The court defended the medieval cultural layer in the center of Pskov

On August 15, the Arbitration Court of the Pskov Region declared illegal the decision of the Pskov city administration to allocate land for the construction of the Flowers pavilion along Pushkin Street, since this decision was made without the consent of the Research and Production Center for the Protection and Use of Historical and Cultural Monuments.

Defenders of Pskov monuments are sincerely happy with this decision of the arbitration court.

On November 14 last year, by order of the city administration, a private entrepreneur was allowed to build a kiosk selling flowers in the park near the drama theater. According to the mayors, this wooden structure was supposed to decorate the face of the city for the future anniversary.

Everything would be fine, but they decided to sell flowers in the historical part of the city, where even wonderful flower pavilions must be set up, first of all, after coordinating the construction with the Center for the Protection and Use of Historical and Cultural Monuments. The result of non-compliance with the law is an unpleasant situation for the mayor's office and considerable losses for the entrepreneur.

According to the director of the Center Vasily Musiychuk, verbal negotiations with the city authorities and the businessman did not give any result, so they had to go to court. The woman entrepreneur reacted to this decision by increasing the pace of construction, hoping for the support of the city authorities. Meanwhile, the city authorities began to assure that after a year of lease the pavilion would be demolished (an extremely original method of supporting small businesses!). But with the expiration of the contract, the owner of the outlet could, in court, demand the continuation of the right to lease.

Those who think that the center for the protection of monuments was simply offended for inattention to their own person will be mistaken. The construction of such a structure not only does not fit into the appearance of the historical part of Pskov (although the author of the project has some attempts to give his brainchild original Pskov features), but also does not agree with the plan for the reconstruction of Pushkin Street, as well as with the project for the restoration of the regional drama theater, outlined for 2002– 2005 years. In addition, it is necessary to pull communications to the pavilion, and, therefore, violate the cultural layer.

Vasily Musiychuk noted that, although many rash decisions were made in Soviet times (who wants to admire their results, walk along both embankments of Velikaya), now both because of the legal illiteracy of the developers, and due to the lack of a sense of proportion in some of them and harmony, there were quite a lot of violations of the law on the protection of monuments.

According to one of the participants in the trial on the ill-fated flower pavilion, the court decision was made quickly and in favor of the Center for the Protection and Use of Historical and Cultural Monuments, largely due to the position of the Pskov regional branch of the All-Russian public organization "All-Russian Society for the Protection of Historical and Cultural Monuments". In an interview with a PG correspondent, the deputy chairman of this organization, Antonina Tarasova, expressed her fears for the fate of many historical places in the Pskov land.

According to her, many violations occur both in the city and in the region, buildings are illegally erected in the protected zones of churches and nature reserves. In the Gdovsky district, for example, residential buildings are being built on the shores of Lake Peipsi in the village of Domozherka, although this is the territory of a nature reserve. The situation is similar in the Sebezh and Pushkinogorsk regions. Local authorities react weakly or not at all to violations of the law. Due to lack of funds, when restoring churches transferred to the Orthodox Church (for example, in the Krypetsky Monastery), the restoration technology is violated.

So the defenders of the historical and cultural heritage still have to rely not on the authorities, but on the prosecutor's office and the court.
