The Moscow City Court has upheld a ruling to apply compulsory medical measures to eco-activist Olga Kuzmina , her lawyer reported.
In August 2023 , the Babushkinsky District Court of Moscow sentenced her to compulsory treatment in a psychiatric hospital on charges of hooliganism (Part 2 of Article 213 of the Criminal Code) due to a protest against renovation and tree felling.
The investigation found the crime to be caused by Kuzmina climbing a tree and tying herself to it, taking with her a crossbow that was unsuitable for shooting. The prosecution representative asked that she be released from criminal liability and "to be treated with medical measures in a specialized hospital."
The case was re -submitted to court in November 2022. The prosecutor's office had already completed the investigation several months earlier, but the Babushkinsky District Court of Moscow ruled to return the materials to the prosecutor's office to correct the violations. The judge also found that Kuzmina's rights to defense and to familiarize herself with all the case materials had been violated.
Kuzmina has been under house arrest since August 17, 2021. In July 2022, she was forcibly hospitalized in a psychiatric hospital for a week for an examination. By that time, the decision to conduct the examination had not entered into force.
In their conclusion, the doctors indicated that the girl’s character was characterized by “willfulness, predominantly oppositional, negative behavior, a tendency toward litigation and protest reactions.”
