Drivers will not initiate affairs for the reception of antidepressants

The traffic police recommended temporarily not to initiate cases against drivers, in the body of which traces of drugs that are not related to narcotic or psychotropic drugs were found. We are talking, including about phenibut, phenazepam and a number of antidepressants. This was reported by Kommersant with reference to the letter of the chief of the traffic police Mikhail Chernikov, sent to the Russian regions.

The Directive of Chernikov, writes the publication, is connected with the recent decision of the Constitutional Court in the case of Russian Vasily Shevelev, in the body of which in August last year, a gabapentin was discovered - a drug for the treatment of epilepsy, not related to drug and psychotropic, after which the court deprived him of the driver’s license.

The City Court of Salekhard, in which Shevelev appealed the decision, noted that Article 12.8 does not provide for punishment for the use of drugs. The KS noted that in the regions they are often punished by deprivation of the rights and fines of citizens who enabled medicines that are not related to psychotropic, recognized the article that did not meet the norms of the Constitution and decided that from November 27, the courts should not punish drivers for taking such drugs.

At the same time, the KS ordered the State Duma to "immediately" amend the Code of Administrative Offenses in order to punish drivers who abuse medicines to obtain a stupid effect, but do not violate the rights of other citizens. Deputies of the LDPR have already suggested that the Ministry of Health establish a separate list of drugs, the use of which will be prohibited at the wheel, regardless of concentration. The bill is sent to the Duma Committee on State Building.
