A case was started against the lawyer Dmitry Talentov under the “fake” article after the next denunciation

Against the president of the lawyer chamber of Udmurtia and lawyer, journalist Ivan Safronov, Dmitry Talentov, opened a criminal case for the so -called "discrediting of the Russian army." The day before he was detained in Izhevsk, the security forces were searched for several addresses, interrogated and the next day was taken to Moscow to choose a preventive measure. They decided to arrest Talentov without outsiders, the court was closed. The prosecutor said that there is information “protected by law” in the case. It is noteworthy that earlier the investigation did not prevent protection about any “secret” materials.

“I'm handcuffed. They are taken to the SK. Everyone !!! ”, wrote on his talent page on the morning of June 28. A few minutes later he published another record: “Please inform everyone about my detention. I hardly write, they don’t see the UK according to Udmurtia. ” Later in the Telegram channel of the community of lawyers and human rights activists, the First Department reported that a criminal case was instituted against Talentov by the investigation department of the Main Investigative Directorate of the Investigative Committee for the South-Western Administrative District of Moscow. The searches were held in several places at once, including in the Lawyer Chamber of Udmurtia.

Talents are suspected of committing a crime under paragraph “D”, part 2 of Art. 207.3 of the Criminal Code of the Russian Federation (public distribution of knowingly false information about the use of the Armed Forces of the Russian Federation based on political hatred - threatens up to 10 years in prison).

It is known that before the detention, the talents defended the ex-journalist of Kommersant Ivan Safronov, accused of Gosizman. Earlier in this case, his colleague Ivan Pavlov participated (entered the Ministry of Justice in the register of “foreign agents”), against which a criminal case was instituted for allegedly disclosing the data of the preliminary investigation. “The detention of Dmitry Talents can cause another significant blow to the protection of Ivan Safronov. In the hands of the lawyer there were many designs of petitions in the case of a journalist, ” said Dmitry Katchev, lawyer Safronova.

Talents repeatedly expressed his anti -war position in social networks and opposed the “special operation” in Ukraine. On the eve, he commented on a blow to the shopping center in Killenechug: “Is today's horror in Kremenchug is also a part of denazification? Or is it fascism? Europe ”Talentov’s colleagues, back in April, they began to write denunciations due to publications on social networks, then the lawyer reported that the police had an audit and took explanations from him. The interest of law enforcement officers in Talents arose after the lawyer Violett Volkov erupted on the president of the lawyer chamber by an evil post in her Telegram channel:

“The head of the Udmurtia Law Chamber, the insignificance of Dmitry Talents I disrespectful, promises to expel all the lawyers who support their people from the lawyer, are proud of their army and wish the speedy victory over Nazism. Colleagues from Udmurtia, why have you tolerate this insignificance for so many years? Have you been taken hostage? 30 years in power this evil spirits. Why is he still a lawyer? "

Talents then replied that after Volkova’s sang, they tried to start an administrative case under Art. 20.3.3 Administrative Code of the Russian Federation (public actions aimed at discrediting the use of the RF Armed Forces in order to protect the interests of the Russian Federation and its citizens). “Among the studied materials, I also found this [screenshot from the case file]. Later he was discharged an administrative protocol under Art. 20.3.3 Administrative Code, but the court returned it to the policeman to eliminate errors. Since then, law enforcement officers have no longer bothered him.

"The author expresses a negative attitude towards the president"

This time, the so-called blogger-patriot and the observer of “military viewing” Roman Skomorokhov has already distinguished his informational. He himself “ boasted ” on the Web that he writes slying in different instances against “fans of ukronazism”.

“I have already said that Russia needs cleaning. And it is the Russians who should clean it. We have no other choice, ”Skomorokhov believes in his article under the heading“ Name of them is a legion ”.

On April 3, talents posted a post on his Facebook page, where he called the actions of the Russian army in Mariupol, Irpeni and Buche “Nazi practitioners”. Skomorokhov’s reaction was obvious - another denunciation in the FSB and SK. And as a result - a new “fake business” is ready.

The publication of Skomorokhov on the “military review” website appeared on April 12, and already on the 14th, the operative officer from the Center “E” drew up an act of inspection of Talent's page on Facebook, the case materials that the journalists of “Lawyer Street” familiarized themselves. The operative discovered nine publications made by talent from March 25 to April 4. But only one publication was interested in the investigation - just the very post of lawyer that Skomorokhov wrote about. At the request of the investigation, a linguistic examination was conducted. According to the expert linguist Vitaly Kuznetsov, “the author of [talents] expresses a negative (hostile, contemptuous) attitude towards Russian President V.V. Putin and his policy.” According to the expert, this is evidenced by the “use of the scornful nominations“ Killer Pu ”and“ Shobla ”.”

