Roskomnadzor considers “consent to the processing of personal data” obsolete and proposes to refuse them

The head of the department, Andrei Lipov, believes that the institution of consent to the processing of personal data is extremely outdated. “It was probably effective at the dawn of the emergence of Federal Law 152 on the processing of personal data, when it left the content of consent to the discretion of the citizen and the company where the person came and which asks him to sign such consent,” says the head of the RKN.

According to him, over time, the number of consents has increased so much that a person is not able to control them, and it is difficult to defend his rights if doubts arise about the legality of these consents.

Instead, the agency proposes to establish clear rules for each industry - what data can be collected, how to store it and to whom to transfer it.

Lipov said that the RKN has sent relevant proposals to the government to include them in the second package of measures to combat fraud and consider it at the autumn session. The head of the RKN also said that the creation of an institute of special personal data operators is currently being discussed at the government level with the involvement of industry representatives.
