"Prone to betrayal." How they put pressure on soldiers who refuse to fight in Ukraine

Over 500 soldiers from Buryatia returned home, refusing to fight in Ukraine - these are the calculations of the Free Buryatia Foundation. About a hundred of them arrived this week with one plane. They “collected” them for several weeks, before that, twice (!) Trying to inspire back from the Russian-Ukrainian border into the territory of Ukraine. On the eve of the wife and mother of other military from Ulan-Ude, they complained that dozens of soldiers who refused to fight Buryatia by force in mid-July were taken to the Lugansk pre-trial detention center.

One of the military, who returned from Ukraine to Buryatia earlier, confirmed in an interview with Siberia. Realities of threats and attempts by leadership to drag out the deadline for returning home.

“I filed a report back in April, when five fellow countrymen killed in my eyes,” says Alexander . -We were returned to Russia to reorganize due to large losses, and I just at that time went to refuse. The commander nodded and carried away the report, and then they called me to the “conversation” where they began to threaten - like I would not find a job or friends on arrival, everyone will turn away from me, because I will have a “traitor” on me. And honestly, I already care, if they kill me - what is the difference, who and how will be said. They will not raise my children. I’d better go to a construction site or a security guard, but I’ll be alive. I waited for three days, but when they announced a new transfer to a new transfer, here I am already a refusal: plant what you want, I won’t go. They put them under arrest (then in the documents it was not issued in any way, they just didn’t let out anywhere). I waited more than a month, returned in June. But by that time he already knew that not one "traitor". There are many of us who do not understand why we should risk life in Ukraine, for the sake of whom.

The commanders do not have the right not to accept a report on the termination of the contract, and even more so to enter into a contractor in the insulator, lawyers say. In the absence of martial law in Russia, this is illegal. In such cases, it is necessary to complain to the military prosecutor's office and the Ministry of Defense. However, soldiers often do not have such an opportunity - they take phones.

"They selected phones, take it to a pre -trial detention center"

-I am the wife of Ilya Kaminsky, on July 14, he called me with terrible news-for a report on the termination of a military contract and dismissal from his service and several more former colleagues (from the 11th Guards Asset-School Brigade of Ulan-Ude) were placed in Dilo-1 near Lugansk. Help to return him home, he does not want to fight, a child, whom he had never seen, will have been waiting for him at home! -says Diana Kaminskaya , the wife of the military from Ulan-Ude.

According to the wife and mother of Kaminsky, Ilya filed a report on April 28 that he needed to return home due to family circumstances-the birth of a child.

- As a result, this report was not considered by the authorities. They refused to sign it, but even just pick it up! - explains the mother of Kaminsky Oksana Plusnin . - On July 11, the son and dozens of military signed another report - already to rejection of hostilities. And the next day, all those who wrote a refusal to fight were divided into groups of 8-10 people and sent to the investigative insulator of the city of Lugansk. I don’t know where my son is and where he will be taken away! They took phones from them.

Relatives say that those who refused to fight the soldiers are “knocking out” the refusal of the report and signature under the consent of “participation in the hostilities”.

In such a situation, lawyers advise the military to write as possible to the military prosecutor's office or the Ministry of Defense of the Russian Federation.

- When they do not accept reports, without fixing the refusal, you need to write statements to the military prosecutor's office and the Ministry of Defense. Thus, at least it is fixed that a person wanted to refuse and, accordingly, took action for this. Also, many are threatened by the fact that in the event of a refusal, they will put the seal “prone to betrayal, lies and deception” in a military ID, which means they may not be accepted on a civilian (they ask for a military ID when employing). This threat is absolutely illegal, such a seal cannot be put in a military ID - marks from headquarters in military IDs of Russian military personnel are strictly regulated. In addition, stands with "traitors" have now appeared - supposedly on the streets of cities they began to hang out a photo of the military who refused to fight. This is also illegal: information about the participation of a soldier in a “special operation” is the official information of limited use, that is, they do not have the right to publicly disclose it. Neither in the form of a photo on the stand, nor in the form of a print in a military man, ”says Andrei Rinchino, lawyer of Free Buryatia.

What can help the refuseniks who were taken away in jail after filing a report, lawyers can only say in theory.

- In fact, they cannot condemn them. My pleasure. They will hold for several days - the maximum. Although it is illegal, of course. If the refuseniks will not succumb to threats and blackmail, they [the Ministry of Defense of the Russian Federation] will not have any other exit, how to let go home. In parallel, you can call the hotel hotline. Let them call relatives from citizens, including. It is not a fact that it will help. But it will not be worse, ” Aleksey Semenov, a lawyer specializing in military law, is sure.

