."
The examination found in the video signs of calls "aimed at the formation of a new federation by secession from Russia and the creation of a new state, with new laws and rules that satisfy the newly formed government of the Republic of Bashkortostan." In addition, according to the examination, the video incited hatred against the authorities and formed the idea of the need to elect Airat Dilmukhametov as President of the Republic of Bashkortostan.
Dilmukhametov was arrested despite his lawyer's request for a milder measure of restraint. At the same time, the court did not motivate the refusal to choose a preventive measure not related to arrest.
In August 2020, the oppositionist was sentenced to nine years in prison in a strict regime colony under articles on financing extremist activities (part 1 of article 282.3 of the Criminal Code), calls for it (part 1 of article 280 of the Criminal Code), on justifying terrorism (part 1 of article 280 of the Criminal Code). 2 article 205.2 of the Criminal Code), as well as on two episodes under the article on calls for separatism (part 2 of article 280.1 of the Criminal Code).
- In 2015, Dilmukhametov was sentenced to three years in a strict regime colony on charges of “publicly justifying terrorism” (part 1 of article 205.2 of the Criminal Code) for a religious and political treatise using verses from the Koran. He was released in 2017.
- In 2011, in connection with publications from 2008, Dilmukhametov was convicted on charges of public calls for extremist (Article 280 of the Criminal Code) and terrorist activities (Article 205.2 of the Criminal Code), as well as inciting ethnic hatred (Part 1 of Article 282 of the Criminal Code) . He spent two years in prison.
