A draft law on the establishment of a probation institute for convicts in Russia has been submitted to the State Duma. His task will be to help them adapt to normal life. The basis of the document was developed in the Ministry of Justice in January, since then it has been subject to revisions and approvals.
As follows from the explanatory note, the draft law provides for the introduction of a number of measures to help convicts, "including their resocialization, social adaptation and social rehabilitation, protection of rights and legitimate interests." They will help not only those convicts who were sentenced to imprisonment, but also those whose punishment was not related to isolation from society.
The bill spelled out three types of probation for convicts. The first is called executive and involves helping convicts whose punishment is not related to deprivation of liberty.
The second type is penitentiary. It is intended for convicts who are serving their sentences in prisons and colonies, and for those who are preparing for release. For them, probation may begin nine months before their expected release. During this time, the convict, if he is recognized as in need of social adaptation, will have to be helped with obtaining the documents, education and work skills necessary for a normal life in freedom.
It is also planned to help released prisoners at the budget expense with the purchase of the necessary clothing for the season. In addition, the bill provides for a lump sum payment to those who have no means of subsistence.
The third type of probation prescribed in the bill is post-penitentiary. It involves comprehensive assistance in the adaptation of convicts who have served their sentences in places of deprivation of liberty, by the forces of medical, educational and other organizations.
Earlier, the head of the Ministry of Justice, Konstantin Chuichenko, said that citizens released from places of deprivation of liberty, as a rule, are not prepared for life in freedom: they have no money and cannot get a job. At the same time, he specified that every year in Russia, after serving their sentences, about 100,000 citizens are released.
“In this regard, recidivism is very high, today it is about 44 percent, that is, out of 100 [thousand] people, about 44 thousand people will again go to places of deprivation of liberty,” the minister said.
