The justification is impossible

For ten months there was a trial of Albert Khamkhoev, a boxing coach. In fact, all the athlete’s fault is how Dosh wrote more than once that he had a chance to train in the same hall with a killed participant in an attack on the post of police on the Caucasus federal highway near the rural settlement of Yandar in Ingushetia. In the case of this accusation, of course, no formally everything is built on a tossed weapon: this simple trick managed to become traditional.

Judging by the state of things on television programs, one might think that athletes from the authorities of the republic on a special account are given foreign cars, apartments, they are shown through federal channels during the Olympiads. However, this is only a front facade, which is sometimes hidden completely different. So, in 2013, the athlete Ahmed Buzurtanov, the head of the Kaloy Team Fight Club, was stolen by unknown athlete. From the authorities, it was not possible to get an intelligible answer to a more than legal question, what happened. Buzurtanov is still listed as missing.

The history of the misfortunes of Albert Khamkhoev, we recall, begins with the fact that, returning home from fees in Moscow, it was called to the FSB, surveyed and almost immediately released. However, while he was in Moscow, an attack on the post of traffic police took place in Ingushetia. And in the hall of the fitness center, where Khamkhoev worked as a coach, one of the participants of the attack by the name of Murzabekov trained. In October 2017, the security forces came to Khamkhoev, threw the athlete a gun and began to demand that Murzabekov gave this gun to him. Albert was subjected to torture in the dungeons of the PEP noted already known in Ingushetia. “They put the wires on my fingers, and then on my earlobes” the athlete describes his experience within the walls of the “ED center”. “When I asked for water, one of the police officers said that after torture you can’t drink water right away, it can damage health, after 40 minutes you can only. They put on a black bag, beat me with my hands and a plastic bottle filled with water, because of which a hole was formed on the bag, and I was able to see my tormentor, ”says Khamkhoev.

He announced what happened in the "Committee against torture". As a result, the identification of the suspect took place, and he was able to identify the executioner by characteristic signs. Special Forces were already called to detain the convicted person in torture, but at the same time, a new temporarily acting chief of the Central CPE came to the building of the Investigative Committee, where the identification was held (the previous chief was convicted of 7 years in prison), and the identified security official was released. Now he walks at large, not even removed from work in the organs.

Albert Khamkhoev was transferred under house arrest on March 14, 2018.

A former CPE employee, who stated that he was forced to throw weapons was called as a witness to one of the trials, when he refused, that was why he was forced to quit. However, the I.O. During the exchange of replicas with lawyers, he said the head of the EE center that he did not force anyone to throw weapons, and the employee was fired for violating the charter. He also said that they detained many, but no one is offended, only Khamkhoev was indignant.

On September 11, 2018, the court, despite the obvious fact that Alberta was tortured, sentenced him to a conviction: 1.5 years conditionally for storing weapons. No evidence of Khamkhoev’s guilt was presented during the trial, the verdict was unfair, said Timur Akiev, head of the office of the Memorial PC in Ingushetia. The case of the torture of Khamkhoev is delayed, the representatives of the "Committee against torture" Magomed Alamov and Albert Kuznetsov, who are engaged in the statement of Khamkhoeva, said.

The defenders filed an appeal, and on October 24, 2018, the case was revised in the Supreme Court of Ingushetia, but the judge took the very beginning of the process, referring to the fact that in February 2018, considering the appeal against Khamkhoev, the preventive measure, granted the defense petition, excluding the letter from the CPE, and thereby evaluated evidence criminal case.

On November 13, 2018, a new meeting was held in the Supreme Court of Ingushetia on the consideration of an appeal against the sentence of Khamkhoev.

The new judge Aliy Ozdoev left the strength of the conviction to the athlete, counting his arrested by his arrested by Khamkhoev of conditional imprisonment.

Recall that on September 10, 2018, the Nazran district court sentenced Albert Khamkhoev to one and a half years in prison, finding him guilty of illegal storage of weapons (part 1 of article 222 of the Criminal Code of the Russian Federation). Khamkhoeva lawyers Alexander Karavaev and Dzhabrail Kuriev considered this sentence unjust, unmotivated and unreasonable, and the conclusions of the court were erroneous. According to lawyers, the evidence of the guilt to which the court referred to, are not even more so since some of them are obtained illegally. In their appeal, lawyers asked to cancel the illegal sentence, stop the criminal case against Khamkhoev and consider the possibility of granting Khamkhoev the right to rehabilitation. The representative of the state prosecution considered the verdict justified and asked the court to leave him unchanged.
