
The European Court of Human Rights (ECHR) granted 26 complaints of the Blood PC Memorial and the OTD-INFO, assigning them compensation from 3,500 to 5000 euros. The decisions were published on the official website of the ECHR.
The complaints of the clients are submitted in the court decisions that relate to the issue of freedom of assembly in Russia: "Ionov and others against Russia." “Puzanov and others are against Russia” , “Belogology and others against Russia” , “Reason and others against Russia” and “Sharashkin and others against Russia” .
They say about the detentions due to public events:
The detainees due to these protests were attracted under articles on administrative offenses. As a result, they received punishments, including fines from 1 thousand to 20 thousand rubles, compulsory work and 10 days of administrative arrest.
The court noted violations of several articles of the Convention for the Protection of Human Rights and Fundamental Freedoms (Convention) in relation to applicants by the Russian authorities. First of all, the ECHR indicated a violation of Article 11 of the Convention, which provides for the right to freedom of assembly.
The court concluded that “disproportionate measures” were applied to the detainees as participants in peaceful meetings. These measures have led to the acceleration of shares, detentions and subsequent prosecution within the framework of the Code of Administrative Offenses (Code of Administrative Offenses). Having taken into account its own practice, the court concluded that in this case, interference in freedom of assembly was not “necessary in a democratic society”.
Another article of the Convention, the violation of which was recognized by the ECHR, is Article 5: It guarantees the right to freedom and personal integrity. According to the court, the Russian authorities violated national legislation and the principles of international law, delivering and holding for many hours the detainees in the police departments. Subject to all the norms, the detainees, according to whose complaints they made decisions, should not be brought to the department, the police were obliged to draw up protocols at the place of detention and not to deprive the freedom of detainees for such a long term.
The court also noted a violation of Article 6, which guarantees the right to a fair trial. This article, among other things, concerns cases when the prosecutor was absent at the hearing. In such a situation, in fact, the court itself became the side of the prosecution.
14:36 ECHR also prescribed compensation for 6 thousand euros to the opposition blogger Mikhail Svetov. His complaint is submitted in the resolution "Belogologi and others against Russia."
The reason for this was two administrative arrests of Svetov: for 10 days - after the St. Petersburg rally against pension reform in September 2018; For 30 days - after negotiations with the Moscow Mayoria on the action on August 3, 2019 in support of independent candidates for deputies to the Moscow City Duma.
In both cases, the blogger was charged with a violation of the rules of the shares (Article 20.2 of the Code of Administrative Offenses) - part 6.1 and part 8 , respectively.
20:02 Among the applicants, who were awarded by the ECHR, also residents of Yekaterinburg Vadim Pankratov and Arthur Khaziev, who opposed the construction of the Church of St. Ekaterina at the site of the square at the Drama Theater. Their complaint is presented in the resolution of "Reason and others against Russia." The veteran of the Ministry of Internal Affairs Pankratov participated in protests from May 13 to 14, 2019, he was fined 10 thousand under an article on an inconsistent rally. In the media, he received the nickname “Grandfather Picket”, the activist is known for often participating in pickets, but emphasizes that he is a supporter of Vladimir Putin. Pankratov was also brought to criminal liability in the case of violence against a police officer (part 1 of article 318 of the Criminal Code) - he hit a police officer with a newspaper. The court appointed him a fine of 20 thousand rubles in a criminal case. Khaziev was fined the same amount after the action in the square on June 4, 2019. Both of the ECHR awarded 3,500 euros of compensation.
In addition, compensation in the amount of 4,000 euros was appointed Petersburger Vladimir Pervovsky, detained on June 29, 2019 during a protest against refusal to register candidates for municipal deputies; 5,000 euros - the Moscow left activist Kirill Kotov, arrested five days after the campaign on May 13, 2019 in support of the defendants in the affairs of the “Network” and “New Greatness”; 4,000 euros - Nikolai Kovalev, fined after the campaign on July 27, 2019 against the uncertainty candidates for the Moscow City Duma for the elections; 4,000 euros - the Yaroslavl activist Andrei Razumov, who received 20 hours of compulsory work after the picket on October 7, 2017 in support of the nomination of Alexei Navalny to the presidential election; 4,000 euros-Voronezhets Yuri Altukhov, fined due to protest on May 5, 2018 against the repeated inauguration of Vladimir Putin.
