
At the end of last year, the Chechen authorities decided to end criticism in their address, and a wave of mass detentions of relatives of opposition Chechen bloggers living in the redistribution of Russia rolled around the republic. Among the detainees were not only adult men, but also old people, women and minors.
Judge Yangulbaev and his wife Zarem, the parents of Ibrahim Yangulbaev, the creator and administrator of the Adat Telegram channel, which the Chechen authorities through the court recognized as extremist, back in 2017 forced to leave Chechnya and lived in Nizhny Novgorod.

On January 20, Chechen police came behind them to deliver by force to the republic. The assault on Yangulbaev’s apartment in Nizhny Novgorod actually broadcast independent media and bloggers on the air, the resonance reached the world level, the FSB, the head of the Presidential Administration of the Russian Federation Anton Vaino, and, finally, Vladimir Putin, were forced to intervene in the situation.
As a result of publicity, the Chechen security officials were not allowed to detain the federal judge Yangulbaev, protected by law guaranteeing judges immunity. The only one who managed to deliver to Chechnya was Zarem Musaev.
“This family is waiting for either in prison or underground,” said Ramzan Kadyrov regarding Yangulbaev.
Therefore, for seven months, Zarem has been sitting in the Grozny pre -trial detention center. On August 3, she had a birthday, she turned 53 years old.
The case on Zarem Musaev was opened on January 27, the investigator of the first department of the investigation of the particularly important cases of the Chechen drying Ayub Taramov conducted the investigation. This is a very experienced investigator. He investigated the attack on me and lawyer Marina Dubrovina in Grozny in February 2020, however, without much success. But in the case of Musaeva, investigator Taramov succeeded.
In the spring, Zarem was a final charge of committing two serious crimes: a large -scale fraud and in an attack on a police officer.

On May 30, the indictment was approved by the deputy prosecutor of the republic Nikolai Semenov. Moreover, he became a state prosecutor in this case. I do not remember a single court in Chechnya, including loud processes over the accused of terrorism, where the prosecution of the republic would have represented the prosecution.
Three lawyers carry out the protection of Zarema Musaeva: Natalya Dobronravova, Alexander Nemov and Alexander Karavaev. Their work is paid by the Nizhny Novgorod Committee against torture recognized by the Ino -Agent. (The organization was liquidated. The “team against torture” is now working. - Ed. ). On July 5, a preliminary meeting was scheduled in the case of Zarema. The judge of the Leninsky District Court Bashuev extended the Musaeva measure of restraint, and then took self -setting up, motivating this by the fact that he could not make an objective decision in this case.
On the same day, Musaeva’s lawyers organized external observation, which was carried out by at least eight people moving on four cars with fake numbers. Lawyers found out this fact, breaking through cars in the federal base. There were no such numbers in it.

The surveillance was carried out as defiantly defiantly, or flagrantly unprofessional. Two “Toptuns” were especially striking, which lawyers among themselves called “bedding” and “checkered”.
The “checkered” was in a bright plaid shirt and behaved like a clown fled from the circus. Pusten, hid in the bushes and scared passers -by. At some point, running around the road to the red light, I almost got under the car.
"Bed Lingerie" received its nickname from the bedding store on Putin Avenue. The guy was monitoring the cafe "Coffee", in which the lawyers had lunch. Each time they went out to smoke and looked in his direction, “bedding” dived into the store and was vividly interested in the assortment of Turkish sheets and pillows.
Despite the comic of the situation, lawyers filed an application for a crime in the FSB, because from comedy to the tragedy in Chechnya - one step. In addition, all three lawyers have already encountered external surveillance and threats against law enforcement officials, working on other criminal cases in the republic.
It would be easy to conduct an audit and establish both the fact of the outdoor and the personality of people who carried out the defenders of Musaeva. It was enough to view the recordings of surveillance cameras at the airport and along the route of the lawyers (this is mainly the very center of the Terrible). But the FSB did not want to carry out the verification and transported the application of lawyers to the law enforcement agencies of Chechnya.
