In one of the Russian regions, the local military investigation department of the Investigative Committee of Russia opened the first criminal case in the country under part 2.1 of Article 332 of the Criminal Code against a contract serviceman. Pavel Chikov, head of the Agora International Human Rights Group, announced this on his telegram channel.
This article provides for responsibility for non-fulfillment by a subordinate of an order from a superior given in the prescribed manner, during a period of martial law, in wartime, or in conditions of an armed conflict or combat operations, as well as refusal to participate in military or combat operations.
As follows from the decision to initiate a criminal case, the investigation established that the defendant, being a contract soldier, “did not comply with the order given in the prescribed manner to leave on a business trip to participate in hostilities, thereby refusing to participate in hostilities.”
If found guilty, the contractor faces up to three years in prison.
The article under which the case was initiated was added to the Russian Criminal Code by appropriate amendments on September 24 this year.
On the eve it became known about the initiation of the first criminal case under another article added to the Criminal Code as part of the same package of amendments. In Yakutia, a mobilized local resident refused to go to fight in Ukraine and escaped from the military unit through a hole in the fence.
After that, a case was initiated against him under part 2.1 of article 337 of the Criminal Code, which was then reclassified to part 3.1 of the same article, which provides for liability for unauthorized abandonment of a military unit. According to it, the defendant faces up to seven years in prison.
