We visited my office. I am already writing a second book about my work with Chechens, and this is insanely interesting. If God gives me strength, this book will see the light. How much, in your opinion, is the image of a Chechen-beer now relevant?
Indeed, there are Chechens who are fighting in Syria from the Russian side, there are Chechen volunteers in Ukraine, on both sides. Although the security forces are forced to fight for the separatists in the Donbass.
The German intelligence services actively use the information of Russian colleagues. For example, they are informed: sixteen Chechen families are preparing a terrorist attack. The police come home, searches, checking. The German media media is widely covered, the people are reading. Recently, the car was detained in Düsseldorf, chopped down that four armed Chechens were sitting there. They began to understand, it turned out that it was not the Chechens at all. But further the media silence. No one analyzes what happened, does not refute suspicions, does not bring an apology.
Russia sows distrust of the Chechens. Therefore, it is easier for European politicians to disown the reception of refugees from them, but on the contrary, to promise their voters to reduce their number.
Why have people have been waiting for a solution to refugee status for years?
Three years ago, a huge number of Syrians arrived at us. In this regard, many cases of Chechens postponed a “long box”, suspended their consideration. First we decided to deal with the Syrians. The Chechens were waiting, received benefits. They taught the language, the children studied the school, thought that they had already integrated. And now the state has reached them. And then they say to people: “Go back to Poland (if they arrived from there)!” If Poland confirms that a person crossed the Polish border and registered, they will send him there. But if the procedure dragged on, or the refugee took a certificate of illness, or the officials did not have time to prepare the documents, then there is a chance to stay. Four months ago, a young man, who was terribly poured in Russia, was beaten with bottles of water or sand, so as not to leave traces, but still he was all blue and his legs were mutilated. Relatives managed to redeem the guy from his executioners, and he escaped. In Germany, he was accepted by the surgeon, sent him to examine the heart. It turned out that a violation of the heart is a consequence of torture. But although torture and mortal danger of his return to his homeland were proved, the migration authorities said that he had no sufficient reason to receive asylum.
- German state deals resort to your help, consultations?
Now I am considered in Germany a specialist according to the traditions of the peoples of the Caucasus, Ekkehard laughs. So, I was invited to Bonn to instruct the police delegation, which is sent to Georgia to exchange experience. I must enlighten them, what kind of country, what culture, history, what hidden threats. Several times I conducted seminars for migration employees about the culture of Chechens. In Munich, in Frankfurt on Main, in Brandenburg. After all, it is necessary that officials who work every day work more correctly, taking into account the specifics of their character. Chechens are a special people.
They never had the feudal system, they were not in hierarchical subordination, their environment reigned equal rights and freedom was valued. Chechens never enslaved neighboring peoples. They love their lands, their mountains, where the graves of their ancestors are located. They themselves, too, do not want to be a subordinate position. Even fighting with them, it will not be possible to enslave. Only destroy.
It is also necessary to take into account the historical memory of the Chechens. They remember every case of mass reprisals from the authorities over the past few hundred years. For them, the tragedy of Dadi Yurt is alive, when the soldiers of General Ermolov killed men, women and children so cruel that many prefer to commit themselves, if only not to be captured. And, of course, the memory of the people stores the genocide of the 40s, the deportation for thousands of kilometers from the house, the suffering of the last two wars. These people really value when a stranger is interested in their history, shares pain, understands, sympathizes. Based on such a dialogue, you can make friends with them, work, build a strong relationship. Engaged in this work, of course, I myself risk. Accepting refugee houses, I am not safe from the fact that one of them will be a dummy face and they will simply kill me for helping people who are objectionable to the Russian authorities. Sometimes, waiting for a stranger, I call the guests of another Chechen, proven, so as not to be alone. Alas, this is not always possible. But I, as before, open the door to everyone. Sometimes you have to disassemble criminal stories, because among Chechens, like any community, criminals come across. It should be noted that they do not steal. But they consider it necessary to intervene if fellow countrymen fight with someone. This has repeatedly happened in the Haimas of the refugee camps. There is such a system. When the refugee arrives, he must live for three months in a large regional Haime. There, a young couple can easily be attacked. There is an interesting explanation for this. Say, a large family in Chechnya decides that someone from young couples should go to be saved in Europe. Find cores and send. Therefore, in Germany there are many young beautiful Chechens. Arabs and Africans live in the same Haim, among whom, on the contrary, the vast majority of men. They begin to show increased attention to Chechen women. Husbands don't like it. The conflict flashes, often three hundred people from each side are connected.
