The bailiffs are trying to obscure a home -made poster from journalists and spectators. Gorinov now and then has to raise it above. To do this is inconvenient - his hands are shackled by handcuffs.
In handcuffs, he has to listen to his sentence at a meeting on July 8. They are accused of 60-year-old Alexei Gorinov of spreading knowingly false information about the use of the Russian army (paragraphs “A”, “B”, “D” of part 2 of Article 207.3 of the Criminal Code)-because he called the war the war. On the eve of the prosecutor Svetlana Zhuravleva asked the court to appoint Gorinova seven years of the colony.
Alexey Gorinov was born and raised in Moscow. In 1984, the Moscow Order of Lenin graduated from the Institute of Geodesy Engineers, aerial photography and cartography, in 2004-the Moscow State Law Academy. He was engaged in scientific activities, taught. He was a human rights activist - regularly came to police branches and courts to detained activists and helped them as a public defender.
“Gorinov could always call and ask for advice, and there was never such a thing that he would dismiss you, he always wanted to help,” recalled the civilian activist and European champion Maria Ryabikova.
“Alexei constantly helped detained activists, acting as their defender. In the days of “big detentions”, he appeared in various police department or in courts, where he defended us professionally, competently, with knowledge of the case, ” said the human rights activist and activist of the Solidarity movement Mikhail Krieger. - When the activists guarded by him were released from the police department around midnight, he brought them home in his car. In 2017, Alexei Gorinov, as a self-nominated person, was elected as a deputy of the Krasnoselsky Council of Deputies of Moscow. It was the discussion of the plan of the “leisure work” of this council, held on March 15, 2022, that became the reason for its criminal prosecution. Gorinov at the meeting turned to colleagues:
What kind of children's drawing contest can be discussed, dedicated to the Day of Protection of Children, or about the organization of dance programs dedicated to Victory Day, when children die every day? For information, I will say that about a hundred children died in Ukraine and children become orphans. Both grandchildren and great -grandchildren of participants in the Second World War are now thrown into the bead of these hostilities in Ukraine.
I believe that all the efforts of civil society should only be aimed at stopping the war and withdrawing Russian troops from the territory of Ukraine.
The municipal deputy Elena Kotenochkin agreed with Gorinov. On April 25, criminal cases of "fakes" were instituted against both. Kotenochkina, shortly before, went abroad (she was arrested in absentia and put on the international wanted list), Gorinov remained in Russia - and five days later, on May 1, he was charged with the final edition.
The investigation believes Meduza tells Gorinov Sergey Telnov that his principal and Elena Kotenochkin entered “a preliminary criminal conspiracy”, “distributed criminal roles among themselves” and “developed a general plan for committing a crime”.
And then-at a meeting of the deputies, which was recorded on the video and was later published on the Internet, they “discredited” the Russian army, “using their official position”, “guided by the motive of political hatred” and “anticipating the occurrence of socio-hazardous consequences”, including the fact that their actions will cause citizens a sense of anxiety, fear, anxiety and unprinting from the outside states ".
For example, Gorinov distributed, for example, what he called the war, and not the “special military operation”, refers to the “obviously false information”, which, according to the investigation, has. And also the fact that the deputy said: the actions of the Russian army in Ukraine are aimed at “seizure of its territories”, “elimination of its independence”, “a change in its political and social system” and daily lead to the death of children there. In addition, he allegedly called it the actions of the "fascist state", the investigation said.
Alexei Gorinov did not abandon his words - neither during the investigation, nor in court. But he insisted that everything he said at a meeting of deputies was his “personal opinion and conviction”. “To express my opinion, I do not need to conspire with someone,” he added . Noting that on February 24, on the first day of Russia's attack on Ukraine, he was detained on an anti -war action, he stayed under arrest until March 11 and did not follow the briefings of the Russian Ministry of Defense (Russian laws on military censorship were formulated so that “fake” can be recognized as everything that is not an official position of Russian authorities).
Gorinov turned to his supporters from custody:
My father returned from the Second World War as a disabled person. As a child, I found many participants in that war without arms, without legs, blind. I grew among them. The war in itself as a phenomenon, regardless of how beautiful synonym it may be, is the last, most dirty thing, the unworthy title of man. In the war, the faster of all is the discontinuation when the line between good and evil is erased. I do not accept it and reject it.
Now I am judged for the expressed opinion. In the days of the August Putch of 1991 , I was also a deputy, along with the defenders of the White House - the House of the Armed Forces [of the Supreme Council] of the Republic. Then we defended, including along with other rights, our right to think and speak out freely. If they told me then that in 30 years they would judge me by the criminal court for words, for my opinion, I would not believe. This is the sad result to which our society came.
On April 27, Alexei Gorinov was placed in the Moscow SIZO-1 "Sailor Silence". Three days later, he fell ill (he had a cough and the temperature rose), the lawyer of the deputy Katerina Tertukhina said (she participates in the case with Sergey Telnov). And she emphasized that in the isolator the help of the principal is not provided: "The employees only gave him the last three tablets of bromhexin and nothing more." Gorinov himself so described the "sailor silence":

