On November 8, 2006, the Sovetsky District Court of Chelyabinsk convicted three members of the NBP without Limonov party (right-wing radical wing) who were accused of inciting ethnic hatred.
All three defendants were sentenced to suspended sentences. Alexander Nazarov and Ivan Gerasimov were sentenced to 1.5 years of imprisonment on probation, Konstantin Ogoltsov - to one year of imprisonment on probation. They are also deprived of the right to engage in professional journalistic activities for a period of one year.
A. Nazarov and I. Gerasimov, who had been under arrest since March 2006, were released from custody in the courtroom.
The convicts were found guilty under paragraph "c" part 2 of article 282 of the Criminal Code of the Russian Federation ("incitement of hatred or enmity, as well as humiliation of human dignity by an organized group"), art. 212 of the Criminal Code of the Russian Federation ("mass riots"), art. 280 of the Criminal Code of the Russian Federation ("public calls for the implementation of extremist activities").
The verdict was delivered at a secondary hearing in a special order.
As a reminder, on October 12, 2006, the Judicial Collegium of the Chelyabinsk Regional Court overturned the earlier verdict against Alexander Nazarov and Ivan Gerasimov, who were found guilty of inciting ethnic hatred (Article 282 of the Criminal Code). The case was sent back for a new trial to the same court with a new composition of judges. A. Nazarov, I. Gerasimov and K. Ogoltsov were detained in March 2006.
