Can those convicted of racist attacks be granted amnesty?

The amnesty adopted by the State Duma will affect first line of minors. Those among those convicted of racist attacks a lot. But, as far as we know, all who are now deprived of their freedom have sentencing articles excluded from the amnesty.

Use of the article "Hooliganism", taking into account the motive national or other hatred is widespread in the persecution violent crimes committed for similar motives.

On the one hand, the extremely unfortunate current wording of Art. 213 of the Criminal Code (“Hooliganism”) allows you to bring absurd accusations, such as those that were presented to members of Pussy Riot. On the other hand, the accusation hooliganism motivated by hatred is often used to qualify real racist attacks where, according to the prosecution, the attackers combined hooligan motive and hate motive. Sanctions under Art. 213 of the Criminal Code, especially on its 2 parts that are quite heavy, which adds to the article's "popularity" among investigators.

We know several dozen cases of application of Art. 213 of the Criminal Code to racist attacks, but only a few will be able to be released under an amnesty person, since the rest of the verdict contains articles excluded from amnesty, or these people have already been released.

About all the people listed below, we do not know if they went out they are already free: parole could be applied to them, and in some cases we do not we know the date of arrest and, accordingly, the date of completion of the term. But if they don't left, an amnesty can be applied to them.

First of all, these are two people, since they have in their sentence there is only st. 213:

Said-Hussein Dudaev , attacked fellow villagers in a drunken state with xenophobic cries.

Andrey Scriabin , member of the Nazi skinhead group in Yaroslavl, who participated in the series attacks.

Vyacheslav Kolobaev , convicted of attacking an alleged native of the Caucasus in an electric train, also had this article in the verdict.

Y. Mansilla, O. Chekashkin and E. Verentsov were convicted of attacking a native of Central Asia in the Moscow metro, moreover, the first in the verdict has the same Art. 115, and for the other two - art. 116 ("Beatings").
