The ECHR recognized the detention of 88 participants in Russian protests

The European Court of Human Rights (ECHR) issued decisions on complaints of 88 participants in Russian protests. In the decisions of the ECHR published on October 13, he satisfied, among others, 57 complaints filed by the lawyers of the ATS-Info with information support for the Memorial human rights center.

We are talking about the following decisions: “ Belyansky and others against Russia ”, “ Bobyrin and others against Russia ”, “ Saloid and others against Russia ”, “ Pimenov and others against Russia ”, “ Chirkov and others against Russia ”, “ Matskevich and others against Russia ”, “ Chernozub and others against Russia ”.

We are talking in published decisions about the detentions at the protest against falsifications in the Duma elections (December 5, 2011), the rally “He is not Dimon” (March 26, 2017), an action with a demand to hold guilty of falsification of the case against journalist Ivan Golunov (June 12, 2019), and supports in support of independent candidates for elections to the Moscow State Duma ( July 27 and August 3, 2019), as well as after the rally on August 10, 2019 on Academician Sakharov Avenue. One of the protesters filed a complaint against his detention in the defense of Alexei Navalny on January 31, 2021.

OTD-Info appealed to the detention of protests on June 12, July 27, August 3 and 10, 2019. According to our joint estimates with the PC "Memorial", in those days the security forces detained more than three and a half thousand people. “Then the lawyers of the Memorial and the ATS-Info launched the most massive campaign to appeal violations at the national level and in the ECHR. Three years later, the ECHR issued decisions in which he agreed with the position of human rights activists and recognized the declared violations, ”says Alexander Baeva, lawyer of the ATS-Info.

In complaints, lawyers indicated that during the detentions, the security forces immediately violated three articles of the European Convention on Human Rights: it was about illegal detentions (Article 5), violation of the right to a fair court (Article 6) and the right to freedom of assembly (Article 11). The Russian side denied all violations: according to the Ministry of Justice, the shares were not agreed with the authorities, and therefore detention are legal. Baeva explains: “This is not true, since Russia has a notification procedure for coordinating the action. In addition, there is the concept of “spontaneous protest rally”, when an acute situation arises, requiring an immediate reaction of society. Participation in such shares is the legal right of a citizen, according to the Convention and the Constitution of the Russian Federation. ”

As part of a joint campaign with the PC "Memorial", ATD-Info filed more than 2300 complaints related to shares held from 2019 to 2022. The decisions published on October 13 concern only 57 applicants, each of which the court awarded compensation with a total of 222,300 euros.

• On June 11, Putin signed a law that allows the Russian government not to comply with the decision of the ECHR, adopted after March 15, 2022 - the day when the Russian Federation left the European Council.
