Lawyer Mikhail Benyash again demanded to be sentenced to a fine in the case of an attack on police officers

The prosecutor in the debate in the Leninsky District Court of Krasnodar demanded to appoint a fine of 40 thousand rubles to lawyer Mikhail Benyash, who was accused of applying violence to the police who beat him (part 1 of article 318 of the Criminal Code). This was reported by the publication Sota.

The criminal case against Benyash lasts since the fall of 2018, and the court is considering it again. A lawyer was accused of applying violence to the police after a group of security forces stopped and beat him when he was heading for the detainees against the pension reform.

According to the investigation, during the detention, Benyash bites one of their police officers by the hand, and hit the second three times with an elbow in the face. The lawyer led a month in a pre -trial detention center, but later he was released on bail of 600 thousand rubles. In October 2019, Benyash was found guilty and fined 30 thousand rubles. Later, the Krasnodar Regional Court abolished the verdict, but in April 2021 the prosecutor's office protested this decision.

• Lawyer Mikhail Benyash is not the first time undergoing pressure from the state. In October 2022, he was recognized as an individual, an “foreigner”. In February 2023, the Council of the Bar Chamber of the Krasnodar Territory after the recommendation of the Ministry of Justice deprived Benyash of a lawyer status. The department made such a requirement on the basis of an inspection of the publications of a lawyer, who, according to officials, "discredit the public service, as well as employees of the executive authorities."
• The lawyer also tried to bring to administrative responsibility for expressing an opinion about the war in Ukraine in an interview with the protocol YouTube channel. However, in April, the courtterminated the case of discrediting the army (Articles 20.3.3 of the Code of Administrative Offenses) against him. In addition, in March, Benyash was searched in the case of telephone terrorism (Article 207 of the Criminal Code). The court later canceled the decision on the search.
