The State Duma is preparing for the second reading a bill on the prohibition of Trash Stamov-video broadcasts, during which people for money are mocking animals or other people. Amendments to the Criminal Code proposed by the deputies provide fines for trash-stamers up to 700 thousand rubles, and in the case of a person of injuries or his death-imprisonment for a period of 8 to 20 years.

Children, cats and dogs

On March 27, it became known about the detention of a trash-stero from Sterlitamak Rustam Absalyamov, who called on the air to “explode Moscow” and stated that he did not sympathize with the victims in the terrorist attack in Crocus City Hall. Just a day later, the official channel of the Ministry of Internal Affairs published an apology of the blogger, where he said that "he spoke catastrophically incorrect things to attract attention."

The intention to prohibit the trash Stems in early January was personally stated by the State Duma chairman Vyacheslav Volodin. “In recent days, there are especially many appeals with requests to find a solution that will allow you to effectively deal with such a phenomenon. These are broadcasts on the Internet, during which illegal acts are made with a demonstration of cruelty, sadism, mockery of people and animals, as a rule, in order to earn money and increase his audience, ”he wrote in his Telegram channel.

Already on January 25, the bill passed the first reading, and in February, amendments were collected for it for adoption in the second reading. The final consideration of the bill is scheduled for the spring session.

Volodin was most angry with Blogger Sergei Kosenko, who live his two -month -old son into a snowdrift. Serov was charged under Article 117 of the Criminal Code of the Russian Federation “Type in relation to a minor” and under article 156 of the Criminal Code of the Russian Federation “Failure to fulfill the duties of raising a minor”. Together, the blogger threatens up to six years in prison.

Often, animals become victims of trash.

• In May 2023, the police detained a trash-steamer from Nizhny Tagil, who beat his dog live and earned it on this. Users sent a man money for a card for each act of violence over the animal. For a “generous reward”, a Tagil resident named Bulat was ready to kill a dog. He is currently under investigation.

In all the above cases, the crimes were qualified in one way or another according to the existing norms of the legislation, but not any of them provided for additional liability for maintaining online broadcasts.

What awaits trash-constraints?

According to the changes that are proposed to introduce to the legislation, the fact of stream will become an aggravating circumstance, as well as a qualifying sign under ten articles of the Criminal Code, including murder, intentional infliction of health, beatings, abduction, illegal imprisonment, and the use of slave labor.

The fact that amendments to the Criminal Code concern crimes against people. In relation to broadcasts with bullying over animals, only responsibility within the framework of the Code of Administrative Offenses is strengthened: for the distribution of such broadcasts for citizens, fines of up to 600 thousand rubles will be provided, for officials - up to 700 thousand rubles.

Social networks will be required to monitor such content and delete it. In some cases, bloggers and leading broadcasts may completely deprive the right to use the Internet. This was stated by the head of the State Duma Committee on Youth Policy Artem Metelev in November 2023 at one of the government meetings. “According to most crimes, we additionally introduce the opportunity to the court to apply for positions or to carry out a certain activity for up to three years, implying that in this way the court may deprive the trash-intramers of the opportunity to use the Internet,” the deputy summed up.

Will the responsibility of the zoo defenders affect?

An important criterion for bringing a person to justice will be the presence of malicious intent, the State Duma deputy Artem Metelev explained to Smole. According to him, some “respectable citizens”, due to the specifics of their activities, somehow work or publish materials that contain cruelty and violence: for example, he classified military commissars and activists who publish crime certificates in order to attract the attention of law enforcement agencies.

“This category also includes zoo defenders, the purpose of which is to save animals and call the public to care for them. Defenders of animals are definitely doing their job not for sake or hatred, but out of good motives, their punishment will not affect, ”Metelev explains.

According to him, everything will depend on what exactly happened. In the event of a murder on the air, the Investigative Committee will do business. “If there were no crimes, but the actions were committed under the definition of the trash Stim-it will also be given in the law-the Ministry of Internal Affairs or Roskomnadzor will conduct an administrative investigation, draw up a protocol that will be considered by the court. The blocking will be carried out by Roskomnadzor, plus we introduce elements of self -regulation for social networks: they will also be endowed with the right to delete this content, ”the deputy explained.

According to the executive director of the animal protection alliance Yuri Koretsky, the bill, “on the one hand, clearly has a positive orientation towards the fight against trash stams, but on the other hand, it is still difficult to evaluate the effectiveness of its application in practice.”

Cause suffering to someone who is weaker

Biologist Mikhail Krivosheev, in an interview with the correspondent of Smol, said that the behavior of the trash-Stamers is a pathology. “If you are mocking animals or someone else, shoot, and then also publish it-what to say here? I absolutely do not understand who looks like this, but from the point of view of biology, everything is explained simply - this is a manifestation of manic inclinations of a person, ”he argues.

The psychoanalyst Elena Glubokovsky told Smole that people publishing trash Stems need therapy: “The desire to cause suffering to the one who is weaker is playing out children's injury. An attempt to alleviate your suffering, not to experience them inside, but to infinitely dissociate, put in another. Such a person needs treatment, psychotherapy. He can’t cope alone alone. It will always be destroyed by someone: others or himself. ”

Glubokovsky draws attention to the fact that Tresh-Strams as phenomena have the same nature as in bullying or traditions to look at public executions in the square.

According to the expert, those who watch streams with such content also realize their needs. And they are also accomplices in crime.
