On September 26, 2005, Stanislav Dmitrievsky, editor-in-chief of the Pravo-Zashchita newspaper, having completed his acquaintance with the materials of the criminal case initiated against him, filed two motions with the investigator of the regional prosecutor's office Oleg Kiryukov - to exclude inadmissible evidence from the case materials and to terminate the criminal case due to lack of corpus delicti in his actions.
According to Dmitrievsky, the main evidence - the conclusions of a linguistic examination - were obtained by the investigation with gross violations of the criminal procedural law, and therefore are subject to exclusion from the case file, and since there is no other evidence of guilt in the case, Dmitrievsky and his lawyer Yuri Sidorov filed a motion to terminate criminal case due to the lack of corpus delicti.
According to Dmitrievsky, his applications will be denied.