On July 16, in court, Musaeva, Deputy Prosecutor of Chechnya, Nikolai Semenov, announced the official position of his department on this occasion:
“Such a statement is not submitted to law enforcement agencies, but to specialists in the field of paranoid personality disorders.”

In a similar way, the Commissioner for Human Rights under Ramzan Kadyrov Mansur Soltaev spoke out. He also suggested that the defenders of Musaeva undergo treatment from the persecution mania in one of the Chechen psychiatric hospitals and called the legal reaction of lawyers to survive the “miserable attempt to draw the attention of the public to a long -lost topic” (spelling of the original).
In his Instagram ( social network was recognized as extremist in the Russian Federation. - Ed. ) Mansur Soltaev called for “political provocations and speculations” in the case of Zarema Musaeva, emphasizing that this is an “ordinary criminal case”.
Soltaev himself, by the way, in this matter appears in a very curious quality - like a person who provided Alibi Zarem Musaeva. This moment does not seem “ordinary” to me, as well as the criminal case of Zarema Musaeva, which, of course, deserves a detailed public analysis, given the public resonance, which caused the threats of Chechen authorities and the actions of the Chechen security officials regarding the Yanglubaev family.
The accusation of Zarema Musaeva of a large-scale fraud is based on the testimony of a single person-twice convicted 42-year-old Madina Azimova.
Azimov received the first criminal record in 2020 for an attempt to give a bribe of 11 thousand rubles to the district police officer, so that he destroyed the administrative protocol drawn up in relation to Azimova for obscene abuse in a public place.
In general, it should be noted that the Russian mat in Chechnya is a widespread and universal phenomenon. Men and women, old people and adolescents, representatives of the Chechen clergy and atheists, officials and ordinary citizens are swearing in the republic.
The head of Chechnya Ramzan Kadyrov, for example, is not hesitation for doing this under the cells of journalists. So, in April 2020, he publicly soured the Ingush elders, for which he then publicly apologized.
But to administrative responsibility for the “violation of public order, accompanied by obscene abuse in public places” in Chechnya, they usually attract those to whom law enforcement agencies have special interest.
Administrative arrest under Article 20.1 of the Code of Administrative Offenses of the Russian Federation (petty hooliganism) gives employees of the Chechen police the opportunity:
legalize illegally detained;
Take the time to charge a person with a heavier crime.
It was in this way that the son of Zarema Ibrahim Yangulbaev, who was detained in May 2017 for critical publications on social networks, was “legalized” at one way. He was held in the basement for a month, then drew up an administrative protocol (supposedly Ibrahim was sitting on a bench in the center of Grozny and swearing loudly), took him to court and was already officially placed in a special receiver for 10 days. And then they accused of trying to "overthrow the state system in the Chechen Republic."
Similarly, in January of this year, the detention of the mother of Ibrahim Yangulbaev, Zarema Musaeva, was also “legalized”. On January 21, she was forcibly brought from Nizhny Novgorod for interrogation as a witness, and on the same day the judge of the Leninsky district court of the Terrible Bashuev gave her 15 days of administrative arrest allegedly for obscene abuse in the police department.
I suspect that Madin Azimov was accused of petty hooliganism in 2020, and then in an attempt to give a bribe to the district police officer extremely formally. The true reason for its detention was probably completely different.
I must say, in certain circles in Chechnya, Madina Azimov is a personality for a long time and well -known. She is known as a notorious fraudster who, for many years, turned schemes for illegally obtaining loans.
But only in 2020, when Azimov was supposedly detained for obscene abuse in a public place, did the police finally began to open the numerous facts of its criminal biography one after another. Each such fact led to a criminal case and the indictment and, therefore, improved the revealing indicators of the crimes with Chechen police.
All these criminal cases are built on the sincere recognition of Azimova and obvious ignoring the conspiracy of the accused with the employees of Chechen banks who have concluded loan agreements with citizens who were almost brought by the hand of Azimov. Employees of banks did not have any questions for borrowers, although almost all of them did not have sufficient income (and some did not have income at all) to pay off the loan. There were no complaints from the investigation to the borrowers themselves, who all understood that they were involved in the fraud of banks, because they received loans in their name only formally, disposed of credit funds and even occasionally paid Azimov on these loans.
