On July 18, 2006, the Moscow Regional Court sentenced two young people for a series of crimes , including a murder motivated by ethnic hatred. The verdict was handed down on the basis of the jury's verdict, which found the defendants guilty of these crimes.
Andrey Shishkin (born 1978) and Alexei Kuznetsov were involved in the case. They were accused of committing a number of murders involving robbery and robbery in the Moscow region and in the city of Ivanovo in the period from October 4, 2004 to June 24, 2005.
The jury found Andrei Shishkin guilty under Art. 105 part 2 p. "a, h, l" (murder of two or more persons associated with robbery motivated by national hatred); Art. 162 part 4, paragraph "c" (robbery with causing grievous bodily harm to the victim); Art. 222 part 1; Art. 222 part 2 (illegal possession of firearms, both individually and by a group of persons by prior agreement); Art. 69 part 3 (by partial addition of punishments). Of the three murders committed by Shishkin, two were recognized as murders motivated by ethnic hatred (the names of those killed were Khanbutaev and Shukurov). As a result, Shishkin was sentenced to 22 years in prison in a strict regime penal colony.
The second defendant, Aleksey Kuznetsov, was found guilty under Art. 162 part 2; Art. 222 part 2; Art. 222 part 2; Art. 69 part 3 (i.e. on the same charges as Shishkin, but without the murders). He received 4 years 6 months in prison.
In addition, the court ruled to recover in favor of the victim N. Chebotareva from A. Shishkin on account of reimbursement of expenses associated with the burial, 16,761 rubles, on account of compensation for non-pecuniary damage from A. Shishkin, 200 thousand rubles, from A. Kuznetsov - 30 thousand rubles .
A. Shishkin appealed against the verdict in the Supreme Court of Russia in parts related to the charge of robbery and possession of firearms.
