On June 29, 2005, the Moscow Regional Court, upon the application of the Moscow Regional Prosecutor's Office, decided to liquidate the National Bolshevik Party (NBP), i.e. Moscow regional organization of the NBP. (This organization was the legal entity of the NBP). According to Article 44 of the Law "On Public Associations", the liquidation of an association by a court decision "means a ban on its activities."
The reasoning part of the verdict will be announced later. Prosecutor Natalya Maltseva said that " "even if the regional court sees signs of extremist activity in the NBP's actions in the reasoning part, a separate court decision will be required to recognize it as an extremist organization .
In fact, a separate court decision is not required for this. If the motivational part of the decision mentions the extremist activities of the organization, the organization will be considered extremist after the ban. And for such organizations, article 282.2 of the Criminal Code provides for imprisonment for up to two years for "participation in the activities of a public association, in respect of which a court has adopted a decision that has entered into force to liquidate or ban activities in connection with the implementation of extremist activities" .
