
The Libertarian Yegor Besvnivnov from Samara was forcibly delivered to the military enlistment office. The draft commission ignored his application for the alternative service and issued him the agenda on December 6. Besvnivnov was able to appeal this decision and left the country. A similar story happened in Moscow, where the police detained 23-year-old Danil Shershev. Threatening with physical violence, they delivered him to the military registration and enlistment office, from where they were sent to the unit for a few hours to serve. “Cold” figured out why one was able to avoid a planned call, while others were sent to serve, using the security forces.

On November 28, in Samara, while registering a power of attorney, police detained a 20-year-old member of the Unregistered Libertarian Party, a former candidate for municipal deputies Yegor Besvonov. The phone was taken from him, after which they put him in the car against his will and brought to the military enlistment office. There, an urgently collected draft commission, ignoring the application for the alternative service, decided to send the activist to the army.

Besnvnov received the first agenda in March. She was handed immediately at the exit of the special reception, where he spent 28 days for organizing an anti -war march in Samara at the end of February.
“Usually, people stand on [military] accounting at school, but I didn’t go with everyone, I don’t remember why. I was not touched until 2022. They, apparently, were simply not known or not remembered about me. And at the exit from the special receiver I was handed the agenda. I registered and filed an application for an alternative civil service. In April, they refused me. From that moment on, we began to sue the military registration and enlistment office, ”Besvyatnov told the Cold.
It was not possible to win the case - then the activist filed a second application for the alternative service. The defender of Besvonov Arseny Levinson says that there were new arguments and new argument in the second statement. “Yegor asked the draft commission to hear witnesses, and the draft commission - now, on November 28 - called him and did not at all consider his new application for alternative civil service. Which, of course, is complete lawlessness and arbitrariness, ”says Levinson.
According to the lawyer, in his practice there were cases when the draftees were twice refused the passage of the AGS, but for the third time the draft commission still made another decision. In the case of Yegor Beschandynov, the draft commission simply ignored this statement.
While Besvnivnov was in the military enlistment office, his acquaintances called the employees and demanded to let go of the guy. A few hours later he was really released, obliging to appear on December 1, and also issued him a summons for sending to the army on December 6. After that, Levinson immediately filed a complaint with the court. The decision of the draft commission was thereby suspended. On the night of November 29, Yegor Besvlnov has already left Russia to Kazakhstan. He says that he crossed the border without problems.
“Egor left, faced with arbitrariness. He lost faith in that you can protect your rights. The state by its political persecution and the deprivation of the right to an alternative service actually squeezes out of the country of young people who are basically ready to serve, but alternative, ”says Levinson.
On November 29, in Moscow, police detained 23-year-old Danil Shershev. As his girlfriend Catherine told the “cold” ( she asked not to name the surname ), people in civilian clothes detained the young man in the entrance of the house, introduced themselves to a criminal investigation and, threatening physical violence, brought him to the military commissariat.

“He was taken away, without letting the agenda even sign it - it simply was not there. He is kept without communication, without a lawyer, ”said Catherine. Danil Shershev, unlike Yegor Besvlnov, was not in military registration and did not fall into the field of view of the police. And in the rented apartment, near which he was detained, according to Catherine, he moved just a couple of days ago.
After the detention, Shershev was immediately taken to the military registration and enlistment office, and from there to the assembly point. There, a young man was held for several hours. He was taken away from him, neither relatives nor a lawyer were allowed to him, and then he was sent to the military unit in the Tver region for military service.
In a car that drove him to the unit, Shershev asked the driver to call his mother. He said that employees of the military enlistment office falsified all the necessary documents by signing them instead. Only thanks to this call, the close Shershev found out that he was taken away
“Danila did not even conduct a medical examination at the assembly point and gave the agenda for shipment on the same day. It all depends on how much people who are in the draft commission are ready to grossly violate the law - only this is the difference. In Moscow, as we see, they are generally ready to grab people on the street, without observing minimal formalities, and send to the military unit, ”says Levinson, who also advised Shershev's relatives.
According to the defender, after sending to the part, it will be much more difficult to help Shershev. Formally, after signing the documents, he was already recognized as a military personnel. While the lawyer will appeal the illegal actions of law enforcement officers and employees of the military commissariat, Shershev will probably be forced to be in the troops.
“This, however, does not mean that we will give our hands and give up the struggle. Danil has health problems - peptic ulcer. We will start by seeking his hospitalization, ”Levinson assured.
If a person received a summons, but repeatedly did not appear at the military registration and enlistment office on it, then he can be put on the wanted list as a slope and initiate a criminal case of a call from under article 328, explains the lawyer Anastasia Burakova.
“A man is not a suitcase to just take and send him to the army. The procedure should be as follows. First, a person is wanted: legally, at the request of the military registration and enlistment office, if a person has evaded the registration of military registration and receipt of the summons. Further, a person, for example, is delivered to the military registration and enlistment office, and the presentation of the agenda should follow this, ”says Burakova.
Neither Danil Shershev nor Yegor Besvnutnov received summons before the detention and sending to the military registration and enlistment office. According to Levinson, in the situation with Besvasnov, the power of attorney for a lawyer helped: “The power of attorney gives more tools to pull out a person. This is a guarantee that it will still be possible to somehow protect his rights, even when a person is completely deprived of communication, in isolation. ”
The coalition of lawyers "Calling to conscience" due to the raids on the draftees also recommends to issue a power of attorney. They also advise you to carry a power supply, a spare button phone and documents (a notarized copy of the passport, an application for an alternative civil service, copies of documents about a leather and medical documents).
Defenders recommend not to open the door if you have come home. If you are approaching you on the street, it is worth notifying your loved ones or a confidant as soon as possible, record the name of a police officer or military registration and enlistment office, as well as to fix what is happening on video or audio. You can not give employees a passport. Lawyers note that nothing can be signed. According to them, it is necessary to demand a summons, and if the police insist that you need to be brought to the military registration and enlistment office, you need to demand from the employees of drawing up a protocol on detention and delivery.
At the military registration and enlistment office, human rights activists recommend refusing to pass the medical and draft commission and also demand from employees to issue a summons. If earlier you did not apply for an alternative civil service, then it is worth writing it and demand that the draft commission accepts the document. The application is submitted through the office of the military enlistment office, on its copies you should put on the acceptance.
Relatives are advised to contact human rights activists as soon as possible. They also need to establish a connection with the conscript himself - for example, bring him a button phone. It is important to remain in touch and advise a conscript about his rights and further actions.
