
In law enforcement agencies, Moscow summed up the results of the outgoing year. Against the backdrop of anxiety talk about the first signs of a sharp increase in crime associated with the economic crisis covering the country, the prosecutor’s office continues to note a decrease in the number of registered crimes.
According to the results of 11 months, the number of crimes as a whole in Moscow decreased by 9% - from 212,722 in 2007 to 193,655 in the current. At the same time, there is also a decrease in the number of serious offenses by 5%, reports "News Time" with reference to the Moscow prosecutor Yuri Semin.
At the same time, the head of the metropolitan supervisory authority believes that "negative phenomena will still increase." This is primarily due to the financial crisis, which always brings with it a surge of crime, as it was already at the turn of the 1980-1990s and in the second half of the 1990s.
According to Semin, prosecutors must hold their hand on the pulse and carefully monitor all the processes that occur in the city. “After all, one of the main reasons for the growth of crime is the unemployment and worsening of the material standard of life of citizens as echoes of the economic crisis,” he added. “If we do not take specific actions now to prevent a surge in crime or at least weaken it, then the consequences may be the most critical.”
For example, recently, in the context of the financial crisis, more criminal cases associated with the banking sphere have been opened. And this problem is now the most acute.
“We have always supervised the legality in the banking sector, and now we are making even greater efforts in this direction,” Semin added. “We work together with several interested departments.” In particular, the prosecutor's office uses the Central Bank data database and financial intelligence bodies. As a result, a number of criminal cases were instituted related to fictitious proceeds of loans in the Moscow branches of Sberbank.
A criminal case on Mira-Bank was also instituted, whose leaders brought the bank to bankruptcy and at the same time unlawfully satisfied the requirements of the creditors elected by them due to the interests of most depositors.
At the same time, we add that investigators engaged in cases of fraud, and themselves often become victims of killers. On Monday, in the center of Moscow, Killer literally admitted one of the leading detectives to combat tax crimes. And in 2007, a similar crime was committed against the investigator who conducted the case of “Fininvest”.
Semin admits that one of the main problems remains the weak disclosure of intentional killings. For two and a half years, the prosecutor's office has purposefully dealt with these issues. Largely due to this, the number of serious crimes decreased by 12.7%, and the number of registered killings is 5.5%, prosecutorial statistics indicate.
Over the same period, the disclosure of murders increased by 4.1%, and crimes related to the intentional cause of serious harm to the health that resulted in the death of the victim by negligence - by 10.1%. Analyzing these data, we can conclude about the intensification of crime prevention, but Semin urged not to feed too rosy hopes.
“We are aware that the effectiveness of the work is insufficient,” he said. “Low disclosure of murders, a decrease in these indicators compared with 2007 is noted through the territory of the Yuao (by 3.2%) and SEUZAO (by 5.9%).” At the same time, the total number of murders registered in these districts decreased by 28.6 and 15.7%, respectively.
Protection of social rights
The Moscow prosecutor admitted that in Moscow the volume of unpaid salaries is growing. As, however, throughout the country. “And we may not have the highest increase in the non -payment of salaries,” he added. “But nevertheless, this problem is. I can say that on December 1 we had a debt of about 230 million rubles in the city.”
And the whole month earlier, the debt was about 73 million rubles. Therefore, such a sharp jump causes great concern to the prosecutor's office. Employees of the supervisory authority are instructed to track those enterprises that do not pay employees salaries on time. Investigators pay the same increased attention to those companies that send employees on vacation, or even dismiss.
By law, all these people should be paid benefits. For non -fulfillment of these obligations, the company's management should be liable - both administrative and criminal.
“I also set the task for prosecutors the task of applying to the courts in the interests of people who have a salary arrears,” Semin added.
According to him, for the current year, the prosecutor's office was able to reimburse citizens about 150 million rubles. In particular, compensation was paid to the workers of the AZLK plant, which was declared bankrupt. At the moment, the enterprise has introduced bankruptcy proceedings. And the debt for payments to AZLK decreased from 7 million rubles to 341 thousand rubles.
And for other enterprises only in the first decade of December, the measures of prosecutors returned debt in the amount of 8.5 million rubles.
Illegal
Another scourge of the crisis period Semin considers uncontrolled migration. “By the way, the number of crimes committed by foreigners and stateless persons increased by 13.5%this year,” he adds. “This is a great increase in the presence of a decrease in the total number of crimes.”
