
In one of the districts of Moscow, in the elections of municipal deputies, the human rights activist Anastasia Korenkova managed to ensure that the wards of the neuropsychiatric boarding school (PNI), which belongs to one of the polling stations, ceased to force voting. As a result, the 18-year-old communist won the elections in the district, and the director of PNI was left without a mandate. "Cold" tells this story.

The scene takes place in a room painted with light green paint. This is a state-owned vote in the municipal elections in the south-west of Moscow. In a wheelchair is one of the guests of the neuropsychiatric Internet, which needs to be signed in the ballot. The video appeared in the telegram channel "Siren" with a comment that people with disabilities are forced to vote in municipal elections.

It is difficult to understand whether he does it on purpose, not wanting to take a pen, or fingers are extended because of a problem with his hand. What was happening was taken to the phone by the lawyer and human rights activist Anastasia Korenkova, a member of the precinct election commission with a decisive vote No. 2307 in the Municipal District Obruchevsky.
This year, the elections of municipal deputies in Moscow took place within three days: on September 9, 10 and 11. If, in the past elections in 2017, the United Democrats Coalition, created by the ex-deputy of the State Duma, Dmitry Gudkov, and the candidates from opposition parties won over the United Russia in more than 20 districts of Moscow out of 125, then this time many independent candidates could not even register. They were preventively detained and arrested under the article on the demonstration of extremist symbolism. PNI "Obruchevsky", judging by the description on the site , is designed for 500 people. The wards of the boarding school, which are not devoid of legal capacity, can take part in the elections. So that all the wards of the boarding school can vote, the elections there, like throughout Moscow, passed for three days.
According to the law “On Basic Guarantees of Electoral Rights”, each statement about the desire to vote at the house must be signed personally before receiving the ballot. The vote itself should be free and voluntary. According to Anastasia Korenkova, the participation of the wards of PNI Obruchevsky did not look like this. According to her, voters were brought or brought in wheelchairs to the table with statements and ballots. Without asking anything from the wards, the boarding school staff helped them sign in the statement, and then put checks in the ballot. In fact, it looked so that PNI employees themselves voted instead of their wards. Korenkova took what was happening on the video and wrote a complaint to the higher territorial election commission (TIK). The complaint, however, was rejected in TIC, saying that it was forbidden to shoot voters in the video.

A single indicator or a formal criterion that allows you to determine that the voter asks for help in order to put a signature for issuing ballots and ticks in the ballot itself, the law on elections does not establish, says Viktor Vengerov, a member of TIC No. 8 of St. Petersburg and an independent observer for elections. The law requires that the voter express his will verbally. A method that allows people with disabilities to communicate with relatives, staff, neighbors in the room can not always be perceived or correctly read by third -party observers. At the same time, a person with preserved intelligence and vision, as a rule, can confirm his will in such a way that this is unambiguously perceived even by strangers, the observer notes.
According to Vengerov, it is extremely difficult to draw a border between the manifestation of desire and unwillingness to vote in this case: a person can be with a completely healthy psyche and intelligent intelligence - for example, after an accident or an accident, but not be able to clearly and aloud about his intention. Carrying out votes in PNI requires simultaneously strict observance of the law on elections and respect for the dignity and will of each voter, he says.
After long disputes between Korenkova with the members of the commission and the PNI employees that it is impossible to force a person to vote against his will and accusations towards Korenkova that she allegedly interferes with the elections, in the end, in the end, they listened to her. “I repulsed 12 votes. When we climbed the floor, where there were people who could not go down, every person was asked if they wanted to vote or not. They asked if help was needed. Nobody put a checkmark for them, I personally followed this, ”says Korenkova. “The rest [before that] did not ask anything, they put ticks for them and that’s it.”
As a result of voting in the boarding school, his director of Besstanko scored 322 votes. In neighboring areas, he received from two to 255 votes, which allowed him to claim the place of the municipal deputy in the district. But, when the counting of votes ended in all sections, it became clear that the director of PNI would not be a municipal deputy. Seven representatives of the “My District” and two United Russia, as well as the 18-year-old member of the Communist Party of the Communist Party of the Russian Federation, Roman Galenkin, who supported the “smart vote”, won the elections in the district. Galenkin received 9 votes more than the director of PNI Besstanko.
