We are talking about the initiative of the head of the State Duma Committee on Defense Andrei Kartapolov, who proposed introducing a separate punishment for evasion of service during mobilization and martial law.

To do this, Kartapolov recommended supplementing Article 328 of the Criminal Code with one more, third part. Now it only provides for punishment for evading military and alternative service (up to two years in prison and up to six months of arrest, respectively), that is, it applies only to conscripts.

Vedomosti writes that the government's review, which is written before introducing the bill, was approved back in July. Specific liability for evading conscription during mobilization or in wartime conditions has not yet been spelled out in the documents.

Kartapolov’s initiative first became known on November 1 last year - the day after the authorities announced the end of the “partial mobilization” (a decree on this has not been signed by Putin since then). Then deputy Ernest Valeev told Interfax that the bill would fill a gap in the law, which still does not spell out liability for evasion of mobilization.

As Vedomosti clarifies, then Kartapolov and Valeev proposed punishing mobilized evaders with a fine of up to 500 thousand rubles, forced labor or imprisonment for up to five years.

At the end of the spring session, the State Duma adopted a bill that would increase fines for failure to appear at the military registration and enlistment office on a summons to 30 thousand rubles.

In addition, before leaving for the holidays, deputies forbade conscripts from leaving the country from the day their summons was entered into the “unified register of military records”, raised the conscription age to 30 years and allowed governors to create their own “military enterprises”.

In April 2023, was passed the Electronic Subpoenas Act .