As a rule, it is possible to solve the problem by resorting to the Chechen adams. They choose the eldest, the most intelligent, at least a little knowing German, turn to the opponents, ask to act in a similar way. And they agree: "Why do we need to fight and kill each other? After all, we came here to survive."
Once in Berlin Haim there was a terrible fight due to the fact that Chechen boys photographed a Syrian girl. Her countrymen staged a brawl, had to attract the police. The next day, the newspapers wrote that seventy Chechen Islamists attacked us Christians in the Syrian Christian there. Not but it was. Lozhov outline! They achieved reconciliation, and soon recent enemies prayed together.
Are there non -trivial cases? Sometimes they call me from the police for advice: “What to do, Ekkehard? We have a Chechen girl. She married a German, it turned out that she broke religious dogmas and traditions. The family wants to kidnap her. Do you think it is really dangerous?” I reply that if it is a strong clan, then she is threatened with death. She must change her name, surname, place of residence and other data. Partly in this situation, the parents are to blame, the girl had to teach Chechen laws, explain that such a marriage was unacceptable. But in Europe, part of the traditions is lost.
I specifically created the Chechen cultural center so that there was a place where Chechen youth will tell what the papa is, what a dagger is, how history developed. This center existed for three years, but the state did not support us, and I myself could not provide everything alone. Now in Germany there is a prejudice against refugees and in particular against Muslims. But each person, persecuted for beliefs, for religion, on a national basis, has the right to azul under the European Constitution. This is not charity, but the implementation of the law. Refugees ask for what they should. Brest is no longer a way out of several European social activists who are engaged in help from refugees, asked me to convey to future applicants asylum so that they would not come to the Belorussian Brest - the city through which for a decade and a half years has been running the path of Chechens to Europe. In the train to the Polish border, here they are allowed without a Schengen visa. Only now, since the “right” government came to power in Poland, this country does not accept this country almost none of the potential refugees.
People go and travel, spending considerable funds on rented Brest and train tickets, but their hopes are divided about the adamant of the border guards. Money ends, people face poverty.
- Once, making a report, I went on the same train. I know that refugees are pushed by the last wagons, and the station in Tereshpol is closed before its arrival.
- Yes, there is only one train from Brest to Terespol, early in the morning. Therefore, we arrived the night before to have time to meet him. When he arrived, we knocked on the door of the station, explained that we were legal representatives of refugees, that we would like to see our clients clients, that we know about their intentions to ask for the power of international protection and we have the right to attend. They did not let us in. We stood at the door for five hours, but did not retreat. At first, the border guards did not want to listen, then they began to send us to a separate department, to a certain office. Allegedly because we are strangers and cannot observe the border crossing.
All these negotiations were filmed by television. We gave our arguments in response. When refugees are trying to get to Poland, they are announced to administrative proceeding of entry. It is carried out on the spot, and a negative decision is quickly issued. Quickly, because you have to have time to send the whole mass of refugees the same train back to Brest. But since this is an administrative case, the lawyer has every right to be. Our clients also had a power of attorney for us and filled profiles for the provision of international protection.
- How do they motivate the refusal?
- Border guards are building a conversation in such a way that a person is confused and said something that will give a formal one - an occasion explains not to miss Sylvia. It is for example a border, they ask: "What will you do in Poland? Are you going to work?" The Chechen replies: "Yes, I have a family, five children, I want to earn money." Then the border guard writes: "He arrived for economic reasons." The refusal is ready. To clarify such nuances, a lawyer needs to be near. In his presence, turning on this scheme is problematic. As a result, out of fourteen lawyers, only two were launched to the principals. They issued administrative decisions to refuse to the principals at the entrance to Poland. The lawyers decided not to take refusal papers, asked to draw up an administrative protocol and introduce all the actions of officials into it. Otherwise, it turned out that everything went according to the law and lawyers agree with everything. The Chechens said in their presence that they want to get international protection. But the border guards recorded a completely different one issued all the unsubscribes about the "lack of a visa".
