On Thursday, August 31, the Government of the Russian Federation did not support the bill, which proposed to exempt from criminal liability for crimes of small and average gravity of volunteers in the war in Ukraine. About this with reference to the order of the Cabinet's recall is reported by TASS.
Details. The bill was submitted to the State Duma on April 4 - this was made by the Legislative Assembly of the Chelyabinsk Region. The document assumes that the prosecutor, as well as the investigator and the interrogator, with his permission, may terminate the criminal case against the suspect or accused of committing a crime of small or medium gravity if the defendant decided to serve in the Volunteer Military Formation.
“This will correspond to the state policy in the field of criminal legislation in the context of a special military operation,” the authors of the document believe.
They noted that in Russia to participate in hostilities, they are already attracting convicted citizens. “Thus, the state recognizes the possibility of a citizen of guilt before society and the state through voluntary military service in military units,” the explanatory note says.
However, the government indicated that such changes contradict the Criminal Code of the Russian Federation. The officials also said that the bill did not specify what needs to be done if the volunteer does not fulfill the military service contract.
Don't they free them anymore? No, on June 24, Russian President Vladimir Putin signed a law that allows you to exemption from criminal liability that concluded a contract on military service during mobilization or martial law.
