The Supreme Court upheld the sentence of politician Alexei Navalny, who died in prison, and former technical director of Navalny LIVE, Daniel Kholodny, in cassation: 19 and 8 years of imprisonment. Rusnews writes about this.
On August 4, 2023, at an off-site hearing at Correctional Colony No. 6 in the Vladimir Region, the Moscow City Court sentenced Alexei Navalny to 19 years in a special regime penal colony under articles on financing extremism (Part 2 of Article 282.3 of the Criminal Code), on creating an extremist community (Part 3 of Article 282.1 of the Criminal Code), and on calls for extremism via the Internet (Part 2 of Article 280 of the Criminal Code). Taking into account the expiration of the statute of limitations, the politician was released from liability under articles on the rehabilitation of Nazism (Part 3 of Article 354.1 of the Criminal Code), on involving minors in dangerous actions (paragraphs "a", "b", "c" of Article 151.2 of the Criminal Code), on the creation of an NPO that infringes on the rights of citizens (Part 2 of Article 239 of the Criminal Code), and on calls for extremism (Part 1 of Article 280 of the Criminal Code). Navalny was also given a fine of 500 thousand rubles, a three-year restriction of freedom, and a ten-year ban on publishing on the Internet.
In the same case, Daniel Kholodny was sentenced to eight years in a general regime penal colony. He was also banned from publishing on the Internet for four years. The man was charged with participation in extremist activity (Part 2 of Article 282.1 of the Criminal Code) and its financing (Part 2 of Article 282.3 of the Criminal Code).
The First Court of Appeal in September 2023 rejected the appeal and upheld the sentence for Navalny and Kholodny.
The case of an extremist community against Navalny was opened in December 2021. Later, several more articles of the criminal code were added to it. On May 25, 2023, the case was submitted to the court. The politician was given 10 days to familiarize himself with the 196 volumes of the case. In June 2023, the court closed the consideration of the case. In February, Alexei Navalny died in the penal colony.
- On June 9, 2021, the Moscow City Court recognized the Anti-Corruption Foundation (FBK), the Citizens' Rights Defense Foundation (CRDF), and Alexei Navalny's headquarters as extremist organizations. The appeals court later upheld this decision. After that, supporters of the opposition politician began leaving Russia en masse.
- In February 2021, Navalny's suspended sentence in the Yves Rocher case was replaced with a real one. A year later, Navalny was sentenced to nine years in a maximum security penal colony on charges of fraud (Part 4, Article 159 of the Criminal Code). He was also fined 1.2 million rubles on charges of contempt of court (Article 297 of the Criminal Code). In February 2024, the politician died in the colony.
