The court returned the police of 12 administrative cases to the defender of the Trinity Forest

The Grandmother's District Court of Moscow returned the police of 12 protocols on an administrative offense drawn up for a pensioner Tatyana Goleva, who was defending the Trinity Forest. In court it was represented by defenders from the OVD-info Vladimir and Natalia Zhilkin.

Goleva repeatedly paid participation in an inconsistent public campaign (part 5 of article 20.2 of the Code of Administrative Offenses) due to the alleged visits to meetings of the defenders of the Trinity Forest. The police detained the activist on August 17 and for almost a day she spent a police department in the Sviblovo district. There, during this time, all 12 protocols amounted to it.

“It is difficult to understand what moved police officers when they staged a pensioner. When for some reason they caught her late in the evening on the way from the store, when they brought her to a hypertensive crisis, when for some reason they were forcibly brought from Troitsk to Sviblovo in order to “stop offenses” for January and February, when, according to an arrest article, they forced her grandmother to spend the night in Kaz , and then kept almost the entire working day in the police, ”the Zhilkin said about the detention of a woman in their own Telegram channel.

In their protocols, police officers wrote the same information that in the Manezhka telegram channel or on the Rupor Moscow YouTube channel, photo and video materials were identified, which shows how Goleva takes part in “against the executive authorities of the“ against the inaction of the authorities and the destruction of the Trinity Forest ”.

The day after the detention, Tatyana Goleva was taken to court, but the consideration of her administrative cases was transferred to another date. As a result, the judge of the Grandmother's District Court Voronin considered all 12 protocols on one day, on August 31, and decided to return all the police materials. Vladimir Zhilkin said that this is a violation, since the judge could only return the protocols for revision at a preliminary hearing, and not at the meeting on the merits.

During the consideration of protocols, Vladimir and Natalia Zhilkin drew attention to numerous violations by the police. In particular, the case file was repeatedly mentioned by a certain Tatyana Goleva with a different date of birth, in the photographs that the police attached, it is impossible to identify the defendant, and an administrative investigation in these cases began in winter, it should not last longer than 30 days.

Defenders were also able to prove that in most cases, Golev was not on shares at the time indicated by the police, as she visited the dentist or went to church. In addition, part of the shares that are charged with were actually meetings with deputies, including representatives of the State Duma, for which coordination with the authorities is not required.

“We filed complaints to the prosecutor’s office, the police and the Commissioner for Human Rights in the Russian Federation against the actions of the police, we hope that the security forces will find the strength not only to stop the pursuit of the pensioner for imaginary violations in the name of the Trinity Forest, but also to apologize to Tatyana Evgenievna,” Zhilkin wrote according to the results of the court day.
