As Ilya Yashin is judged - one of the few opposition politicians who remained in Russia after the start of the war

Since November 29, the Meshchansky court of Moscow is considering the case of the policy of Ilya Yashin , who is accused of spreading the "fakes" about the Russian army "based on political hatred." The reason for the initiation of the case was the April Stream Yashin, in which he talked about the murder of civilians in Buch. Three trips of the court took place. What is accused by Ilya Yashin - and on what basis

On the first day of the court, the prosecutor made an indictment according to which Ilya Yashin in his stream spread “knowingly false information” about the actions of the Russian army, telling about the murders of civilians in the occupied buch. At the same time, according to the prosecution, he “knew” that Russia is taking measures “to maintain peace and security” and complies with the conventions prohibiting aggression in relation to the civilian population.

The prosecutor referred to the results of a linguistic examination, according to which Yashin presented “information in the form of allegations of facts”, which does not correspond to the position of the Ministry of Defense of the Russian Federation. The Russian command denies the involvement of the Russian military in murders in Buch.

Then the interrogations of witnesses of the prosecution began. The first to the courtroom was invited to the senior operative center for counteracting extremism Ivan Kucherov, who wrote a report, which formed the basis of a criminal case. He stated in court that Yashin was critically reacted to the position of the Ministry of Defense and included a fragment of the BBC video about the murders in Buch in a stream. At the same time, Kucherov added that he was simply a detective who collected materials and sent them to the Investigative Committee.

For a linguistic examination, expert Marina Savosina attracted experts. She said in court that Ilya Yashin gave the position of the Russian Ministry of Defense in Stream, but did this critically, putting up the version of the ministry as "not inspiring confidence."

What the defense side answered

The second day of the court is the interrogation of witnesses of defense. Expert Igor Zharkov said that Ilya Yashin in his stream expressed a position regarding events in Buch, which was based on media reports.

Another witness to the parties to the defense is the psychologist Veronika Konstantinov. She said that Yashin “only interprets other people's reports, and his statements cannot be evaluated for reliability,” writes Mediazon. Konstantinova added that Yashin in his stream did not call anyone to anything and did not arouse hatred or enmity by any signs. “We cannot talk about enmity and hatred of the social group,” she concluded.

A person, when he sees two plausible information messages, is forced to choose one. And he is inclined to what his soul lies with more. The official position is against the position of unofficial - this is an opinion against opinion. This is not connected with the factology. It is impossible to check.

The defense asked the court to call for the interrogation the official representative of the Ministry of Defense of the Russian Federation Igor Konashenkov, the main speaker on behalf of the Russian command, who makes statements about the war in Ukraine. Judge Oksana Goryunova refused this petition.

What did Ilya Yashin say

Ilya Yashin said in court that he was innocent. “This is absolutely legal journalistic and political work, I have the right to freely collect information, distribute and give it an assessment. I did not make inaccurate statements, I expressed my point of view. No need to take this right from me, ”he said.

The next court session is scheduled for December 5. On this day, the debate will take place - and, probably, Ilya Yashin will perform with the last word. This is how the judge and the defendant talked:
