On February 26, 2008, the Adler District Court recognized as extremist the content of the leaflet "You have chosen - you will judge", which was allegedly distributed at a rally on October 28, 2007.
The text entitled "You have chosen - you will be the judge" is a material of the newspaper "Duel", regularly published by it for several years, for which the newspaper was issued two warnings about the inadmissibility of extremist activity. The leaflet is a proposal to hold a nationwide referendum and adopt a new article of the Constitution and a corresponding law, according to which the President of the Russian Federation and parliament deputies should be held responsible for the deterioration of the population's life - up to and including the death penalty. The bill contains a number of proposals that are clearly contrary to the spirit of law, for example, a proposal to actually outlaw officials who harm the people.
The newspaper "Duel" was almost closed, as it also published materials inciting ethnic hatred (and the court considered far from all such materials). On February 28, 2008, the Moscow City Court overturned the decision of the Zamoskvoretsky District Court of Moscow to close the right-wing radical newspaper Duel and returned the case for a new trial in a new composition of the court.
But it should still be noted that in itself the call to hold a referendum, in our opinion, is not extremism. And there are no direct illegal calls in the leaflet, except for the vague phrase: "If they prevent us from going this legal path, then the AVN will force those who prevent us from fulfilling the laws of Russia."
Recall that the Adler court did not consider the reliability of the very fact of distribution of the leaflet.
