One foot in the Union

Vladimir Putin introduced a bill on the introduction of criminal liability for the violation of the rules for the registration of citizens at the place of residence or stay to the State Duma. This step will finally restore the Soviet registration system. In modern language, the registration was one of the "tags" of the Soviet lifestyle, along with the collective farm, communal apartment, gulag, Komsomol, five -year plan and social obligations.

One of the super -task of the Putin system is to know who, where, with whom he lives and what he does. Putin, which grew under the banner of Leninism, apparently, for the rest of his life, was remembered by the Leninist "socialism - this is accounting." They need to take into account us in order to know exactly where to get us if they count that it is time. There is nothing worse than crossing a security officer with a socialist. Well, perhaps a cross between a Gestapo with a Nazi.

There is nothing new under the sun. What happened will be. Under Soviet power, an article 198 of the Criminal Code of the RSFSR "Violation of passport rules" - and again will be. Maybe under a different name and with other sanctions, but there will be. This is the iron logic of the Putin regime. Whatever he wants to build, but it turns out a scoop. However, it will not be quite so - it will be worse. Soviet legislation punished for such a "crime" by deprivation of liberty up to one year. Putin plans to give up to three.

For violation of registration rules, it is proposed to be punished with a fine of up to 500 thousand rubles (it was given to them that Putin, that Medvedev, this amount is half a million; as if everyone in the country is so steep!), Forced labor or imprisonment for up to three years.

So far, the criminal norm applies to only those who register visitors in violation of the rules. But the dashing trouble has begun. While the document reaches the last reading, a lot of new ones may appear in it. In addition, the article at any time is easy to supplement with new subjects of responsibility.

At the same time, Putin also offers criminal measures administrative. Accommodation without registration is considered an offense and is punishable by a fine: for individuals up to 5 thousand rubles, for legal entities - up to 750 thousand. According to the already rooted anti -constitutional tradition, in Moscow and St. Petersburg, fines will be higher - up to 7 and 800 thousand, respectively. Why anti -constitutional? Because Art. 19 of the Constitution of the Russian Federation "guarantees the equality of the rights and freedoms of man and citizen, regardless of ... place of residence."

But what about Putin to the Constitution? He is on its own, she is on its own. In the same way, he also spit on the decisions of the Constitutional Court. The introduction of criminal or administrative liability for violation of the registration rules directly contradicts the decision of the Constitutional Court of the Russian Federation No. 4-P of February 2, 1998, which records: "... the fact of registration or absence of one does not give rise to any rights and obligations for a citizen and ... cannot serve as a basis for the restriction or the condition for the exercise of the rights and freedoms of citizens provided for by the Constitution of the Russian Federation".

An attempt to establish administrative responsibility for living without a TOP of registration of the time established by law also contradicts the decision of the Constitutional Court: “The establishment of the period after which the citizen is obliged to leave the place of stay is the intervention of the executive authorities and other registration authorities to civil, housing and other legal relations that develop on the basis of the consent of the parties, and limits the constitutional right of citizens to the freedom of choice of place stay and residence.

Of course, they were the "dashing 90s" when the Putin-like cavalrymen opposed constitutional law and the state could be limited in their capabilities to rejoice the rights of citizens. Today all this is not at all in sight. The slogan of today's government - "I do what I want!".

In support of his legislative initiative, Putin gives the problem of "rubber houses" when up to several hundred citizens are registered in one apartment. So the problem is not houses or citizens, but stupid laws that oblige people to register in some specific place! Again, this norm is contrary to the same decision of the Constitutional Court: "... the citizen’s determination by the place of his stay and the deadline for being in it is not necessarily related to the presence of the corresponding residential premises as a place of stay." In other words, in accordance with the law (the strength of which has the decision of the Constitutional Court), you can not register in the apartment, but in the city. He arrived, went to the police and notified that you are in this beautiful city, and where exactly, not your business.

The mechanism for using such a legal remedy as registration should not serve as the goals incompatible with its notifying character, since otherwise leads to excessive restriction of the rights and freedoms of citizens in the field of civil, housing, family and other legal relations. Registration authorities are authorized only to certify the act of free will of the citizen when choosing a place of stay and residence. That is why registration can not be permissive and should not lead to restriction of the citizen’s constitutional right to choose a place of stay and residence.

This paragraph was written not by me, but by the judges of the Constitutional Court. They addressed him from 1998 to Putin in 2013. It is unlikely that he does not know this decision of the KS at all. Just today, the authorities cynically demonstrate the power of lawlessness to society. Laws and by -laws that contradict the decision of the Constitutional Court are already in force in the country, now they want to add new ones to them.

Recently, a lot is talking a lot about the upcoming lustration, under which the functionaries of the current regime should fall. So, they will not even need lustration - their measures to restore registration fall under Article 315 of the Criminal Code of the Russian Federation. This wonderful article states that the malicious non -fulfillment by the representative of the court verdict, the decision of the court or other judicial act, as well as the obstruction of their execution are punished by deprivation of liberty for up to two years. Putin, his administration and puppet deputies of the State Duma should not forget that they commit a crime.

Which of them is more to blame, and who is smaller, an independent court will understand. Not today, of course, and not even tomorrow. But someday it may well happen. The fact that Soviet criminals managed to avoid punishment in the 90s does not mean that it will always be so. History is not obliged to repeat.