The Council of the Lawyer of the Free Buryatia to the military who decided to refuse to participate in the hostilities. - If you are in Russia, you should write and submit to your commander or command your part a report on the early termination of the contract. For example, in connection with the emergence of anti -war beliefs. The report should indicate the reasons why you refuse to participate in military operations and demand, before considering the report, not to send you to the war zone and transfer to the place of your permanent deployment. If you are already on the territory of Ukraine or on the border with it in a field camp, then you will most likely not be accepted. In this case, if possible, you need to send a statement to the military prosecutor’s office or to the Ministry of Defense that you submitted a report, and your commander refused to accept and consider it. In the application, you ask to ensure the exercise of your right to early termination of the contract, obliging your command to accept and consider your report, and before its consideration, do not send you to the combat zone to participate in the special operation. These statements can be sent either through our fund or directly on the website of the Ministry of Defense of the Russian Federation. If you have not accepted the report, you should hand over weapons - this is very important! - immediately leave your location and return to the place of your constant deployment, to the part from which you arrived. That is how many contractors who refused to fight. And immediately, as soon as you return, first of all, submit a report to the command of your part on the early termination of the contract. Most likely, you will be drawn up for a protocol on the commission of a rude disciplinary act in the form of unauthorized abandonment of the place of service and refusal to participate in a military special operation. This protocol will be the basis for terminating the contract with you and dismissal from military service, ”lawyers explain.

Human rights activists strongly advise, if possible, not to wait for "centralized shipping" to the unit, for example, on a military aircraft. This is fraught with the loss of time and the attempt of the military leadership by deception to send the refuseniks back to Ukraine.

- Gather things and leave in passing cars, buses, trains, aircraft. Remember, in order to avoid criminal prosecution, you must have time to return to your military unit in order to submit a report (if it is not accepted in place. - approx. S.R.) , within ten days! - the lawyers warn.

“I don't understand how to leave on the way?” The military police are slowing down, and you are without documents! - says Alexander, quitting in the spring. -Yes, you just won’t get out of the unit, except from the hospital, if it is wounded, and then not a fact. One works here - wait for the number of refuseniks to get, then everyone will be taken. And before that, you, of course, are suffered by threats and bullying, but alive.

"They jumped out of the bus, which secretly drove them back to Ukraine"

A similar story happened a few weeks ago with other contractors from Buryatia who refused to fight in Ukraine. They were not taken to the pre -trial detention center, but after the report and termination of the contract they tried to return to Ukraine again - they put them on the bus to be taken home allegedly, but in fact he went to the west, the head of the Free Buryatia fund Alexander Garmazhapova said.

- The military returned to Buryatia on Saturday, July 9. Since many of the soldiers (or relatives of the military) communicate with us anonymously, it was important for me to get confirmation from at least a few. Therefore, we did not communicate with the media in the first days after their return, refused to comment in detail. But when the mother of one of the military, and then the sister of the other (not familiar with each other) wrote with a difference of a few days and reported that on Thursday, July 7, the plane flew at the Omsk, and on July 9 to Ulan-Ude, everything was confirmed, says Garmazhapova. - At the same time, the figure is 150 military - this is loading during take -off, in Omsk a part landed, that is, not all 150 flew to Buryatia, but more than half approximately.

Before the return of those who refused from the contract, they kept several days in a camp in the territory of the Luhansk region, threatening criminal prosecution and not letting go home.

According to the relatives of the military, who told about what happened on anonymity, about three dozen bond contractors at the end of June were supposedly taken out of Ukraine to the airport, but the car was deployed on the way. Several people, including the son of an interlocutor, jumped out of the car and walked to the nearest military camp.

- There they were told to wait a few days, they promised that the plane would take them home. For a few days, more than a hundred refuseniks gathered in the camp - 120–130. On July 4, everyone was selected from everyone, again put in the car and allegedly taken to the plane. Miraculously, one of the colleagues remained a telephone - he realized that they were being taken towards Ukraine. They all jumped off the car (yes, the second time in half a month) and reached on foot to the nearest settlement, found the military police there. There was a skirmish, they were all taken to a closed camp in the Luhansk region, threatened criminal cases under the "new law on the unauthorized leave of Ukraine" (they later found out that there was no such law). Soon another 20-30 people were added to them - these 150 military sat on the plane on July 7.

"There are much more refuseniks"

Human rights activists from Free Buryatia are sure that even in the republic there are much more than 500 refuseniks, whom they know directly from the military themselves and their relatives.

“In fact, Russia as a whole is a very large number of refuseniks, many are returning, and return permanently, regularly,” the activists of the Free Buryatia Foundation say. - There is no such thing that these 150 people are the first batch. There are many cases when the military refused even before sending to Ukraine. For example, they were originally in the contract service, and when they were told that they would go to this "special military operation", they immediately wrote a report on the refusal. One former contractor from among the officers vivo watched the refuseniks - from the place and returning. According to him, there were more than 500: “There are much more. Often they do not take into account those who refuse directly in Buryatia, who, in principle, did not want to go. There are a lot of such. We had ethnic Ukrainians, but for some reason no one recalls this. And the commander of the 36th Army, the commanding of the Eastern District, Tchaiko, chief of staff of the Nikolaenko brigade.”