According to the prosecutor, everyone understands that even in the context of the financial crisis the city will not be able to do without labor migrants. After all, such jobs as wipers are uninteresting in Muscovites, and the streets must be kept clean and tidy.
However, according to Semin, it is important to suppress illegal migration. Meanwhile, it is quite difficult to fight her, since such a disenfranchised position of handymen is beneficial to Moscow officials and businessmen. As a rule, violations of migration legislation are committed at the objects of the economic infrastructure of the city: at construction sites, in hostels, hotels, in the markets.
For example, the prosecutor's office of the South-Western Administrative District of the city of Moscow, together with representatives of the Federal Migration Service of the Federal Migration Service in Moscow in the Yuzao at a construction site located on the trade union street, Vl. 102, cases of illegal attracting foreign labor were revealed. Based on the results of the audit, the head of the enterprise was introduced, the legal entity itself was brought to administrative responsibility.
The prosecutor's office of the Southern Administrative District was verified by the Moskvoretsky Market LLC. Foreigners working on it also did not have work permits, in connection with which the market director introduced a representation, individual entrepreneurs who attract migrants to work were brought to administrative responsibility.
The fight against corruption and its profanity
The Moscow prosecutor believes that the new Federal Law "On Corruption" not only strengthens liability and establishes additional rules of conducting officials (for example, on the issue of declaring the property of both the official and his family members), but also raises the issue of presenting to civil servants of gifts. “These amendments are prophylactic,” Semin adds.
The prosecutor approves these measures of the country's leadership, calling them a step in the right direction. At the same time, he admits that the facts of suppressing serious corruption are extremely few. For 11 months of 2008, 627 facts of receiving bribes were registered in the city. This is a little more than last year.
However, according to the results of investigations, only 132 cases reached the court. “This suggests that the effectiveness of operational work and investigation is low, because all other matters either acquire a long investigation or end even,” Semin explained.
In addition, in general, when an increase in the quality and number of the level of identified facts of bribery is stated, this increase is mainly not due to the case of receiving bribes, but at the expense of giving bribes. For comparison: for this year, under the article "Giving a bribe", 653 cases were sent. Here on this "trifles" are made statistics on the fight against corruption, the prosecutor of Moscow believes.
“Therefore, you need to break such a stereotype,” Semin adds. As an example of an imitation of the fight against corruption, he called cases with elements of provocations, when traffic cops, along with employees to combat economic crimes, make the so-called "sticks", detaining bribery leaders. “It turns out that this is not the fight against corruption, but profanity . It must be resolutely left,” the prosecutor concludes.
Work in a pre -trial detention center
Another chronic problem of law enforcement system of the capital of Moscow called the overload of investigative insulators (pre -trial detention center). To date, the city has seven pre -trial detention centers designed for the maintenance of almost 9 thousand arrested.
“I must say that the problem of overflowing the pre -trial detention center has always existed,” Semin adds. “In Moscow there were periods when, with a sanitary norm, a person in 4 square meters in the cells was two to three times more.” Even at the beginning of 2008, the overflow of the pre -trial detention center reached 10%.
The European Court of Human Rights still receive claims of convicts complaining of inhuman conditions of stay in the insulators, as well as the inaccessibility of justice. And many of these lawsuits are satisfied.
According to Semin, the prosecutor’s office reacts to all complaints of prisoners related to material support, medical care and the terms of detention. “As a result, the problem is gradually solved,” the head of the metropolitan prosecutor's office added.
So, just these days, a new special building should be introduced in the 4th insulator, which is designed to contain 1.2 thousand arrested. This corps was built in compliance with all European norms, and this is already a great achievement, the prosecutor of Moscow believes.
Moreover, now in almost every chamber of the capital's insulators there is a TV and a refrigerator, and before they could have only VIPs.
Sudden prosecutorial inspections play a large role in protecting the rights of prisoners, during which not only the cameras themselves are inspected in the pre -trial detention center, which contains arrested, but also catering, outbuildings.
The inspectors must visit the punishment cell to find out who is in it and how reasonable the punishment is in this case. According to Semin, thanks to these checks and consideration of complaints of the prisoners themselves, many offenses made by the administration of the pre -trial detention center were revealed.
