Sergei Pchelintsev is recognized as insane, which means that he is exempted from criminal liability. It cannot be called “accused” or “guilty”, since the concept of guilt is applicable only to persons who can realize the actual nature and social danger of their actions.
The trial in the case of Pchelintsev took place in accordance with Chapter 51 of the Code of Criminal Procedure. According to Article 442, the court had to investigate the following issues: 1) whether the act prohibited by the criminal law took place; 2) whether the act committed the person against whom the criminal case is being considered; 3) whether an act was committed by a person in a state of insanity; 4) whether the person’s mental disorder, which makes the sentence of punishment or his execution, has come in a person after committing a crime; 5) whether the mental disorder of the face poses a danger to him or other persons, or is it possible to inflict other significant harm to this person; 6) Is a forced measure of a medical nature subject to use, and which one?
All questions were given a positive answer. Yes, it was Sergei Pchelintsev killed Pavel Adeelheim, he has paranoid schizophrenia, and he can be dangerous to others. Judge Galina Belik issued a decision on the application of forced medical measures to him. Every six months, the court, relying on the materials provided by the doctors, will decide the issue of extending or terminating forced treatment.
In Russia, today there are eight psychiatric hospitals of federal subordination intended for the treatment and rehabilitation of mentally ill persons who have committed socially dangerous acts in a state of insanity and exempted from criminal liability by court decision. The nearest of them is located in St. Petersburg (full name: the Federal state institution "St. Petersburg Psychiatric Hospital (hospital) of a specialized type with intensive supervision" of the Ministry of Health of the Russian Federation). Svetlana Kovaleva, the mother of Sergei Pchelintseva, expressed the desire that her son would be placed in the St. Petersburg clinic.
The defense did not dispute the conclusions of the investigation and did not present its evidence. Pchelintsev himself and his legal representative also refused to participate in the debate and testify. “It is very difficult for me to remember all this,” answered the questions of judge Sergei Pchelintsev.
At the request of the state prosecution, the testimony of Pchelintsev, given to him during the investigation of the criminal case, were announced. The prosecutor Marina Yakovleva read out several protocols.
The first interrogation carried out in the hospital, where Pchelintsev was after an attempt to suicide, did not give anything to the investigation: “The question of the investigator: how did you end up in the hospital, remember? Answer: I was picked up on the street with a knife wound. ” At the second interrogation, he mainly told the investigators about the headaches that he suffered from the age of six (after the divorce of his parents), studying at VGIK, relations with Anna Shishova (“She needed an operator, and I fell in love”) and an appeal to religion. About what happened on the day of the murder, Sergey Pchelintsev was able to tell the investigators more or less in detail in two weeks.
According to him, since June last year, he stopped taking pills from his head, because he found out that very strong coffee has exactly the same effect as drugs. However, insomnia began from coffee. And by the time of the trip to the Pskov (on a private car from Zelenograd for 16 thousand rubles - I thought that the train costs about the same, although I did not recognize the price for a ticket) Sergey did not sleep for almost a week.
“In connection with the insomnia in my head, everything is mixed up, so I can’t restore the exact order of events,” was recorded in the interrogation protocol of August 23, 2013.
Sergei Pchelintsev arrived in Pskov early in the morning. He himself could not find the desired address and called the city number in the house of the Adeelheim. Introduced herself to Vera Mikhailovna: "I'm from Ani." Mother Vera explained how to find them, met and suggested that the guest complained of fatigue. Soon Father Paul came. We met. The priest invited Sergey to go to a meeting with pilgrims - Witness Anastasia Volkov spoke in detail about this episode in detail. She, together with Adeelheim, drove Pchelintseva to the city hospital, where he was examined by the neurologist Anna Dmitrieva, who also testified on January 22 [ 1 ].
A confused, torn story, written in the dry language of the interrogation protocol, surprisingly accurately reproduces the condition in which Sergei Pchelintsev was on August 5.
“Since at that time I felt bad because of insomnia, I had an increased pulse, which was constantly from the 20th of June 2013, and I asked Father Paul to lie down or go out to breathe fresh air. They opened the door to me, I left the house outside and lay down on the lawn, where I lay down for 15 minutes.
Then I returned to the apartment where he told Father Paul that he called a car that would take me to a neurological hospital so that they would have a injection and I could sleep because I had not slept for seven days. Father Paul said that I do not have to go to a neurological hospital, they will take me to another. In this car, we went to the hospital, in which - I don’t know, I don’t remember where it is.
Together with Father Paul, we went to the hospital, and I told the nurse that I did not sleep for several days, I had an increased heartbeat and I could not fall asleep. They made me two injections and gave me a pill. What kind of injections and pills were, I did not ask, apparently, some kind of sedative.
After the injection and taking the pills, I felt worse. I don’t remember anything at all.
The next thing I remember is that I am sitting on the steps of a store. I called Father Paul from my mobile phone and asked me to pick me up. It was in the daytime, I don't know the exact time. I don’t remember anything further again.
Then I remember that I am sitting with my father in the city of Pskov in the kitchen in the house of Pavel Adeelheim. We talked about something, I do not remember the meaning of the conversation. Further, we seemed to be with my father on a train in the city of Pskov.
On the train, Anya Shishova called me on a mobile phone, she said that I was crazy and that we could not have children. Further, everything is dull, I was very upset because of this.
The next thing I remember is in the hospital, and I am recorded on camera. To date, I can’t explain anything from the circumstances of the case. ”
It is difficult to imagine something more terrible-suddenly find out that you killed a person. In addition, a remarkable person, a rare person, to whom he himself turned for help.
There are people who survive your crime, their irreparable mistake is much harder than a crime against oneself. It is not known whether Sergey Pchelintsev belongs to this type.
The only thing he said in court: “I want to ask for forgiveness from relatives, primarily from Vera Mikhailovna, for what I did. Forgive me. "
“God will forgive,” Vera Mikhailovna answered quietly.
On the final part of the process, when the judge read out the decision, Mother Vera brought with him the icon “saved the miraculous”, about to convey it to Sergey Pchelintsev: this image in the Orthodox tradition is endowed with the ability to heal the patients. In order not to transfer the icon through the convoy, Vera Mikhailovna gave it to Svetlana Kovaleva.
Both women left the courtroom together.
