The Southern District Military Court in Rostov-on-Don extended the preventive measure for the Crimean Tatars Servet Gaziev, Dzhemil Gafarov, Alim Karimov, Seyran Murtaza and Erfan Osmanov. They will remain in the pre-trial detention center until December 20, reports the Crimean Solidarity association.
The men are involved in the case of the second Simferopol group - according to investigators, they took part in the activities of the Islamist party Hizb ut-Tahrir, which is recognized as terrorist in Russia and is banned.
In addition to participating in the activities of a terrorist organization (Part 2 of Article 205.5 of the Criminal Code), they are accused of preparing for a violent change of government (Article 278 of the Criminal Code with the use of Part 1 of Article 30 of the Criminal Code).
Gafarov has a second group disability and was diagnosed with renal failure. At the meeting, he said that he had been feeling unwell for the last week. The conditions in the tuberculosis hospital at the Federal Penitentiary Service are difficult, so he suffers and cannot fully prepare for meetings.
The man asked to cancel the preventive measure, or replace it with any other one not related to detention.
Gafarov also pointed out procedural violations: in particular, errors in the FSB certificates, where the names of their compilers differ. However, the judge said there were no violations.
“I am a disabled person of the second group, I don’t sleep at night and find contradictions, and at the meeting they tell me that everything will be ‘put together in a bag’ and made along with the final decision,” Gafarov was indignant in response.
There are 29 people in the case of the second Simferopol group “Hizb ut-Tahrir”: four are wanted, the rest are in custody.
Most of them were detained in 2019 after massive searches in Crimea and sent into custody. Many of those detained were activists of Crimean Solidarity, a public association that supports people facing persecution for political reasons in Crimea.
“According to the case materials, the accused did not have weapons, explosives, ammunition, did not plan to commit a terrorist act and did not call others to carry out terrorist actions,” Crimean Solidarity notes . At the heart of the matter are meetings with discussions of religious and political topics.
Memorial recognized the defendants in the second Simferopol group of Hizb ut-Tahrir as political prisoners.
On October 14, the Military Court of Appeal in Moscow upheld the extension of the arrest of five defendants in the case of the second Simferopol group of Hizb ut-Tahrir, Crimean Solidarity reports .
The publication Crimea.Realii published a detailed text about the second Simferopol case of Hizb ut-Tahrir. On March 10 , March 18 and May 12, fifteen other defendants in this case were sentenced to terms ranging from 12 to 19 years in prison.
After the ban on Hizb ut-Tahrir, criminal cases began to be initiated in different regions of the country. According to a number of experts, the party was unlawfully recognized as a terrorist organization, since its members in Russia did not prepare or carry out terrorist acts.