But most of all, in this situation, the extraordinary humanism is usually very harsh Chechen investigators and judges.
An attempt to give a bribe to an official who is in execution is considered a serious crime by law. However, during the investigation in this case, Azimov was not under arrest, but under the subscription of the lower place.
In April 2020, Madina Azimov was found guilty, but the judge of the Staropromyslovsky court Khlystunov sentenced her to 1 year 6 months of conditional punishment.
Soon after the sentence, Azimov was again brought to criminal liability, now in part 2 of Article 159 of the Criminal Code of the Russian Federation (fraud committed by a group of persons by prior conspiracy). Azimova’s accomplice was held by a resident of Grozny Jamaev, who was also previously convicted of fraud. Azimov and Jamaev were accused of receiving a loan in the Rosselkhozbank for a standing face. During the investigation in this criminal case, Azimov and Dzhamayev were under the subscription about proper behavior and nonsense. That is, at large.
Despite the fact that Azimov and Dzhamayev were already previously convicted and their criminal records were not repaid, the court and this time sentenced them to a conditional time.
And a few months later, Azimov was already opened a third criminal case - in part 3 of Article 159 of the Criminal Code of the Russian Federation (large -scale fraud). And the investigator again chose a subscription of a lower -off wizard as a preventive measure.
That is, being a defendant in three criminal cases, two of which ended with sentences with a real term, and the third is at the investigation stage, Madina Azimova did not spend a day in prison and, remaining at large, continued to fool citizens and deceive the banks.
... The investigation in the third case of Azimova went along the rolled rails. On October 6, 2021, she was charged with fraudulently, having promised help in obtaining a loan of cash for a large amount at a rate of only 3% per annum, convinced 8 people to issue a consumer loan for the purchase of household appliances in the Eddorado store, which then saved the residents.
The bank’s employees (once the Chechen branch of the Bank of the Bank), without questions and delays, issued consumer loans for insolvent borrowers with a total amount of almost 1 million rubles, took place in the case as witnesses. The borrowers themselves, who, in fact, entered into a conspiracy with Azimova in order to deceive the bank and receive a loan, on which they were not going to fulfill their obligations, were recognized as victims.
Only Azimov appeared as the accused of this case, and it was clearly not to look for her accomplices in the plans of the senior investigator of the SU, SU Grozny Khusaynov.
However, on November 18, 2021, investigator Khusainov unexpectedly changed his plans and issued an order to hold a complex of operational-search measures to “establish persons through which M. Azimova Could get acquainted with the persons on which loans were issued. "
And already on November 23, the operative officer UUur OP No. 1 of the Ministry of Internal Affairs of the Terrible Police Captain R.I. Tsuraev introduced the following report to Khusainov: “During the operational-search measures <...> information received that citizens Yangulbaev Sayda Vakhaevich, born in 1958, <...> and Musaeva Zarema Abuzitovna, born in 1969, <...> previously provided information for M.A. Azimova About persons who want to receive money in the form of a loan, <...> and also introduced to Azimov M.A. With persons in whose name you can get a loan in order to further obtain material benefits for yourself. ”
So Azimova had as many as two potential accomplices: federal judge Sidi Vakhaevich Yangulbaev and his wife Zarem Musaev, who had not been living by that time in Chechnya for more than four years.

In itself, this report did not prove anything, it was necessary that Azimov personally confirmed the information about the involvement of Yangulbaev’s involvement in the organization of large -scale fraud.
On November 24, investigator Khusainov called her for an additional interrogation.
-You know Yangulbaev Saydi Vakhaevich and Musaev Zarem Abuyazitov and did they assist you any assistance in committing this crime? -asked Khusainov one single question that worried him.
All that was required of Madina Azimova is to say yes. But she unexpectedly refused to stipulate innocent people.