"When you plant good lawyers, who will then protect you"

On June 29, Talentov was taken to Moscow to choose a preventive measure. The investigation entered the Cheryomushkin court of the capital with a petition for detention for two months. The investigator motivated his statement by the fact that the President of the Law Chamber is suspected of "a crime against public security and public order, which has signs of increased danger and resonance."

The investigator believes that if the talents remain at large, it may hide, put pressure on witnesses, will also be able to prevent the proceedings on the case, because he knows the methods of investigating criminal cases and is the current lawyer.

Talentov was taken to court closer to dinner. His defenders - Pavel Biyanov, Alan Gamazov, Anastasia Kostanova, Daniil Berman, Maria Nemova and Dmitry Tkachev - expected their colleague in the morning.

Talents were already in the Aquarium in a white jacket and a black cap, leafing through the documents. His lawyers have already managed to get acquainted with the materials. The investigator Alexei Panyutishchev took advantage of this pause and tried to take a receipt of non -disclosure of materials right before the meeting. All Talent’s lawyers refused to sign the investigator’s documents, saying that this is illegal and such actions could take place only during the investigative actions.

“This is a procedural action,” the investigator hesitated from the boycott of lawyers. He asked one of the bailiffs in the hall to fix the defense refusal, but he did not answer in the stupor and was silently retreated. Instead, the investigator was helped by the prosecutor Yana Rajabov, who gave the desired signature in the document on the refusal of lawyers. And later, as it turned out, instead of the investigator, he himself drew up a petition for a meeting without listeners and the press.

“Keep in mind when you are planting good lawyers, you must think who will then protect you,” lawyer Lapin turned to the investigator.

More than an hour of talents continued to carefully read the materials.

-Someone could have imagined what it could be 10 years ago? - lawyer Lapin asked the audience.

The meeting began with the request of the suspect to the investigator’s discharge from participation in the process. “He is personally interested in the outcome of the matter. I do not trust him, ”Talentov explained.

According to him, when he was delivered to the UK in Udmurtia, he immediately told the investigator that he was in extremely serious condition due to high pressure. An ambulance team was called, the doctor examined Talent and insisted on hospitalization, as he suspected his stroke. According to the lawyer, the investigator began to incline the doctor so that he wrote the paper that the suspect could participate in investigative actions and may be transferred to Moscow. The doctor admitted to Talentov that he first encountered such pressure and refused to sign the papers. Then, instead of him, another ambulance team arrived and appeared the “desired” doctor, who just signed all the necessary documents for the investigation.

Among other things, Talentov’s defense noted that the investigation in the first minutes of the detention did not provide him with a lawyer, did not report his whereabouts and did not familiarize themselves with the case file at the request of the defense. Judge Sergei Khomyakov left a petition without consideration, explaining that the discharge to the investigator could be considered by the head of the investigative body.

Next, the prosecutor petitioned the meeting in closed mode. She motivated her statement by the fact that lawyers refused to give a receipt of non -disclosure of materials

And they were notified that in the case there are data that supposedly constitute a secret. Thus, according to the supervisory authority, the materials that are “covered with mystery”: the report of the operative, the response from the General Staff of the Ministry of Defense and the examination, in which there are supposedly “secrets protected by law”. In addition, the prosecutor believes that open consideration can lead to pressure on the expert.

Talents objected and said that there are no secrets in the case and there is no need to close the meeting. “There is nothing secret in this process except that I am against the war and killing children,” the suspect added.

The defense also drew attention to the fact that there is no secrecy vulture in the case and there is no causal relationship: refusal to subscribe and close the process. “There is some supposedly secret conclusion of an expert, which someone can then put pressure. There is no logical connection. When did the enlightenment suddenly occur and the prosecution found a secret? The investigation and the prosecutor were silent all this time, ”said Lapin defender.

His colleague Biyanov explained that before the meeting, investigator Panyutishchev really asked the defenders to sign a “certain sheet of paper” without details and positions. He believes that such a document cannot be considered a subscription of non -disclosure.

Berman added that the subscription should clearly indicate which information is not subject to disclosure and until what time.

During the meeting of the talents, he complained about his well -being and asked him to call him an ambulance. However, Judge Khomyakov did not respond to this request and ignored the defense position, the meeting continued in closed mode.

During the break, the defenders told reporters that they consider the investigator’s petition illegal and unreasonable, asked the court to appoint an alternative to the principal for detention - to appoint house arrest or let them go on bail. But their presiding arguments did not hear and sent Talent to the pre -trial detention center until August 21. Protection intends to appeal the court decision.
