The judge of the Preobrazhensky Court of Moscow Valentin Lebedeva sentenced the programmer Ilya Vasiliev, known as Arvi Harcker, by the 8 years of the colony in the case of the distribution of “fakes” about the army (paragraph “D” of part 2 of Article 207.3 of the Criminal Code) for the post on Facebook . Before the debate, lawyer Gevorg Aleksanyan asked the court to appoint a new examination of the post - he was written in English, and the FSB experts found “political hatred” in inaccurate machine translation of the text. The court refused this request. The prosecutor's office asked Vasiliev to be sentenced to 8.5 years in the colony.

“Throughout the world, they are now looking at this matter, what I wrote, read our laws and compare where the ancestors honor the victory over fascism and where we are working to ensure that fascism is not, but where we can’t do it yet. <...> We have not to go under the bullets, but to risk our career, our freedom, to go to the shkski in sailor silence or on the bunk, and to meditate there, and not in the altar, so that there is no fascism, ”said Ilya Vasiliev in the last word.

The FSB first came to Vasiliev’s apartment with an inspection and seized all the equipment from him on May 11, 2023. He himself unlocked all the devices and issued passwords in exchange for a promise that the security forces would only “establish the absence of curators from Ukraine” and after a month everything would return. On the same day, Vasiliev was assigned a fine of 40 thousand rubles for the "discredit" of the army. He was not returned to the equipment, and on June 22, 2024, after a new search, he was sent in a pre -trial detention center in the case of military "fakes".

Vasiliev was charged on a page on Facebook of December 25, 2022: “Putin rejected the Christmas truce. Now his missiles are firing on peaceful Ukrainian cities and villages. Only yesterday in Kherson, where the family of my father lives, 16 people were killed. Or lived? Millions of Ukrainians are now sitting without light and water. The picture is called Christmas-2022. " The post was written in English, his text was a signature for the picture of the Ukrainian artist Ivan Yurchuk “Christmas of 2022”. In court, Vasiliev said that he deleted all his accounts after the seizure of equipment in May 2023.

Vasiliev admitted that he posted the post, but refused to consider this a crime. He said that he pursued his publication "exclusively religious", not political goals. " According to Vasiliev, he wanted the Christmas truce proposed in 2022 by the Ukrainian side to take place, and "people remained alive." The news of the dead residents of Kherson was “very personal” for him, because his relatives lived in the city, about whose fate he “still does not know”.
