Who is the master in the house?
On the example of the case of the case of Kagarlitsky, today the appeal military court in a closed village of Vlasikha answered this question.
Replacement of punishment to the political scientist Boris Kagarlitsky* with a fine of 609 thousand rubles. For five years in prison, it does not formally contradict the Criminal Procedure Code of the Russian Federation, at the end of 2010 a supplemented head of production in the appeal instance. Article 389.15. UPK indicates among the grounds for the cancellation or change of the court decision “unfair sentence”, and Art. 389.24 clarifies that he can be changed towards the deterioration of the situation of the convicted person on the complaint of the victim (which is not in this case) or the presentation of the prosecutor.
According to Kagarlitsky, who spoke to the supporters and journalists before the trial outside the gates of the closed village, the prosecutor's office substantiated the complaint that, since July last year, he was in custody in the Syktyvkar pre -trial detention center, that is, four months before the sentence in Komi, was submitted to Rosfinmonitoring in the list of terrorists and extremistles: all of him. The accounts are blocked, and he is supposedly unable to pay a fine. Meanwhile, the penalty was paid back in January 2024 from the funds raised by his associates-socialists.
All this has only an indirect attitude to the law, as well as the direction of the case of a resident of Moscow for investigation and the court in Syktyvkar only on the grounds that it was instituted on the complaint of a certain deputy of the municipal council of Ukhta. He saw the signs of the justification of terrorism in the Kagarlitsky video, which, according to the Kommersant newspaper (the case was listened in closed mode, and we can only refer to this source), was published in his telegram channel in October 2022 as a reaction to the explosion on the bridge over the Kerch Strait. The explanation given by the author that in the name of the video that outraged the prosecutor’s office, he had in view of the real cat of the bridge-the favorite of the bridge builders, the Komi-Suds did not consider a sufficient basis for the cessation of the persecution.
Meanwhile, judges of military courts sometimes show more common sense and independence than their colleagues in the courts of general jurisdiction, who in recent years are rarely resolved with the prosecution bodies. Probably, the Komi-Suds were taken into account, if not a cat, then at least the scientific degree of the political scientist and his previous merits-in particular, the seizure in Lefortovo for criticizing the Soviet regime in 1982-1983.
In October 2023, at a meeting of the Valdai discussion club, the question of the fate of Kagarlitsky, known in scientific circles as a teacher of Shaninka, with an explanation that “he was never against Russia” was set by President Putin, and he promised to “figure it out”.
So, they figured out who was supposed to. Once again: today's change in the punishment of Kagarlitsky - the decision is by no means legal, but purely political.
In addition to the general message, that no mercy of political affairs should be expected, it makes it clear who is actually the owner in the house, which in the USSR was so together and was called "courts-and-preservative-orientes-organes."
The prosecutor’s office asked for 5.5 years in Komi, and the court showed some “left” humanism and common sense. So it should not be - now the "dictatorship of the law" has happened.
