The court did not consider the claim against Telegram restrictions

The Tagansky court decided that the plaintiff does not have evidence to represent interests in defense of messengers

The Tagansky District Court of Moscow terminated the proceedings on the administrative claim of the Russians against Roskomnadzor and the Ministry of Digital Development to recognize the restrictions on calls in the Telegram and WhatsApp messengers as illegal.

The court indicated that “the plaintiff has not provided evidence that he is authorized to file a claim in defense of the rights of the owners of the Telegram and WhatsApp information resources.”

The essence of the lawsuit against restrictions on Telegram and WhatsApp

The lawsuit was filed on December 23 by Kaluga activist and politician Konstantin Larionov together with a group of Telegram and WhatsApp users. At the time of termination, the number of plaintiffs reached 106 people. The applicants demanded that the actions of Roskomnadzor and the Ministry of Digital Development to restrict calls in instant messengers be declared illegal and unfounded, pointing out that mobile communications and SMS remain the main channels of fraud.

The plaintiffs also insisted on the priority of freedom to receive and transmit information, as well as the protection of communications and privacy.

The press service of the Moscow courts reported that Konstantin Larionov did not prove that he has the authority to represent the interests of the owners of the information resources Telegram and WhatsApp in court, and therefore the proceedings in the case were discontinued.
