The Supreme Court commuted the punishment of those accused of exploding an anti-Semitic poster in Tomsk

On April 16, 2007, the Supreme Court reduced the sentence for those accused of blowing up an anti-Semitic poster in Tomsk. Thus, the court partially satisfied the cassation appeals of the defendants and their lawyers.

In accordance with the court ruling, the punishment for the accused Viktor Lukyanchikov was reduced from 23 to 21 years in prison, and for Igor Kirillov - from 20 to 18. or enmity"), Art. 209 of the Criminal Code of the Russian Federation ("banditry"), Art. 105 of the Criminal Code of the Russian Federation ("premeditated murder under aggravating circumstances"), Article 126 of the Criminal Code of the Russian Federation ("kidnapping"). The court expelled Article 205 of the Criminal Code of the Russian Federation (“terrorism”) from the charges against the defendants in the case due to the lack of corpus delicti and Art. 119 of the Criminal Code of the Russian Federation ("threat to kill") after the expiration of the statute of limitations.

According to the verdict, they will serve their sentences in a strict regime colony. Another member of the group, Vladimir Istomin, was upheld the sentence. The court sentenced him to a suspended sentence of 6.1 years with a probationary period of 4 years.

The court noted that Lukyanchikov committed crimes motivated by ethnic hatred. "From 1999 to June 2004, he created and led a stable armed group with the aim of intimidating people of Jewish nationality" .

The verdict also states that the members of this group committed a number of grave and especially grave crimes in the region. In particular, in July and November 2002, I. Kirillov, on the instructions of Lukyanchikov, poured mercury twice in one of the restaurants in Tomsk, owned by a Jew. According to the investigation, the convicts planned to blow up the Tomsk synagogue and committed two murders.

The defendants and their defense lawyers asked to commute the sentence or cancel it altogether and stop the criminal case due to the lack of corpus delicti.

Let us recall that on March 10, 2003 the Tomsk Regional Court sentenced the leader of the group, Viktor Lukyanchikov, to 23 years in prison, and Igor Kirillov to 20 years. The court found the defendants guilty of committing crimes under Art. 282 of the Criminal Code of the Russian Federation ("incitement of national hatred or enmity"), Art. 209 of the Criminal Code of the Russian Federation ("banditry"), Art. 205 of the Criminal Code of the Russian Federation ("terrorism"), art. 105 of the Criminal Code of the Russian Federation ("premeditated murder under aggravating circumstances"), Article 126 of the Criminal Code of the Russian Federation ("kidnapping").