And then the investigator Khusainov realized and ... petitioned the court to change the preventive measure from the arrest subscription: “M. Azimov He is accused of committing a serious crime and <...> remaining at large, may hide from the preliminary investigation and court, may prevent the investigation of the criminal case, influencing witnesses, as well as commit other crimes ... ”The judge of the Leninsky district of the court, Ediev, satisfied the request of the investigator Khusainov.
So Madina Azimova for the first time in her life ended up in prison.
For some reason, the leadership of the Ministry of Internal Affairs for the Czech Republic considered the work of investigator Khusainov unsatisfactory and handed over the case to his more experienced colleague-the senior investigator for particularly important cases of the Ministry of Internal Affairs of the Ministry of Internal Affairs for the Czech Republic Lieutenant Colonel Beksultanov.
The new investigator did not stand on ceremony with Azimova. He found her weak place and painfully pressed him.
The fact is that Madina has three children. She raised them without her husband, with whom she dispersed. In general, in Chechnya, it is customary to take away the children from the mother after the divorce of children. And according to Adat (Chechen traditional law), and according to Islam, children should remain with the father and his relatives. But on the case materials, we can conclude that the ex -husband of Azimova was not particularly interested in children and was not torn to educate them. Madina herself received only school education and fraud, most likely, she did not deal with a good life, but in order to feed her family.
Therefore, investigator Bexultanov perfectly understood what he was doing when he sent a request to the guardianship authorities, in which he asked to report: did Madin Azimov not be deprived of parental rights?
It was a fat hint.
The next day, Madina Azimova wrote a statement on the conclusion with the investigation of the pre -trial agreement and gave the necessary evidence.
A week later, investigator Bexultanov petitioned the court to change the preventive measure of Azimova for house arrest, as she "actively helps to disclose and investigate the crime, has three children on dependent ...". The trial of the investigator satisfied and returned the mother to the children.
... The Zuraev Opera’s report of November 23, 2021 laid the foundation for the hunting of the Chechen security officials on Yangulbaev, which ended on January 20 with a scandalous assault on their apartment in Nizhny Novgorod.
The head of Chechnya then fiercely justified that all the actions of his security forces were within the framework of the law. So, in his telegram on January 21, he wrote (spelling of the original): “Law enforcement agencies for conscience do their work, and a bunch called themselves“ human rights activists ”whines about the violation of the law. This time ... they write about the case in Nizhny Novgorod. Everyone replicates the same information, not actually knowing the facts. Yangulbaev, before yesterday's occasion, sent a summons three times ... "
But the case file in relation to Zarema Musaeva Ramzan Kadyrov refutes.

Так, 3 февраля следователь Хусайнов сделал запрос в отдел полиции № 1 УМВД Грозного: «Мною в ваш адрес были неоднократно направлены поручения о вручении Янгулбаеву С.В. и Мусаевой З.А. повесток. Согласно полученным ответам <…> повестки были переданы почтой. <…> На основании изложенного прошу Вас предоставить сведения о направлении указанных повесток…»
Вот что ответил следователю начальник отдела полиции № 1 И.К. Сайдхасанов: «На ваш запрос сообщаю, что <…> документов, подтверждающих отправку <повесток>, не имеется…»
Таким образом, чеченские силовики явно вышли за пределы своих полномочий, так как никаких оснований для вынесения постановления о принудительном приводе Янгулбаевых на допрос по делу Азимовой в декабре 2021 года у следователя Хусайнова не было. Как, впрочем, не было и объективных доказательств причастности Янгулбаевых к мошенничеству (на тот момент Азимова этот факт подтвердить отказалась и стояла на своем).
Допрос по делу о мошенничестве неизвестной ей женщины, ради которого Зарему Мусаеву подвергли жестокому и унижающему человеческое достоинство обращению (согласно статье 3 Европейской конвенции о правах человека именно так квалифицируются пытки), насильно запихнув в машину (хорошо хоть не в багажник) и доставив за 2000 километров из Нижнего Новгорода в Чечню, продлился всего 20 минут.
