“Trepashkin was arrested illegally ,” said E. Liptser. “ Both the very fact of the arrest and its execution contradict existing laws. Firstly, the prosecutor’s office of the Sverdlovsk region protested the decision to release Mikhail later than prescribed, and secondly, the prosecutor’s protest is not reason for the arrest. The cassation court decided to send my client’s case for a new trial, but did not provide for a preventive measure. An arrest can only be applied by a court decision; a summons is sent to the suspect in advance, which was not done in this case.