- It turns out that formally all the actions of the border guards are true?
- Yes. In addition to official papers, border guards are official
Notes. Unlike protocols, this is a purely internal document. One of our customers, the note says that oh he is going to Poland for sports training. The other that he wants to visit Germany's acquaintances. Not a single document reflects the fact that these are refugees who are saved from the torture of threats. For us, colleagues became a real shock that we were not allowed to our customers. We first encountered such lawlessness. As a result, we all the same took the refusal and appealed.
The first appeal is submitted by the Main Directorate of the Border Service. Their answer was waiting for a very long time. According to the law, there is a month. They did not wait. They filed a complaint with the ECHR (European Court of Human Rights). And then suddenly all the answers came. These were just refusals, but they gave the opportunity to cross the next stage - complaints of the Governor Administrative Court to Warsaw. Further, in order not to waste time, I decided to use the mechanism provided for by the European court. Another case can be considered the ECHR faster than the main one.
So, you can forbid any institution to deport a person from the country if, where he is returned, he is threatened with torture. The law says that if someone is already the EU country and is waiting for the consideration of their business, it cannot be deported. And here is a unique situation. Our customers have not yet crossed the administrative border, although de facto has already entered Tereshpol. The ECHR Tribunal took the side of my client, deciding that in this case, deportation is also unacceptable. This is the 39th article of the Charter of the European Tribunal. The tribunal has one day for consideration by a similar application.
We were answered in 3.5 hours!
- This is the efficiency!
- But this is a very rare method of solving the problem. It can be applied not to the situation as a whole, but to one specific refugee. The decision was immediately received in the Polish Ministry of Internal Affairs, which by law is obliged to immediately instruct border guards. The client received his copy of the decision and again appeared with him in Terespol. I called the border, said that it was my client, that he could not be deported, that he wants to ask for international protection, and in addition, he has paper from the ECHR, since his case is exceptional. But the security forces once again ignored the law: this man was again "deployed" on the border.
It should be noted that the Belarusian human rights organization Human Constant achieved a similar decision on the Chechen family. Then the border guards did not really understand what to do about it. In the end, they considered that the presence of an ECHR is a unique option, and they let the family. I remember other isolated cases of successful penetration of refugees into Poland. So, one large family, accompanied by television, overcame the border. But then the security forces were simply scared that the woman, while on demolitions, would begin to give birth to a scandal. None of our trusters managed to help. It comes to the point of absurdity, states Sylvia. - One of the asylum applicants in the refusal wrote that in fact he was not looking for international protection. And if I were looking, then 6 were let him in. It was an answer from the government. What is this situation? A person says to a lawyer that he needs international protection, the psychologist will examine the petitioner and confirms his words. And as soon as the same petitioner gets to the Polish border, he admits that he really needs a Polish wife.
- When my client was not allowed, despite the decision of the ECHR tribunal, I wrote that this is what, your decision was not fulfilled. Therefore, the ECHR sent a request to the Polish authorities, and then the government already responded to the Eurosud. There are these dispatches, the statements of the Polish administration on the adoption of refugees.
Despite all our efforts, the client failed to enter Poland. Then a complaint was filed in the tribunal against the Polish state. There is a weak moment. The ECHR Tribunal has already spoke out in the case of this person. Further, on our complaint, we can make a decision that the Polish government violated the law, and award people who suffered because of this, compensation. There are no other mechanisms of exposure to the European estimate on the Polish executive branch.
Now there is a correspondence between us and the government, which will go to the unsubscribes. Our task is to collect everything necessary for the new sending of the ECHR, and then we will wait for the final decision.
- Except as unspoken instructions from the “right” Polish government, it is difficult to explain such a delusional situation.
- Yes. It seemed to me and my colleagues that the Chechens were a completely obvious case and the most likely contenders for refugee status. Chechnya region, where there are all the prerequisites for this. Say, it is much more difficult for citizens of Uzbekistan to justify why they are looking for refuge.
- How do others perceive your work related to the help of refugees?
- In B recently I get a lot of threats on the Internet. When a note or report with a mention of my role is published, vulgar, boorish comments appear under it. And I receive private messages of this variety on Facebook. But Chechen cases