Следователь Хусайнов спросил Зарему, знает ли она Азимову. Зарема ответила, что не знает. Больше у следователя Хусайнова вопросов не было.
В 19 часов 10 минут следователь объявил, что допрос закончен, Зарема Мусаева свободна и может идти домой. В 19 часов 15 минут Мусаева спустилась с третьего на первый этаж отдела полиции № 1 города Грозного. Но вместо того чтобы пойти домой, она, по версии обвинения, остановилась у дежурной части и начала без причины громко нецензурно выражаться. Участковый уполномоченный Абдулхамидов сделал Мусаевой замечание, а когда женщина не отреагировала, пригрозил составить на нее административный протокол по статье «мелкое хулиганство». Далее цитирую показания Абдулхамидова:
«Как только я стал записывать ее <анкетные> данные, она напала на меня, пытаясь выколоть глаз,
я защитился от нее, но она смогла дотронуться до моего лица и в левой скуловой области поцарапала меня своими ногтями. В результате данных действий я испытал физическую боль… В тот же день я обратился в больницу КБ № 1, где мне оказали помощь…»
В деле действительно есть справка из клинической больницы № 1 г. Грозного. Из нее следует, что Абдулхамидов был осмотрен врачом Эртухановым 21 января в 22.33, на лице участкового была зафиксирована «скальпированная рана», ее обработали антисептиком, после чего отправили «раненого бойца» домой.
Кроме того, в деле есть медицинское заключение от 25 января, согласно которому «скальпированная рана» спустя четыре дня волшебным образом трансформировалась уже в «восемь полосовидных ссадин размером от 0,2х0,7 до 0,2х0,45 см» и, что самое удивительное, «эти повреждения ( то есть на самом деле царапины длиной менее 1 см. — Е. М. ) обусловили временное нарушение функций органов и систем <участкового Абдулхамидова> продолжительностью до трех недель… и по признаку кратковременного расстройства здоровья квалифицируются как легкий вред здоровью».
К сожалению, в этой экспертизе нет конкретики, какие именно функции организма пришли в расстройство у 29-летнего сотрудника полиции Магомеда Абулхамидова. А без этого, увы, все выводы медицинской экспертизы о легком вреде здоровью (который нужен был следствию, чтобы квалифицировать действия Мусаевой по более тяжкой статье) являются научной фантастикой.
В материалах дела есть и версия этих событий с позиций Заремы Мусаевой.

ИЗ ПОКАЗАНИЙ ЗАРЕМЫ МУСАЕВОЙ
«20.01.2022 я вместе со своим супругом Янгулбаевым Сайди и дочерью <…> находилась дома <в Нижнем Новгороде>. Примерно в 20 часов к нам в дверь постучали <…> я услышала крики своей дочери о том, что кто-то врывается в квартиру <…> В спальню зашли двое ранее мне незнакомых мужчин и на чеченском языке приказали мне быстро выйти, я отказалась. <Они> Взяли меня за руки и ноги и потащили по полу <…> Я кричала, просила, чтоб мне позволили взять лекарства, поскольку я инсулинозависима. Также я просила разрешить мне взять что-то из теплой одежды, но на мои просьбы они не реагировали и таким образом вытащили меня на улицу на мороз без верхней теплой одежды и без обуви <…> По пути следования <в Чечню> мое состояние ухудшалось, развивалась сильная тахикардия. Я не ела, пила только воду, поскольку у меня не было инсулина. За все время пути меня только два раза выводили в туалет <…>. Я несколько раз теряла сознание <…>.По прибытии в Грозный меня завели <…> в здание ОП № 1 <…> в кабинет к следователю, он меня допросил <…> <после чего> сказал, что я свободна и могу идти домой. Я вышла из кабинета, в коридоре меня ждал сотрудник полиции и сопроводил в актовый зал <ОП № 1> Ко мне подошел <…> мужчина, представился уполномоченным по правам человека, зовут его Мансур Мусаевич. Он со мной поговорил. <…> При этом нас снимали на камеру. Когда я находилась в актовом зале, время было 20 часов 00 минут. <…> В это время пришел сотрудник полиции, принес документы, я увидела <…>, что данные документы были о том, что я совершила какое-то административное правонарушение. Я отказалась подписывать. После этого меня <…> отвезли в Ленинский районный суд <…> время было примерно 22 часа <…> судья спросил мои анкетные данные, я ответила и упала в обморок <…> Я очнулась уже в спецприемнике МВД по Чеченской республике…
Представителя власти, в отношении которого я якобы применила насилие, я впервые увидела 01.02.2022 <…> в суде при избрании в отношении меня меры пресечения в виде заключения под стражу…»
В качестве доказательства к протоколу Заремы Мусаевой следователь Тарамов по ходатайству адвоката Натальи Добронравовой приобщил видеозапись того самого разговора с Уполномоченным по правам человека Мансуром Солтаевым. 21 января фрагмент этой видеозаписи был выложен самим Солтаевым на его странице в инстаграме ( соцсеть признана в РФ экстремистской. — Ред. ) и опубликован в этот же день на официальной странице ЧГТРК «Грозный».