“At home, I would be cured in one night,” wrote Gorinov in another letter. A year ago, when he was sick with Covid, he was diagnosed with tuberculosis and removed part of the lung. But the judge of the Meshchansky District Court of Moscow Olesya Mendeleev, who considers the case of the municipal deputy, several times refused him to be released from custody, agreeing with the state prosecution that otherwise Gorinov could “put pressure on witnesses” and “hide from the investigation”.

The judge of the philistine court Olesya Mendeleev became in the summer of 2015. She is known and other loud affairs. For example, in 2017, Mendeleev found guilty of the fraud of the former head of the Russian Federation Dmitry Nirodelov, sentencing him to nine years in the colony and a fine of a million rubles. In 2020, she also pronounced a conviction in the “Seventh Studio” case, appointing Cyril Serebrennikov, Yuri Itin and Alexei Malobrodsky, conditional terms and fines, and Sofya Apfelbaum-only a fine, freeing her from punishment due to the expiration of the statute of statute of statute And in 2021, she released four defendants in the case of an attack on the left activist and anti-fascist Alexei Sutuga (Socrates)-he died of injuries.
But the judge did not release Alexei Gorinov from the glass cage even during the announcement of the sentence, despite the numerous requests of the deputy and his protection. “Mendeleev did not see any violation of the principle of equality of the parties in this.
The criminal case against Alexei Gorinov appeared shortly after the prosecutor’s office of the two deputies of the State Duma - Alexander Khinshtein from United Russia and the activist of the Lisa Alert search team Oleg Leonov, who went to the parliament as an independent candidate (now consists in the faction of “new people”).
But in the case they are not mentioned in any way. They did not call them to court as witnesses. 13 people should have testified about the fault of Gorinov, but in the end, says lawyer Sergei Telnov, only two were called to the court: “This often happens.” They gave testimony in the absence of journalists and listeners in the hall - this was how Judge Mendeleev decided after a message appeared that the witnesses were “psychological pressure from the Gorinov support circle” (in which it was expressed in court).
The guilt of the deputy, according to the prosecutor Svetlana Zhuravleva, is evidenced by the conclusions of comprehensive psychological linguistic examinations. There are two of them in the case: one was conducted by specialists from the Moscow Research Center , the other from the NIC of forensic examination and forensics of the Qiolkovsky Kaluga State University.
At the same time, the first examination, which was done by MIC specialists, says lawyer Sergei Telnov was actually in favor of defense. The second conclusions were already significantly different: for example, specialists from the Tsiolkovsky University decided that in Gorinov’s words there were “statements containing allegations about the facts of use” of the Russian army in Ukraine. At the same time, Gorinov did not call Russia a “fascist state”, but characterized the actions of its army as “aggressive, hostile, related to the murder of people”. And also expressed an opinion on the need to stop the “special military operation”.
According to Gorinov’s defense, the only question that could be raised in this matter before linguists: was the deputy’s statement by his opinion or the assertion of the fact? At the request of lawyers, a specialist of the Russian Federal Center for Forensic Examination at the Ministry of Justice answered this question. He thought that in Gorinov’s words there was only one statement about the fact - “about a hundred children died in Ukraine, and the children become orphans, and grandchildren, great -grandchildren, great -grandchildren of participants in the Second World War are now thrown into the fed of these hostilities in Ukraine.”
All other statements were considered an expert - the opinion or evaluative judgments of the deputy. Lawyer Katerina Tertukhina, in turn, paid the attention of the court that, according to the Office of the Supreme Commissar of the UN Human Rights, on March 12, 2022 it was known about the death of 79 children in Ukraine.

But Judge Olesya Mendeleeva did not take into account this expert’s opinion. Before announcing the punishment, the judge announces a five -minute break in the meeting and leaves the hall. All listeners are also withdrawn by force - because they applauded the defendant. Gorinov himself uses a pause to chat with his family: his wife and son came to the court. He tells them that the decision in his case was probably written in advance.
Soon, Judge Mendeleev is returning. She reads the verdict - seven years of colony of general regime, exactly so much requested the charge. As well as the ban on holding public posts for four years.
