The prosecutor's office asked to soften the sentence of a resident of Krasnoyarsk Krai who fought in Ukraine and was sentenced to 9 years for the murder of his ex-wife

The Krasnoyarsk Regional Court, despite the prosecutor's office's petition, did not mitigate the sentence of local resident Alexander Borodin, who fought in Ukraine and was sentenced in March to 9 years in prison for the murder of his ex-wife. He was found guilty of causing grievous bodily harm resulting in the death of the victim (Part 4 of Article 111 of the Criminal Code). The decision was found on the court's website by Verstka.

At the end of December 2023, Borodin rented an apartment for a day in the city of Kodinsk and invited his former common-law wife to celebrate the New Year together, the publication writes.

According to the court ruling, during the argument the man beat his ex-wife. The forensic medical examination found the cause of death to be closed blunt chest trauma with rib fractures, ruptures of the parietal pleura and right lung, complicated by the development of traumatic shock. At least eight blows led to such an injury, experts classified it as serious bodily harm. In addition, Borodin struck the woman at least 244 times, which caused hemorrhages, bruises and abrasions on her body, which did not cause harm to health.

Neighbors questioned by the police said that when they met, they saw traces of beatings on the victim’s face, they said that she was afraid of Borodin, and he himself did not hide the fact that he beat her.

The man insisted that "the victim provoked him, playing on his feelings and dignity for a long time, insulting him with rude obscene language." According to Verstka, after the beating, the man left his ex-wife lying on the floor and went to bed, and when he woke up in the middle of the night and realized that the woman had died, he decided to take her body out of the apartment, but then changed his mind. In the morning, Borodin called an ambulance.

Since January 3, he was in a pre-trial detention center; on March 21, the Kezhemsky District Court sentenced him to 9 years in a maximum security penal colony.

The appeal against the man's sentence was filed by Irina Aleksanina, acting prosecutor of the Kezhemsky District of Krasnoyarsk Krai. He was represented in the regional court by prosecutor Malyutina. As arguments for mitigating the sentence, she indicated that Borodin actively contributed to the disclosure of the crime, wrote a confession, gave a confession, and immediately after the beating, "independently called an ambulance." At the same time, Verstka notes that by the time the doctors arrived, the woman had been dead for more than six hours.

The convicted man himself expressed disagreement with the sentence in his complaint "due to its unfairness due to the excessive severity of the punishment imposed." He said that the court did not take into account as a mitigating circumstance "the immoral behavior of the victim, which was the reason for committing the crime." In addition, Borodin noted that the court should have taken into account that he fully admitted his guilt, "sent the victim an apology letter," and also that he fought in Ukraine.

However, the Krasnoyarsk Regional Court did not heed these arguments, noting that, when passing the sentence, the first instance took into account mitigating circumstances, such as a confession, admission of guilt and remorse for the crime, as well as “the health of the perpetrator, his participation in a special military operation and the awarding of awards.”