Видео действительно сделано в помещении, похожем на актовый зал, Солтаев задает Зареме вопросы, купили ли ей инсулин, когда везли из Нижнего Новгорода в Чечню, и применяли ли к ней насилие полицейские. Он также обещает, что Зарему сейчас осмотрят врачи, потому что — это прямо видно — женщине совсем плохо, она, по сути, находится на грани обморока. Ни о каком нападении самой Мусаевой на полицейского и ее якобы буйном поведении в отделе полиции Солтаев не упоминает.
Вообще-то эта видеозапись — алиби Заремы Мусаевой. Because
ее разговор с Солтаевым происходил и был зафиксирован на видеокамеру сотрудников телеканала ЧГТРК «Грозный» как раз в то самое время, когда Мусаева, по версии обвинения, совершала нападение на участкового Абдулхамидова.
Между тем 24 января следователь Тарамов вынес поручение в адрес начальника отдела полиции № 1 И.К. Саидхасанова с просьбой провести «оперативно-розыскные мероприятия, направленные на установления свидетелей и очевидцев… <противоправного> деяния, совершенного Мусаевой З.А., а также сообщить <…> имеются ли камеры видеонаблюдения в здании ОП № 1 УМВД России по г. Грозному…»
На что начальник отдела полиции Саидхасанов ответил: «Записывающих видеокамер в помещении дежурной части ОП № 1 <…> не имеется».
Но на самом деле камеры есть. Об этом сообщили следователю Тарамову установленные в результате «оперативно-розыскных мероприятий» очевидцы «деяния Мусаевой» — все как один сотрудники ОП № 1, то есть коллеги участкового Абдулхамидова.
Они и рассказали следователю, что на самом деле камеры в отделе полиции установлены, вот только работают они «в режиме онлайн». Что имели в виду сотрудники полиции, следователь Тарамов выяснять не стал. Хотя вообще-то все современные системы видеонаблюдения работают «в режиме онлайн», то есть пересылают сигнал в облачный сервер, в котором хранятся видео- и аудиоданные.
Возможно, конечно, сотрудники полиции таким «эзоповым языком» хотели сказать, что установленная в обязательном порядке (согласно внутренним инструкциям МВД РФ)
система видеонаблюдения в отделе полиции № 1 УМВД России по г. Грозному на самом деле — муляж и профанация.
В любом случае, теперь этот важный вопрос будет выяснять уже суд в ходе процесса на Заремой Мусаевой.
Но лично меня удивляет другое.
Следователю Тарамову даже в голову не пришло допросить Уполномоченного по правам человека Солтаева и сотрудников телеканала ЧГТРК «Грозный», а также изъять у них видеозапись, по которой совершенно точно можно было установить время беседы Солтаева с Заремой Мусаевой.
Следователь Тарамов так отчаянно искал свидетелей и очевидцев преступления Мусаевой, что совершенно забыл про свидетелей ее невиновности.
