The court awarded the Perm oppositionist Konstantin Okuneev a compensation for one ruble for the inaction of the police in a criminal case of slander against him. It is reported by Perm 36.6.
In 2022, the head of the local branch of the Cyber Front Z movement, Viktor Korovkin, accused Okunev on his VKontakte page of allegedly organized an unfinished rally. In response, the opposition filed an application for slander. The security forces conducted an examination and found that in the words of Korovkin it really contained slander.
Law enforcement officers opened a criminal case of slander in social networks (part 2 of article 128.1 of the Criminal Code), but not against Korovkin, but against an “anonymous user”. The security forces substantiated this by the fact that the author of the author of the post could not be established. Okunevfound a personal phone, address and place of work of the offender, but did not convince the police that this person is an “unknown user” that appears in the criminal case. Later, the case was closed due to the expiration of the statute of limitations.
Okunev decided to file a lawsuit about the inaction of the police and attempts to delay the case. As a result, the court sided with the opposition and decided to recover one ruble in his favor. As the lawyer of the activist Ivan Skorukin said, they are satisfied with the court decision.
“The meaning of the claim was to establish the very fact that the red tape took place. Therefore, the amount of the claim was a symbolic 1 ruble. As a result, the requirements of our principal were satisfied in full, we heard at the end what is happening quite rarely: to satisfy the requirement to recover compensation for violation of legal proceedings within a reasonable time, ”said the lawyer of the Zvezda telegram channel .
Konstantin Okunev is a former deputy of the Legislative Assembly of the Perm Territory. Previously, he was fined more than once due to posts on social networks. In July 2023, he was fined 250 thousand rubles due to post with a negative assessment of Putin's personality. Then the protocol for it was drawn up under an article on disrespect for society and the state (part 5 of article 20.1 of the Code of Administrative Offenses).
