
The Interire City Court of the Kemerovo Region terminated two administrative cases of an eco -activist and lawyer Maxim Andrianov - in both cases he was charged with an article on the initiation of hatred (Article 20.3.1 of the Code of Administrative Offenses). This was announced on his YouTube channel by the blogger Mikhail Alferov, who represented the interests of the eco-activist in court.
The prosecutor’s office started administrative cases due to the repost of the video “six coal hucksters” from the Alferov channel. In this video, the police, under the pretext of a broken car, blocked the locals of the village of Berenzas, who were on duty in the forest - at the site of the construction of the road to the carbon station. Reposts made on July 13 and 22, 2022; In them, the security forces found the excitement of hatred of law enforcement agencies.
At the court meetings, the representative of the prosecutor’s office could not prove that this video could not be distributed: at the time of publication he was not banned and not recognized as extremist material.
In addition, the prosecutor’s office introduced a sociological-linguistic examination to the materials of the case, which was originally issued at the request of the E-E Center for another administrative case-in relation to Alferov himself. In this study, three videos were studied and made a general conclusion based on them. At the same time, the prosecutor’s office used this examination for only one video, which was charged with Andrianov.
The court sided with the defense and terminated administrative cases. In both cards of cases ( one , two ), the “lack of an administrative offense event” indicated as a reason.
Materials for initiating the case were sent to the prosecutor’s office by an employee of the Center “E” named Samara. According to Alferov, earlier this operative participated in the initiation of two other administrative cases on Andrianov: according to a rally article (part 1 of article 20.2 of the Code of Administrative Offenses) due to a meeting with the participation of 10 residents of the village of Berenzas; And also under the article on the abuse of freedom of the mass media (part 9 of article 13.15 of the Code of Administrative Offenses) due to the repost of the text of the publication “New Gazeta. According to the rally article, Andrianov was appointed 40 hours of compulsory work. The materials of the second administrative case were redirected to different courts twice, but, as Alferov says, “their further fate is unknown”: the activist did not receive summons or notifications about the court session.