Sources in the parts of Buryatia say that if you fold everyone in total, it will turn out to be "closer to half." The most interesting thing is that after refusal, they did not even want to dismiss some, offered to serve in the unit. Although this is the most common scarecrow for the military who have gained military mortgages. One-room apartment in Ulan-Ude costs 3 million rubles, these are unhappy 30–35 square meters. A spiritual apartment apartment 40 square meters costs 4 million - just unrealistic prices for a region with salaries of 20-30 thousand. That's why they brought the republic to such a state that it takes 81st place out of 85 subjects in terms of living standards, despite Baikal, despite the 9th place in terms of gold production, despite the deposits of zinc, coal, and other minerals. The only thing that Putin’s power can offer them is the contract under the contract and the war in Ukraine. And the argumentation of most contractors, why they are fighting, consists in a military mortgage. There is no other motivation.

But now the question is like this: either an apartment, or your life - what will you choose? And immediately the choice is simplified: "Well, you will buy these four walls by the end of the service. Who will live there if you are killed?"

Another thing is that now after the report many even in Buryatia do not want to serve. They are no longer afraid of anything. One of the first contractors who wrote a refusal to fight back in March, then in Ukraine, to the question of whether he was afraid, said: “After I survived the shelling of“ grades ”, I am no longer scared,” they say in Free Buryatia.

The exact figures of refuseniks in the fund refuse to call the fund - many military calls several times, and some - not only for themselves, but also for a dozen colleagues. But they call and write for advice on how to refuse to fight, daily.

- They [the military, who want to refuse to participate in "Swim"] write every day. And periodically they say that, they say, I write not only from myself, but on behalf of those who want to quit: we are, for example, 10-12 people. Sometimes it happens that a person immediately represents a group. Therefore, it is difficult to talk about any specific figures-this is not amenable to accurate calculation for many reasons.

But the main thing is that this process is constantly going on. In the whole in Russia, he probably also goes, because people, choosing between life and this notorious military mortgage, choose life and leave. It is no coincidence that we ourselves after anti -war circulation needed to create a legal and consulting department. Relatives of contractors, 24/7 contractors themselves have to answer. It is parallel to be almost psychologists, because they write in a stressful situation, they are afraid that they will be transferred to the front line for refusing to fight immediately. And after the experience of consultations, it was necessary to transfer to other regions of Russia - Tuva and Khakassia, for example. All because there is demand.

Indirectly, that there are a lot of refuseniks, is also said by the fact that sophisticated ways of power began to advance a set into the army. Recently, the contract of contract service was opened on Sur Harban (Buryat National Feast). If you have everything so great with the number of military men and everyone is torn to the contract service, why are you campaigning at the holiday?!

- I understand correctly that none of the refuseniks suffered any real punishment? And not a single trial?

- No. I say, some, upon returning, despite the broken contract, even offer to stay in the unit. There is no sense in any disciplinary sanctions-the military breaks the contract.

Another thing is that people have to start life again, many of them have been military all their lives and did not work anymore: they walked, the parade ground, they faded the papers, while they had a military mortgage, the salary by local standards was normal. And now they will have to arrange life from scratch, to look for themselves, and this is a complex process, given the standard of living in Buryatia.

They survived stress, but glad that they returned alive. I have never received so many messages from people that they were finally dismissed and returned home, with some emoticons, with exclamation signs, that is, so that a person was happy that he is dismissed. The man writes: "Good morning! I am at home! I am fired!" And emoticons.

By the way, I do not recognize all cases in details, because military people are not inclined to lyrics to talk about all their adventures. The person writes: "I want to quit. I do not accept a report. What to do?" They answer him, and he ultimately, after some time, writes: "Thank you! I am at home! Good luck!"

Or someone writes: "Good morning! Our home! Thank you and your whole team for your work. How can you thank you?" It is ridiculous that the money is offered, they do not immediately believe that we work for free.

Or such messages come: "Hello! I want to thank you for the information. My son is already at home." A person after a consultation, we write: "How are you doing? Do you need more help?" - "Hello! So far it’s normal. We wrote a report, we are waiting for the order. How and what, we will write to you." Or this is constantly: "Brother the youngest at home", "You gave hope because they intimidate, wash their brains. Thank you very much!", "Good evening! I am fired and I am at home." This is constantly.

The head of the analytical department of Free Buryatia, Maria Vyushkova , leading the statistics of the dead military from the republic, notes that on July 16, 275 military were killed in Ukraine who were born, lived or served in Buryatia. "Погибших бурят по национальности – 117 человек. Из них 84 были из Бурятии, 30 из Забайкальского края, и 3 из Иркутской области", – пишет Вьюшкова.
